The petitioner states in her application that she conducted a part-time home electrolysis business at her previous address in New Hope for almost seven years without incident. She states that she desires to continue supplementing the family income while providing a high quality of service and treatment to her clients, and therefore is requesting a conditional Use permit to continue the business at her new address. The Planning Commission and City Council approved a similar home occupation CUP at 3425 Hillsboro in 1988. No Problems were encountered at that location and staff conducted annual inspections. The petitioner moved to 8820 45th Avenue North within the past 12 months and is requesting approval to. operate t_he same business at the new location. The property is loCated in an R-I Zoning District and is surrounded by R-1 uses. The parcel has a 75-foot frontage on 45th Avenue North and contains 10,125 square feet. The existing home contains 1,400 square feet. The business, would be conduCted in a 70 square foot room in the basement of the home. Single customers would park in the driveway, enter the front door for a scheduled appointment, and go directly downstairs to the electrolysis room. 6. The off-street parking at the site is typical of many single family homes in the neighborhood, with a 20' x 45' double driveway and garage. 7, The topography of the property slopes from the backyard to the ~eet. 8. Property owners within 350' of the request have been notified and staff have received several inquiries from neighbors. One resident indicated that they opposed the use. Planning Case Report 95-09 2 ANALYSIS June 1, 1995 The purpose of a Conditional Use Permit is to provide the City with a reasonable and legally permissible degree of discretion in determining suitability of certain designated uses upon the general welfare, public health, and safety. In making this determination, whether or not the conditional use is to be allowed, the. City may consider the nature adjoining, landor buildings, whether or not a similar use is already in existence and located on the same premises or on other lands close by, the effect upon traffic into and from the premises, or on any adjoining roads, and all such other or further factors as the City shall deem a requisite for consideration in determining the effect of such use on the general welfare, public health, and safety. Other general criteria to be considered when determining whether to approve or deny a conditional~ use permit include: A. Comprehensive planl The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official Comprehensive Municipal Plan of the City. B. Compatibility. The proposed use is compatible with its adjacent land uses. C. Performance Standards. ~ The proposed use conforms with all applicable performance standards contained in the Code. D, No Depreciation in Value, The: proposed use will not tend to. or actually' depreciate the area in which it is proposed. E. Zoning District Criteria. In addition to the above general criteria, the proposed CLIP meets the criteria specified ::for the various zoning districts: 1. In Residential Districts, R-1,2,3,4,5, R-O: a. Traffic. Non-residential traffic is channeled into thoroughfares or onto a street abutting business or industrial uses leading directly to thoroughfares, and not onto minor residential streets., b. Screening. The proposed use will be sufficiently separated by distance or screening from adjacent residentially zoned land so that existing homes 'will not be materially depreciated in value and there will be no deterrence to development of vacant land. c. Compatible Appearance. The structure and site shall have an appearance that will not have an adverse effect upon adjacent residential properties. The regulation, of home occupations within residential structures is intended to insure that the occupational use is clearly accessory or secondary to the principal dwelling use and that compatibility with surrounding residential uses is maintained. For purposes of the City Code~ home occupations are defined to distinguish between "permitted home occupation" and "conditionally permitted home occupations". Alt home occupations. which satisfy the "permitted home occupation" criteria shall be considered as a permitted accessory use in all residential zoning districts. Home occupations which fail to satisfy the permitted home occupation criteria shall require a conditional use permit and may be Planning Case Report 95-09 3 June 1, 1995 located in any residential zoning district based upon conditions set forth in the approved conditional use permit. 5. Permitted Home Occupations. A. Home occupations which meet the following criteria: Structural Changes. Businesses which require no interior or exterior changes necessary to. conduct the business, which.~ are conducted within a principal, building,~ and~ which require no mechanical or electrical equipment not customarily found in a home. B. Traffic. Businesses which do not significantly alter the traffic pattern of the neighborhood. C. Employees. Businesses which do not require employees other than those living on the premises. D. Area Permitted. Businesses which require no more than twenty (20) percent of the gross floor area of a dwelling, not to exceed three hundred square feet, including accessory building. E. Sales on Premises. Businesses which are not involved in direct sales on the premises except as may be conducted through the' use of the U': S. maiI, commerciaI deliVery services by a vehicle no larger than a set van, or by taking and ordering delivery of orders by telephone. F. Outside Storage. Businesses which require no outdoor storage of equipment, machines: inventory, tools or any other item required for use by the business, except for parking of business vehicles in compliance with §4.036(4)(f) of this Code. (Items.E and F were amendedor added to the City Code 1994.) o Conditional Use Permit. Conditionally permitted home occupations shall consist of those home occupations which do not~ meet~ atl:.ofthe.provisions of #5 above: Saidhome occupation'may be' granted a conditional use permit provided that: A. Adverse Effect on Neighborhood. The City Council shall find that all business related activity occurring on the premises shall not cause any adverse changes to the residential character of,the neighborhood., Screening of Exterior Chan~es. The' ~City CounciI shall fmd~ that any. exterior:changes necessary to conduct the business are sufficiently screened, properly designed, or separated by distance so as to be consistent with existing adjacent residential uses and compatible with the residential occupancy. C'; Interior Changes. The City Council shall find that any interior changes necessary to conduct the business comply with all building, electrical, mechanical, and fire ~codes governing the use of the. residential property. D. Traffic. The City Council shall find that the traffic generated by the business involves only vehicles of the type that typically service single family residences and that such traffic constitutes neither a nuisance nor a safety hazard. Planning Case Report 95-09 8. 4 June 1, 1995 In 1988, the petitioner stated that she would have only 3 - 5 customers per week by appointment only and that no signs would be used. 9. The Commission will want to confirm the number of customers expected per week and discuss parking arrangements and signage. Project Bulletins - Enclosed for your information are project bulletins that have been recently mailed out to residents regarding the three major construction projects currently underway in the City: 1) 36th Avenue Railroad Bridge Improvements, 2) Cooper High School Street and Parking Lot Improvements and 3) the 1995 Street Project. Codes & Standards Issues r The Codes & Standards Committee, met on, May 25~ to discuss the following issues: A. Bass Lake Road Housing Redevelopment Report - They discussed the code issues related to the project and the potential for a fUture rezoning of the area to accommodate both multi and single family dwellings. B. Possible Sign Ordinance Modifications - They reviewed several memos by staff suggesting:several minor modifications to the sign ordinance. The Committee indicated that they would be willing to study possible modifications if the Manager/Council would be supportive of the recommendations, In June, staff will be meeting to identify specific code change recommendations and will be bringing these back to the Committee for review. C. Regnlation of Tattoo Parlors - The Committee reviewed correspondence from the City Attorney regarding the regulation of .tattoo parlors. This issue has arisen because of several inquiries staff has received. New Hope currently has no regulations regarding tattoo parlors and the Committee is reviewing whether or not some type of regulations are necessary. The committee indicated that they' would support the adoptiOn of. an ordinance regutatingtattoo parlors if the Manager/Council w~e~ supportive~ Staff. will be £eviewing this issue, ands,if the Council wants the Committee to. proceed, the City Attorney will prepare an ordinance for review by the Committee. On November 28, 1994, the City Council passed an ordinance prohibiting the location of any pool/billiard center or any other commercial., recreational facility with more than two pool tables anywhere in the City and the prohibition is effective through May 2& 1995. The Council also passed a resolution ~authorizing a planning study to consider' amended, regulations for commercial recreational facilities. The study was to review the hours of operation for all commercial recreational facilities and performance standards, as they relate to proximity to residential zoning districts, churches and:schoOls, The Planning Consultant, Planning Commission and staff completed a study and forwarded recommendations to the City Council on April 10th. At that time the Council tabled the matter so that the recommendations could' be reviewed/discussed in detail at a work session. The recommendations have not yet been reviewed or adoPted,, therefore affrecommends: that the moratorium be'extended for anadditt~ six (6) months 'so no gap occurs between the crn'r~ termination deadline of May 28th and the new deadline of November 28th. In the event that the recommendations from the Planning Commission are adopted prior to November 28, 1995, in original or modified form, the moratorium can be terminated. Staff recommends approval of the ordinance. A purchase agreement has been negotiated, we have obtained a commitment from our bank and we have a commitment from the Certified Development Company for the SBA Portion of the loan. The problem we have encountered has been with the appraised value of the property in that it is not sufficient to support the amount of financing needed to complete the project under the SBA 504 loan program. The SBA 504 lOan program is limited to providing financing for. up to 90 percent of the appraised value of the property. The improvements required to make the building suitable for Universal's business are significant on a cost basis, but do not necessarily addto the appraised value of the building. Therefore, we are requesting a loan from the New Hope Economic Development Authority which will help bridge the "gap" in the financing structure. We are requesting a loan in the amount of $140,000 to be amortized over 20 years with a ten year balloon. It is a clean business and one that provides a valuable service to both the consumers and other businesses in the City and the surrounding area. Universal Color currently has 12 full-time employees. As a result of this project, we anticipate adding 5 full-time positions within the next two years. As a part of the building improvements, Universal is proposing to add a drive-up window fo~: customers to use when dropping off or picking up, film. This feature will benefit disabled and elderly citizens as well as parents with children and the general public. In addition to the items: listed above, there are other advantages for the community associated with the completion of this Project. With Universal COlor moving out of the Autohaus building, the owner of that building will then have the ability to complete the renovation or' its. property according to its obligation to the City.' Also, the'tenam of the subject' property (Kuppenheimer) has a lease on the property through July of 1995. They have already indicated to the owner of the building that they do not intend to renew that lease. Therefore, if this project is not completed there would ben vacant building ~ an area of high visibility in the- City. Universal Color's lease expires on November 30, 1995. Autohaus has indicated that it does not wish to extend the lease. We have been looking for a new site within the City of New Hope for the last five years and have not been able to find a building suitable for our needs until this building became available. Taking both of these situations into consideration, we would probably have to look.outside of New Hope if we are not able to buy the IG~penheimer building. This is not what we want ta do, (which is',~ indicated by ~e amount of time we have wa/ted for a NeTM Hope location) because our customer base is established in this area and,/t would hurt our business to move out of the area. Phase I of the improvements will include construction of a new railroad bridge and street/utility work aFproximately 250 feet on either side of the bridge (notinctuding the' fina~ bituminous surface). The span between the new concrete bridge abutments will be 70 feet arid w~fl accommodate e 48~,foot' wfde roadway, a 5~foot' vvfde' sidewafk orr each side an(fa 6-foot wide boulevard. The contractor started construction at the end of March and the first part of construction will involve removal of existing bridge abutments and construction of new abutments. Pilings This project is proceeding on schedule and on Tuesday, May 30th, the contractor will start excavating' to the bottom' of the footfngs, Pilings will start' to be driven on Wednesday or Thursday, May 31st or June 1st. There are 73 pilings that will be driven on the north side of the bridge and 73 pilings that will be driven on the south side of the bridge. The majority of the pitings are 60 feet Ion~and't~e ~ dfivir~ is: ex13ecte~ to'take.~ weeks. Pilings will be installed on the north side of the bridge first, and after that work is completed, work on the south side of the bridge will start. Avenues witl~ continue and the road will be temporarily closed between the hours of 8:30 a.m. and 4:00 p.m. during the piling. Access Access to. the shopping center and the apartments located west of the. railroad tracks will continue to be available at a ti times from Winnetka Avenue via 36th Avenue. Access to' Rainbow, !nc., Creamettes, AIl American Storage and residential properties on Maryland and Louisiana Avenues located east of the railroad tracks will continue to be available at all times from Louisiana and Nevada Avenues via 36th Avenue. Traffic. travelino~west~. will be detoured along the same route. 5/26/95 Project Schedule After the pilings are completed the contractor will start forming and pouring the footings and then the abutment and wing walls wilt be formed. The abutment construction will be completed at the end of July, at which time 36th Avenue will be closed to through traffic to erect the steel for the bridge and perform the street and utility, work. Estimated project completion is the end of September, at which time the road will be re-opened. It is difficult to be more specific about the schedule for the road closing due to the number of utilities to be constructed. It is possible that the road may have to be closed earlier or remain closed later than the dates stated above. Zealand Avenue will also be reconstructed and narrowed from the existing 4Q-foot, width, to & 3Q-foot width and. &cul-de-sac will .be constructed opposite of the most southerly residential property on Zealand Avenue, such that residential' traffic will exit north to 49th Avenue and all school traffic will exit onto Boone or Winnetka via 47th Avenue (see attached map). Area, south/west of St. Raphael Catholic Church At the April 24th City Council meeting the Council awarded the contract for the street improvement project to Hardrives, Inc., low bidder, in the amount of $887,828.50. The Council awarded the contract with Construction Option B, which utilizes the bituminous reclamation process. All of the cxisti~, bituminous surface of thc streets iwill be reclaimed and mixcc[ in with the existing: gravel base. A new three, (3) ~ bituminous surface will then be placed on top ofthe base. Curb and gutter identified for repair will be removed and replaced. Since 1980, the City has undertaken 15 similar projects which have resurfaced/reconstructed about 63 miles of the street system.
