Planning District 11. The Comprehensive Plan supports promoting private
reinvestment into commercial sites along 42nd Avenue. It cites the appearance
of the rear of shopping centers in the area as an area of concern and encourages
continual maintenance.
IV. Background
The applicant, ARI, LLC:, is requesting an amendment to a Lomprehensive Sign Pian to allow for the
installation of larger tenant identification signs on the west wall of the New Hope Shopping Center as
well as the ability to illuminate the signs at their discretion. A 7,839 square foot addition was completed
on the northwest corner of the building in 2016. In conjunction with the addition, wall treatments on the
west side of the building were enhanced and an amendment to a Conditional Use Permit (CUP) for
Planned Unit Development (PUD) allowed for the installation of wall signs. The amendment allowed

the property owner flexibility in the number and location of wall signs. This included the installation of
15 tenant signs and three "marketing signs" to promote Life Time Fitness, all on the west side of the
building. The approval capped the tenant signs to the dimensions specified within the application and
restricted illumination to the three "marketing signs" and one Life Time Fitness tenant identification
sign. The four Life Time Fitness signs were installed shortly thereafter; however, none of the other
tenant identification signs were installed. The applicant is now requesting flexibility in the size and
location of the tenant identification signs, as well as the ability to illuminate all of the signs. The vertical
location of the tenant identification signs would remain consistent "cross the building while the
property owner would have discretion on the horizontal location of the signs.
V. Zoning Analysis
A. Plan Description
1. Proposed Sign
The applicant is requesting the ability to install up to 14 additional signs, in addition to the
four Life Time signs and three Applebee's signs that are currently in place. According to the
applicant, only three to four tenants plan to install signage at this time; however, flexibility for
tenants to install signs in the future is preferred. The vertical location of the signs would
remain consistent across the building, with placement within the established uniform sign
band. The property owner would determine the horizontal location of the signs. The applicant
is also requesting flexibility in the allowable square footage for each individual sign to
accommodate for future tenants or logo changes. According to City Code, the cumulative area
of wall sign, awning signs, canopy signs and marquee sign shall not exceed 10% of the face
of the principal commercial building upon which they are located. The rear wall of the
building has a facade area of 8,625 square feet, allowing for a total sign area of 862.50 square
feet. Instead of capping each individual sign at the proposed square footage, the applicant is
requesting that the total area of the wall signage be limited to 10% of the fagade. Individual
signs would be limited to no more than 100 square feet. The property owner is also requesting
the ability to illuminate each of the signs. While not all of the signs would be illuminated, the
property owner would have the option of allowing illumination.

2. Sign Code
City Code requires the submission of a Comprehensive Sign Plan for commercial multiple
occupancy buildings. No illuminated wall signs are allowed on a side of a building that
directly abuts a residential zoning district. The subject property does not abut to a residential
district. The proposed signage does not exceed the maximum area requirement of 10% of the
combined wall surfaces on walls that abut streets in business or industrial zoning districts. No
individual tenant identification sign exceeds the 100 square foot area limit. The proposed
"marketing signs" do not fit the definition of a wall sign, awning sign, canopy sign, or marquee
sign. The signs contribute to the fagade appearance and were approved with flexibility offered
as part of a CUP for PUD amendment in 2016. Tenants without exterior walls on the west side
of the building are not eligible for signage, according to City Code. That flexibility was also
granted as part of the CUP for PUD amendment.
3. Design Guidelines
The city's Design Guidelines state that "signs should be positioned so they are an integral
design feature of the building and to complement and enhance the building's architectural
features. Signs should not obscure or destroy architectural details such as stone arches, glass

transom panels, or decorative brickwork." Signs may be placed in the horizontal lintel above
the storefront windows; within window glass, provided that no more than 33% of any
individual window is obscured, projecting from the building; as part of an awning; or in areas
where signs were historically attached. The proposed location of the tenant identification signs
within the established uniform sign band would be supported by the city's Design Guidelines.
4. Zoning District
The New Hope Shopping Center is located in the City Center zoning district. District goals
include requiring "aesthetically pleasing building and site design through the use of high-
quality building materials, landscaping and architectural design," and the encouragement of
"a sense of activity and liveliness along from building fagades, public open spaces and
sidewalks." The New Hope Shopping Center is a highly visible site that abuts to the recent
Hy -Vee redevelopment project. The proposed improvements contribute to the aesthetic
appearance of the building, benefiting the shopping center, its tenants, and the surrounding
properties.
B. Zoning Code Criteria
1. Comprehensive sign plan. Mixed use, commercial, and industrial multiple occupancy
buildings or single occupancy buildings with more than two signs shall submit an application
and receive approval of a comprehensive sign plan. Any building devoted to two or more uses
shall be a multiple occupancy building and shall require a comprehensive sign plan. Upon
approval of a comprehensive sign plan, no permit shall be issued for an individual use except
upon a determination that it is consistent with a previously or concurrently approved
comprehensive sign plan. The effect of said comprehensive sign plan is to allow and require
the owner of multiple occupancy structures to determine the specific individual sign
requirements for the tenants of his building. As sign locations, size and other sign details may
be of some significant importance in lease arrangements between owner and tenant, it is the
city's intention to establish general requirements for the overall building only, thus providing
a building owner with both the flexibility and responsibility to deal with his individual tenants
on their specific sign needs. Comprehensive sign plan applications or amendments require
approval of an administrative permit according to section 4-31 of the New Hope Zoning Code.
a. Comprehensive sign plan information. The applicant shall prepare a written and
graphic comprehensive sign plan for submission to the city. Said plan shall include,
but not be limited to the following information:
1. Sign location (both wall signs and freestanding signs).
2. Sign area.
3. Sign height.
4. Scaled building elevations.
S. Scaled floor plan that outlines tenant bays.
6. Identification of sign design.
7. Sign construction drawings (sections).

8. The city council, planning commission and city staff may request additional
information from the applicant concerning the application or may retain expert
opinions at the expense of the city, or may require as a condition of proceeding
with its consideration that the applicant furnish expert opinion and data at the
expense of the applicant.
Findings. The tentative locations and sizes of the wall signs have been defined on the
plans submitted by the applicant. The vertical location of the signs would remain
consistent throughout the building, with placement within the established uniform
sign band. The property owner would determine the horizontal location of the signs.
The applicant is requesting flexibility in the allowable square footage for each
individual sign to accommodate for future tenants or logo changes. According to City
Code, the cumulative area of wall signs, awning signs, canopy signs and marquee sign
shallnot exceed 10% of the face of the principal commercial building upon which they
are located. The rear wall of the building has a facade area of 8,625 square feet, allowing
for a total sign area of 862.50 square feet. Instead of capping each individual sign at the
proposed square footage, the applicant is requesting that the total area of the wall
signage be limited to 10% of the facade. Individual signs would be limited to 100 square
feet. The request will meet the intent of the City Code while allowing the property
owner the flexibility necessary to accommodate future tenants without needing to
continually amend the Comprehensive Sign Plan.
b. Through an approved comprehensive sign plan, the site may have building
identification wall signs, individual tenant wall signs, awning signs, canopy signs,
marquee signs and directory signs. The cumulative sign area of the aforementioned
signs shall not exceed 10% of the building fagades which they are located. These signs
shall be located on building fagades fronting on public street or a city approved private
street.
Findings. Under no circumstance will wall signs exceed 862.50 square feet, or 10% of
the building facade. According to the applicant, wall signs will most likely be limited
to approximately half of the tenants within the building due to costs associated with
installation.
c. Multiple occupancy buildings.
1. Wall signs.
i. Maximum area. The total allowable sign area for a multiple occupancy
structure shall not exceed 15% of the combined wall surfaces on walls
which abut streets in business or industrial zoning districts. No
individual tenant identification sign may exceed 100 square feet in area.
Findings. Wall signs will not exceed 10% of the combined wall surfaces
and no tenant identification sign will exceed 100 square feet in area.
ii. No multiple occupancy structure may display more than two overall
building identification signs. The total area of individual tenant wall

signs, awning signs, canopy signs and marquee signs shall not exceed
10% of the building fagade of the individual tenant bay.
Findings. This requirement has been satisfied.
iii. Tenant signs. Individual tenants located within multiple occupancy
structures shall be permitted to display individual signs, if they have
separate exterior entrances to their use or they are tenants in a shopping
center. A. tenant orn pying a corner location fronting two stxeets may
display signs to both street frontages.
Findings. Flexibility for this requirement was granted as part of the
CUP for PUD amendment in 2016 as the signs contribute to the facade
appearance, giving the building attractive, four-sided architecture in a
highly visible location.
iv. Except for subsection (k)(5)c.1.iv of this section, tenant wall, awning,
and banner signs shall be located on the building fagades of the tenant
bay occupied by the business.
Findings. Flexibility for this requirement was granted as part of the
CUP for PUD amendment in 2016.
V. The property owner may identify through a comprehensive sign plan
up to four tenants per building within the multiple occupancy building
that will be eligible to locate wall signs on the building at locations
beyond their occupied tenant bays.
Findings. Flexibility for this requirement was granted as part of the
CUP for PUD amendment in 2016.
vi. The location of all wall signs and awning signs shall be established
through an approved comprehensive sign plan. No illuminated wall
signs shall be located on the side of a building where the lot directly
abuts a residential zoning district.
Findings. The vertical location of the signs would remain consistent
throughout the building, with placement within the established
uniform sign band. The property owner would determine the
horizontal location of the signs. The subject property does not abut to a
residential district
vii. Individual sign permits shall be required prior to the installation of any
wall signs or awning signs.
Findings. The property owner must obtain permits for each individual
sign prior to installation.
viii. Multiple story/multiple occupancy buildings with tenants served by a
common building entrance may have, in addition to the wall signs, one
tenant directory sign as either a wall sign or freestanding sign located

at each common entrance provided the tenant directory sign meets the
following standards:
a. An individual tenant directory sign shall not exceed 100 square
feetin area.
b. An individual tenant directory sign shall be located within 50
feet of the common building entrance.
c. A freestanding individual tenant directory wall sign shall not
exceed ten feet in height. Individual tenant directory wall signs
shall not be located above the building floor where the common
entrance is located.
Findings. The subject property is not served by a common building
entrance.
C. Design and Review Committee
The Design and Review Committee met on December 14, 2017. The committee was generally
supportive of the request for an amendment to the Comprehensive Sign Plan.

VIII. Summary
The applicant is requesting the ability to increase the allowable size and ability to illuminate wall signs
that were approved for the west side of the New Hope Shopping Center in 2016. The vertical location of
the signs would remain consistent across the building, with placement within the established uniform
sign band. The property owner would determine the horizontal location of the signs. The applicant is
requesting flexibility in the allowable square footage for each individual sign to accommodate for future
tenants or logo changes. The total area of the wall signage would be limited to 10% of the fagade with
individual signs not to exceed 100 square feet.

IX. Recommendation
Staff recommends that the Planning Commission recommend approval of the Comprehensive Sign Plan,
with the following conditions of approval:
1. Individual tenant signs shall be placed within uniform sign band in a consistent vertical location.
2. The horizontal placement and allocation of sign area shall be at the discretion of the property owner,
with the cumulative sign area not to exceed 862.50 square feet and individual sign area not to exceed
100 square feet.
3. The applicant shall obtain individual sign permits for each of the signs to be installed.

BACKGROUND
In 2016, the City approved a comprehensive sign plan amendment for the New Hope
Shopping Center to allow business identification signs and three 59 square foot
marketing signs on the west side of the building. In approving this sign plan, the City
found that these signs contributed to the City Center integrated commercial design by
providing business identification between commercial sites, promoting business
interchange, reducing the visual impact of the building's rear service drive, and meeting
the City's commercial design guidelines.
The shopping center is now requesting the following changes to their sign plan through a
new comprehensive sign plan amendment:
1. The applicant is requesting larger tenant identification signs and the ability to
illuminate the tenant identification signs at their discretion on the west wall of the
shopping center.
2. The applicant is requesting flexibility in the size and location of individual tenant
signs to be determined by the landlord, with maximum sign area of all wall signs
meeting the total sign area cap below 10% of the building facade on which they
are located.
ISSUES AND ANALYSIS
Zoning, The New Hope Shopping Center is zoned CC, City Center District. This
district's purpose is to create a unified district and implement the goals within the New
Hope City Center Vision, Comprehensive Plan, and New Hope. Design Guidelines.
Elements of these plans include:
Promote business interchange between the various shopping centers.
Four-sided architecture.
Reducing the visual impacts of the internal service areas.
Integrating building and internal traffic patterns into a unified design.
The introduction of signs on the rear wall of tho New Hope Shopping Center brings some
business identification to the customers in the Hy -Vee parking lot. It also brings an
architectural component to an otherwise blank wall, which contributes both color and
interest to the New Hope Shopping Center site. These signs are intended to promote
interest and business interchange between the commercial sites.
Comprehensive Sign Plan. The New Hope Sign Code allows for a multiple
occupancy building to pursue a comprehensive sign plan to allow the property owner to
determine the specific individual sign requirements for tenants in the building. The sign
plan provides flexibility to the property owner in dealing with individual tenant needs.
Tenant signs may be located on the building facade fronting a public or City -approved
private street.
The past approval of the Lifetime Fitness signs on the west side of the shopping center
deemed the back service drive of the shopping center as a City -approved private street.
The same finding will be used in evaluating this application.
Maximum Sign Area. The total allowable sign area shall not exceed 1u"/o of wall
surfaces abutting the private street. The rear wall of the New Hope Shopping Center has
a facade area of 8,625 square feet. This allows for a total allowable sign area of 862.50
square feet. The following table illustrates the proposed tenant sign sizes.

The table above demonstrates that proposed signs fall far below the 10% maximum wall
sign area for the west wall fagade and complies with maximum individual tenant wall
signs of 100 square feet.
Sign Locations. The comprehensive sign plan standards require the tenant sign
placement to be on the tenant bay fagade. The Sign Code allows for an exception to this
standard for up to four to. -ants.
The shopping center floor plan shows seven tenants abutting the west shopping center
wall. The request is to allow up to nine tenants not abutting the west shopping center to
also have signs along the west wall, within a controlled size limit, and uniform sign band.
In 2016, the City approved 15 tenant signs for the west wall, which included the potential
for two future tenants. The large expanse of the west wall, limited proposed sign size,
and uniform sign height made this request acceptable.
Illuminated Signs. The previous plans approved the size, location, and illumination of
the Lifetime Fitness business identification sign and three marketing signs.
The sign plan amendment requests the illumination of multiple tenant signs on the west
side of the building. The proposed tenant sign shall be either internally illuminated
cabinet signs or channel letters. The type of signs and colors would be reflective of the
business brand.
Internally illuminated signs are allowed within the commercial zoning district provided
glare from said signs shall not exceed one foot candle at the centerline of a public street
or property line where abutting a residential district. This location will not impact either a
public street or residential property. The illumination of these signs are acceptable
provided an electrical wiring plan is submitted and approved with the sign permits.
RECOMMENDATION
Based on our review, we find that the proposed comprehensive sign plan represents a
reasonable use of the site. The proposed signs are directed toward adjoining
commercial sites that share access drives and will serve to implement the CC District's
intent to create a unified commercial design and promote business interchange between
the shopping centers. We would recommend approval of the comprehensive sign plan
with the following conditions:
Each individual tenant sign shall require a separate sign and electrical permit at
time of installation.
2. The individual tenant signs shall match the proposed sign height, but the
allocation of sign area shall be at the discretion of the landlord with the cumulative
sign area not to exceed 862.50 square feet.

established uniform sign band.

should be an integral part of the building and site design.

Shape- Wall signs should generally be rectangular. In most cases, the edges of signs shall include a raised border that
sets the sign apart from the building. Individual raised letters set onto the sign area surface are alsc preferred. Projecting
signs may be designed in a variety of shapes.
Colors- Sign colors shall be compatible with the building facade to which the sign is attached. No more than three
colors should be used per sign, unless part of an illustration. To ensure the legibility of the sign, a high degree of contrast
between the background and letters is preferred. A combination of soft/neutral shades and darktric:h shades (see Build-
ing Calors standard) are encouraged.
Materials- Sign materials should be consistent or compatible with the original construction mate ials and architectural
style of the building facade on which they are to be displayed. Natural materials such as wood and metal are more ap-
propriate than plastic. Neon signs may be appropriate for windows.
Illumination- External illumination of signs is permitted by incandescent, metal halide, or fluorescent light that emits
a continuous white light. Light shall not shine directly onto the ground or adjacent buildings. Neon signs are permitted.
Internally lit awnings are not permitted. Internally lit box signs and variable electronic message signs are discouraged.
Free-standing signs- Ground or monument signs are encouraged rather than pylon signs. Sign materials, colors,
and architectural detailing should be similar to those of the principal building. The area around the base of the sign should
be landscaped.

PUBLIC HEARING Vice Chair Clark introduced Item 4.1, text amendment to Section 13-7 of
Planning Case 17-15 the New Hope City Code related to park dedication fees.
Item 4.1
Mr. Jeff Alger, Community Development Assistant, gave background
on the planning case. Alger stated the city requires the dedication of
parkland or fees to fund them as a result of higher demand associated
with new development. This dedication is required for platting, re -
platting, subdivision or lot division allowing the development of land
for residential, commercial, industrial, and other uses or combination
thereof. According to the League of Minnesota Cities, case law and state
statute require an "essential nexus" between the fees or dedication
imposed and the municipal purpose sought to be achieved by the fee or
dedication. The requirements apply to the following scenarios: 1. The
creation of at least one additional lot or the addition of at least one
dwelling unit. 2. The combination of lots for the purpose of development
involving changes or mixed land uses or the intensification of uses. 3.
Planned Unit Developments (PUD), as defined and regulated by the
zoning code.
Next, Alger reviewed the fees charged by other cities. Some cities used
a flat fee and some charged a percentage of the value of the fair market
land to be subdivided. An argument against park dedication fees is the
potential deterring of development projects from taking place. The city
compared the current fees to surrounding cities and determined the fees
are lower than other cities. It was deemed appropriate to double the fees
to match the fees of surrounding cities. Alger showed charts
demonstrating the current fees and proposed fees.
The Codes and Standards Committee was in favor of increasing park
dedication fees to reflect increases in taxable land value in the city and
align with need created by new subdivisions or developments. AIger
concluded that staff was available for questions.
When Vice Chair Clark questioned whether any of the Commissioners
had any questions for staff, Commissioner Redden asked if there was a
rational why the cap would be removed for the 3+ family dwellings, as
the dedication fee would be quite large without the cap. Alger
responded the proposed fee would be comparable to other cities. The
rational is the fees are based on the number of people using the land.
Commissioner Smith asked if this fee would be applicable to new
dwellings. Alger confirmed it was for new dwellings. Commissioner
Smith asked without a cap if the fees would be too expensive for
development opportunities to occur. Alger stated that was one of the
arguments opposing park dedication fees. The fee increases are in line
with what other cities are charging. Sargent clarified that park
dedication fees are only applied when a new lot is created. The proposed
fee increases are in line with what most contractors are used to paying.
Commissioner Smith asked how much development property the city
had. Sargent said there is only one area that currently is being looked at
for development. This does not mean there will not be other
opportunities in the future. Al Brixius said if a subdivision occurs, and
is replaced unit for unit, there is no park dedication fee collected.
Commissioner Hanson agreed that the fee increases wouldn't deter a
large project from happening.
Vice Chair Clark inquired if anyone in the audience would like to

said most of the surrounding cities did not have a cap with their fees.
Commissioner Redden said he had wanted further discussion due to the
fact that our fee was different from other cities because of that cap.

PUBLIC HEARING Vice Chair Clark introduced Item 4.2, text amendment to Section 3-50 of
Planning Case 17-16 the New Hope City Code related to on—premises directional signs.
Item 4.2
Mr. Jeff Alger, Community Development Assistant, gave background
on the planning case. Alger stated the City Code restricts on -premises
directional signs to no more than two square feet in size. Businesses are
allowed up to four signs and can exceed four with the special approval
of city council. Several businesses have approached the city stating these
signs are too restrictive and need to be larger to ensure visibility.
At the August 3, 2017 Codes and Standards meeting, staff recommended
increasing the size to three square feet in size, which is about the size of
a yard sign used to promote special events and fundraisers. Staff is also
recommending signs be limited to eight feet in height.
Vice Chair Clark asked the first question if there currently was a height
restriction. Mr. Alger stated currently the code does not address
directional sign heights and staff wanted to make sure that was
addressed in this text amendment. The limit of eight feet in height
matches the rest of the sign code in regards to height restrictions. Vice
Chair Clark asked if the suggested increase in size would make enough
of a difference to ensure visibility. Alger responded that the
recommended size is consistent with other temporary signs, which are
easy enough to read, and is a common size for printing.
Vice Chair Clark inquired if anyone in the audience would like to

PUBLIC HEARING Vice Chair Clark introduced Item 4.3, text amendment to Section 4-3(d)(4)
Planning Case 17-17 of the New Hope City Code related to the irrigation moisture sensors for
Item 4.3 landscaped areas.
Mr. Jeff Sargent, Community Development Director, gave background
on the planning case. Sargent stated the city's landscape ordinance
requires all landscaped areas be irrigated or have access to an exterior
building water spigot in a location adequate for providing landscape
maintenance. The city has received complaints about properties
irrigating landscaped areas while it is raining. As a result of those
complaints, the Planning Commission requested that the city consider
an ordinance requiring moisture sensor irrigation controllers for new
developments. The sensors detect moisture levels in the soil and
prevent an irrigation system from operating when it is not necessary.
Such devices prevent the waste of water by limiting irrigation as
landscaped areas reach adequate moisture levels. This would apply to
all properties except 1 and 2 family residential.
The Codes and Standards Committee was in favor of requiring moisture
sensor irrigation controllers for new developments installing automatic
irrigation systems. Staff recommends approval of the proposed text
amendment.
When Vice Chair Clark questioned whether any of the Commissioners
had any questions for staff, Commissioner Smith asked what the cost
would be to install this moisture sensor. Mr. Sargent stated the cost has
not been researched, but does not anticipate it to be prohibitive. This
would be required for new installations or when systems are being
replaced. Commissioner Smith was concerned with requiring people to
do things they do not want to do. Mr. Sargent stated this change would
be beneficial in regards to energy conservation. Again, this would not
require current systems to upgrade to utilize this gauge; it would just
require new installations to have this gauge. Al Brixius reiterated this
would apply to multi -family, commercial, and industrial properties only
and not one and two-family residential.
Commissioner Redden asked when systems are being replaced if they
are required to have this sensor on the new units. Mr. Brixius stated they
would be required to comply with code. Commissioner Frazier said
companies would likely want to upgrade to this gauge, as it would
result in a cost savings to the companies through less water usage.
Vice Chair Clark inquired if anyone in the audience would like to

PUBLIC HEARING Vice Chair Clark introduced Item 4.4, text amendment to Sections 1-4, 3 -
Planning Case 17-18 50, 4-30, 4-34, 6-9, and 13-3 of the New Hope City Code related to the
Item 4.4 requirement of posting land use petition sign during zoning requests.
Mr. Jeff Sargent, Community Development Director, gave background
on the planning case. Sargent said this would be a text amendment that
would aid the notification process during the land use request process.
The City must follow strict state statute requirements for notifying
residents of public hearings, including those located within 500 feet of
the location through a mailer. Situations have arisen lately where
individuals are claiming to have not received notification and were not
made aware of the request until the last minute. This request will
provide another opportunity for people to understand that a land use
petition has been requested on a given property. The city would require
the applicant put a yard -size sign on the property during the notification
process. Sargent showed what the sign would look like for
commissioners to see.
Staff recommends approval of the proposed text amendment.
Vice Chair Clark asked if the sign would be specific to the type of
application or just a generic sign. Mr. Sargent responded it would be the
generic sign required to be in the yard. Vice Chair Clark then asked if it
would be the applicant or staff's responsibility to place the sign. Sargent
stated it would be the applicant's responsibility. When the application
is received, staff would give the applicant the sign and take a $15
refundable deposit, which is refunded when the sign is returned.
Commissioner Frazier asked if $15 was the true cost of the sign. Sargent
replied he thought it was double the true cost of the sign.
Commissioner Redden asked for discussion about the paper the legal
notices are published in. The Sun Post used to be delivered for free and
since it no longer is, residents may not be receiving the notification.
Sargent replied the procedure has been to use the official press of the
city for notification, which is the Sun Post. There are always copies
available at City Hall for residents to take for free or at least look at.

Residents who are not within the 500 -foot mailing radius can still drive
by the signs and be informed of what is happening within the city. Other
avenues are being explored for getting notifications out to residents. The
city is working on a new website that will provide the opportunity for
residents to receive notices through.

Mayor Hemken stated the Sun Post is utilized for notices due to cost.
Star Tribune is very expensive to publish public hearing notices. Many
residents are also notified through the mailings that are sent within 500
feet of the location. Al Brixius stated that New Hope's notice radius of
500 feet is larger than other cities and the signs are a good idea.
Stacy Woods made note there is a typo on the first page of the proposed
ordinance. The word 'city' needs to be inserted in the second to last
sentence, "The sign shall be removed and returned to the 'city' , by
applicant..." Stacy wanted to propose that as an amendment.

PUBLIC HEARING Vice Chair Clark introduced Item 4.5, text amendment to Section 6-14 of
Planning Case 17-20 the New Hope City Code related to the Small Cell Bill and right-of-way
Item 4.5 management.
Mr. Jeff Alger, Community Development Assistant, gave background
on the planning case. Alger stated in 2017 amendments were made to
Minnesota's Telecommunications Right -of -Way User Law. The
amendments essentially eliminated any confusion about whether
wireless providers are treated the same as other telecommunications

Right -of -Way users under state law, but created a separate, streamlined
permitting system that allows small cell wireless equipment to be placed
on city -owned infrastructure in the ROW. This was a result of increasing
demand for wireless and streaming data services. The law restricts
antennas to no more than six cubic feet in volume and equipment
associated with the antennas to 28 cubic feet in volume. The law limits
new structures to 50 feet in height. The city ordinance requires poles to
be placed 800 feet from each other. With the assistance of the city
planner, the assistant city attorney drafted an ordinance consistent with
what other cities in Minnesota are passing. The draft ordinance would
be presented before uie uty council uit DeLeinber 11, 2017 io be passed
in time to meet the deadline of January 1, 2018.
Next, Alger showed examples of what these small cell wireless units
would look like installed. New poles are also allowed in residential
areas, with requirements to locate a new pole on the corner of residential
properties. The city cannot be more restrictive that what the state statute
allows.
The Codes and Standard Committee was in favor of amending the City
Code related to right-of-way management. Staff recommends approval
of the proposed text amendment.
When Vice Chair Clark questioned whether any of the Commissioners
had any questions for staff or the applicant, no Commissioner had any
questions. Vice Chair Clark then opened the Public Hearing, and no one
from the audience wished to address the Commission. Being that no one

Mr. Jeff Sargent, Community Development Director, gave background
on the planning case. City code requires air conditioning units to be
located in the rear yard or in the side yard so long as they are screened
from neighbors and right-of-way. In some instances, the materials used
to screen air conditioning units are substandard and do not hold up over
time. In such cases, viewing air conditioning units from the right-of-way
or adjacent properties may be more aesthetically pleasing than the
materials that are used for screening.
The Codes and Standards Committee was in favor of eliminating
screening requirements for air conditioning units iocated in the side
yard. Staff recommends approval of the proposed text amendment.
When Vice Chair Clark questioned whether any of the Commissioners
had any questions for staff or the applicant, Commissioner Hanson
asked if this would apply to residential and commercial properties.
Sargent said it would apply to both residential and commercial
properties. If a rooftop unit was being installed, the screening
requirements would still apply. Commissioner Hanson asked if
someone wanted to install a cooling tower if that would require
screening. Mr. Brixius responded a cooling tower goes beyond an air-
conditioning unit and screening of these towers would be addressed
through the site plan review. Mr. Alger reminded commissioners the
units are not allowed in the front yard of properties.
