TEe Village Council of tk¢ Village of New Hope ordains:
S'eetion '1. Section 6'.51 of the Village Code is 'amended
to read:
"6.S1 When unclaimed prop'ert¥ may b'e disposed of.
Wken any personal property (eXcept
dogs) in the custody or possession of the
village, or witk any party with Whom the
village has contracted for removal and
storage, which has been abandoned by the
owners thereof or for which no owner has
been found may be disposed of after said
property has been so held by the village
for at _least tkree (3.) months'. The village
may dispose of perishable property prior to
th~ expiration .of said tkree (3]' months if
said three (3.) months wait would .result in
a substantial reduction in the value of
said property."

Section 6.52 of the Village Code is amended

Subd.(!) Notice 'of sale.
All property held in the'. custody of the
village or any party with whom it contracts
for Such storage, shall be sold at public
auction or sale, at any time after such

shall be given at least once, not .less than
three (3.] days before the date of proposed
sale. Said notice shall state.: The time
and place of said proposed sale and the
property to be sold.

Said sale may be conducted by the
Clerk-Treasurer or by any other authorized
employee or agent of the village. The pro-
ceeds-of any such sale shall be applied in
payment of the expenses of the sale' and all
other costs occurred in retaining and
storing such property. The balance of the
proceeds remaining from such sale shall be
paid into the general fund of the village.
Any property offered for sale but not Sold
and not suitable for appropriation to the
use of the village shall he deemed of no
value and shall' be disposed of in such
manner as the Village Manager directs.
Subd. ($.) Terms of sale.
The village shall not he. liable in
any manner foz the condition of any such
property which is so'id, and no warranty,
express' or implied, is authOrized in conne'c-
tion with any such sale."
Section 6.53 of the Village Code is amended
"6.53. The true owner of such unclaimed, personal
property, held for sale or disposal by the
village, may reclaim his property upon
satisfactory proof of ownership thereof
prior to. the sale or other disposition here-
under. If such unclaimed personal property
has been so'Id or otherwise has been disposed
of under the provisions of SeCtions 6.Si and
6.52, the tr. ue owner, upon application to
the Clerk-Treasurer, within six (6) months
of such sale or disposition and upon satis-
factory proof of ownership, shall be entitled
to receive the actual sale 'price of such
property, except that there shall be. deducted
from said sale price any expense's incurred by
the village in, connection with the retention,
storage and sale of such property. The net
· proceeds of the sale deposited in the general
fund shall he subject only to the former
owner's right to' receive payments as herein
provided.~'

AN ORDINANCE ADDING SECTIONS 11.81 THROUGH
11.83 AND AMENDING SECTIONS 11.73 AND 11.77
OF THE VILLAGE CODE RELATING TO TRAFFIC
AND VEHICULAR CONTROL
The Village Council of the Village of New Hope ordains:
Section 1. Chapter 11 of the Village Code is amended
by adding theretO Sections 11.81 through 11.83 to read as
follows:
11.81. Definitions:
The following words and phrases, when
used in Sections 11.81 through 11.83 have
the meanings set out herein.
Subd. (1) "Vehicle".
Vehicle means every device in, upon
or by which any person or property is or
may be transported or drawn upon a highway,
except devices moved by human power or used
exclusively upon stationary rails or tracks..-.
Subd. (2) "Street or Highway."
Street or highway means the entire
width between boundary lines of any way
or place when any part thereof is open
to the use of the public, as a matter of
right, for the purposes of vehicular
traffic.
11.82
Parking Prohibited at all times on Certain
Streets.
When signs are erected giving notice
thereof, no person shall park a vehicle
at anytime upon any of the following
described streets or highways or parts of
streets or highways:
susa. (1)
On Broadway Avenue North
between 60th Avenue North
and 62nd Avenue North.
11.83 Parking Signs Required.
Whenever by this or any other section
of the Village Code any parking time limit
is imposed or parking is prohibited on
designated streets or highways, it shall be
the duty of the chief of police to erect
appropriate signs giving notice thereof and
no such regulation shall be effective unless
said signs are erected and in place at the
time of any alleged offense.
Section 2. Section 11.75, Subdivision (1) of the Village
Gode (added by Ordinance No. 67-28) is amended by adding thereto
Paragraph (4) to read as follows:
(4)
No person shall operate a snowmobile or go-
kart within the village between the hours
of one-half hour after sunset to one-half
hour before sunrise.
Section 3. Section 11.73, Subdivision (1) of the Village
Code (added by Ordinance No. 67-28) is amended to read:
Subd. (1) On Roadway.
No persons shall operate a snowmobile or go-
kart upon roadway, boulevard or inside bank or
slope of any village street or highway, except
as provided in this section.
Section 4. Any person violating the terms of this ordinance
shall, upon conviction thereof, be fined a sum not to exceed $100
or shall be imprisoned for a period not to exceed 90 days.
Section 5. This ordinance shall be in full force and
effect~from and after its passage and publication.

AN ORDINANGE AMENDING SECTIONS 2.71 AND 2.72 OF THE
VILLAGE CODE RELATING TO THE POSITION OF FIRE CHIEF
The Village Council of the Village of New Hope ordains:
Section 1.

Section 2.71 of the Village Code is amended
"2.71 Establishment.
Section 2.
to read as follows:
There is hereby established in the
Village a volunteer fire department. The
department shall be headed by the Fire Chief
who shall be an employee of the village hav-
ing a position in the classified service.
In addition to the Fire Chief, the depart-
ment shall consist of volunteer personnel as
follows: An Assistant Chief, a Fire Marshal
and not less than ten (10) nor more than
thirty-five (35) firemen."
Sectioni2.72 of the Village Code is amended
"2.72 Election.
The Assistant Chief and the Fire Marshal
shall be elected annually by the members of
the department, subject to confirmation by
the council. He shall hold office for one
year and until his successor has been duly
elected, except that he may be removed by
the council for cause and after a public
hearing. Firemen and probationary firemen
shall be appointed by the members of the
department, subject to confirmation by the
council. Firemen shall continue as members
of the department during good behavior, and
may be removed by the council only for cause
and after a public hearing."

AN ORDINANCE AM~IDING SECTIONS 2.94 THROUGH
2.96 OF THE VILLAGE CODE RELATING TO FILLING
OF VACANCI~ OCCURRING IN THE COMMISSION.
The Village Council of the Village of New Hope Ordains:
Section 1. Sections 2.94, 2.95 and 2.96 mf the
Village Code '(added by Ordinance No. 67 - 42) are hereby
amended to read as follows:
"2.94. Composition. The Commission
shall consist of fifteen (15) members. The
members shall be appointed by a majority of
the Council and shall serve without compen-
sation.
"2.95. Terms of Office. The members of
the Comm4ssion shall be appointed for a term
of one (1) year. The first commission shall
serve until December 31, 1968, thereafter
appointments shall be made in January of each
year and shall expire December 31st of the year
in which appointment is made.
"2.96. Vacancies._ Vacancies occurring in
the Commission shall be filled for the unexpired
term by an appointment by a majority of the
Council. The remaining members of the Commission
shall interview candidates for C~ission mem-
bership and make recommendations thereon to the
Council."
Section 2. This ordinance shall be in full force

TO REZONING PROCEDURES.
The Village Council of the Village of New Hope ordains:
SeCtion 1. Section 4.82, Subd. 2, of the Village Code,
is 'ame~e'~ to'. read:
"Subd. (2.) Notice.
"The Clerk-Treasurer shall set a hearing on the
application and shall publish notice of hearing. When
an amendment involves changes in district boundaries
affeCtiFg an area of five (5) acres ~or ,less', similar
notice shall be mailed at least ten (!0)~ days before
the day of the hearing to each owner of affected prop-
erty situated wholly' or partly within two hUndred (2,0,0)
feet of the property to which the amendment .relates,
or, if the rezoning petition is 'for only a part 'of a
la.rger parcel of property, then within two hUndred (2.00)
feet of the boundary of the la.rger 'parcel to which the
amendment relates. Public property shall be ignored in
measuring .such two. hundred (2.0.0.) feet. For the purpose
of giving mailed notice, the Clerk-Tr.easurer may use'
any appropriate records to determine the' names and

VILLAGE CODE RELATING TO GIVING FALSE
FIRE ALARMS.
The Village Council of the Village of New Hope ordains:
Section 1. Chapter 12 of the Village Code is hereby
amended by adding thereto Section 12.17 to read as follows:
"12.17 Giving False Fire Alarms.
No person shall give or cause to
be given, or to knowingly start
or spread, any false alarm of fire
in the Village.
Section 2. Any person violating the terms of this
ordinance shall upon conviction thereof, be fined a sum not
to exceed $100.00 or shall be imprisoned for a period not to
exceed 90 days.
Section 3. This ordinance shall take effect and
be in force and effect from and after its passage and publi-
cation.

AN ORDINANCE AMENDING SECTION 3.49 SUBDIVISION 2
OF THE VILLAGE CODE RELATING TO EXITS FROM CELLARS
AND BASEMENTS OF SINGLE-FAMILY RESIDENCES
The Village Council of the Village of New Hope ordains:
Section 1. Section 3.49, Subdivision 2 of the Village
Code is amended by adding thereto Paragraph (C) to read as
follows:
"(C) Notwithstanding the provisions of Section
3302 (b), Uniform Building Code, 1964
Edition, incorporated by reference in
Section 3.49, Subd. (1) of this Code, one
of the required two exits from a basement or
cellar of a single-family residence building
may consist of a window which is openable
from the inside without the use of a key
or any special knowledge or effort provided
that the window shall be a minimum of thirty-
six inches in width, thirty-six inches in
height~ that the sill be no more than forty-
eight inches above the floor level, and pro-
vided that the exit window shall swing in the
direction of exit travel and that the window
well will be sufficiently large to allow the
window to be fully opened. Only one means
of exit, consisting of a stairway, is required
from the basement or cellar of a single-family
residence building if the basement or cellar
is not used for sleeping quarters."
Section 2. This ordinance shall be in full force and
effect from and after its passage and publication.

REGULATIONS OF PRIVATE SWIMMING POOLS
The Village Council of the Village of New Hope ordains:
Section 1. Chapter 3 of the Village Code is hereby amended
by adding thereto Sections 3.160 through 3~169 to read as follows:
3.160 PRI~TE SWIMMING POOLS
3,1~L Definition.
The term "private swimming pool" shall mean
any pool, tank, depression or excavation or other
structure which shall cause retaining of water over
a greater depth than 18" and having a larger plane
surface of water greater than 150 square feet and
which shall be designed or used for swimming, wading
or immersion purposed by men, women or children, used
or intended to be used solely by the owner, lessee, or
tenant thereof and his family and by friends invited
to use it without payment of any fee.
3.162 Permit Required.
It shall be unlawful hereafter for any person,
firm or corporation to construct, alter or repair a
private swimming pool within the village without first
having secured a permit therefor from the Building In-
spector. An application for this permit shall be made
on such form as may be furnished by the village, and
shall be accompanied by complete plans and specifi-
cations for the pool, including the type and location
of fencing, and a survey or map showing the location
thereof with respect to the boundary lines of the
land of the applicant. The applicant shall pay the
fee prescribed in Section 3.14.
3.163 Water.
Subd. (a) Villase Water Supply.
There will be no cross connections of the
village water supply with any other source of
water supply for the pool. The line from the
village water supply to the pool shall be pro-
tected against backflow of polluted water by
means of either an air gap, vacuum breaker or
other adequate device to prevent back siphonage.
Subd. (b) Polluted Water.
No body of water, whether it be a natural
or artificial body of water in the village which
contains sewage~ waste or other contaminating or
polluting ingredients rendering the water hazardous
to health shall be used for swimming or bathing
purposes by any person or persons.
3.164 Enclosed by Fence.
Ail swimming pools to be constructed or which
are already constructed shall be completely surrounded
by a fence or wall not less than four feet in height,
which shall be so constructed as not to have openings,
holes or gaps larger than four inches in any dimension,
except for doors and gates; and if a picket fence is
erected or maintained, the horizontal dimensions shall
not exceed four inches. The fence shall be of a type
not readily climbed by children. A dwelling house or
accessory building may be used as part of such en-
closure. All gates or doors opening through such en-
closure shall be equipped with a self-closing and self-
latching device for keeping the gate or door securely
closed at all times when not in actual use, except that
the door of any dwelling which forms a part of the en-
closure need not be so equipped.
3.165 Shielding Lights.
Lights used to illuminate any swimming pool
shall be so arranged and shaded as to reflect light away
from adjoining premises.
3,166 Unnecessary Noise.
It shall be unlawful for any person to make, con-
tinue or cause to be made or continue at any swiL~m~ng
pool or family pool any loud, unnecessary or unusual
noise or any noise which annoys, disturbs, injures or
endangers the comfort, repose, health, peace or safety
of others. In the operation of a swimming pool, the
use or permitting the use or operation of any radio,
receiving set, musical instrument, phonograph or other

machine or device for the producing or reproducing
of sound in such a manner as to disturb the peace,
quiet and comfort of the neighboring inhabitants or
at any time with louder volume than is necessary for
convenient hearing of the person or persons who are
in the pool or the swimming pool premises shall be un-
lawful.
3.167 Lot Lines.
Swimming pools shall comply with the setback
line requirements of the Zoning Ordinance of the
Village of New Hope.
3.168 Prior Construction.
The owner of any land upon which a private swim-
ming pool has been constructed prior to the effective
date of this ordinance shall within 60 days after said
effective date, comply with the requirements of this
ordinance, and thereafter it shall be unlawful to main-
tain any swimming pool which does not meet the require-
ments of this ordinance.
3.169 Modifications.
Subd.. (a) .Certain Modifications.
The Council of the Village of New Hope
may make modifications in individual cases,
upon a showing of good causes with respect to
the height, nature or location of the fence,
wall, gates or latches, or the necessity there-
for, provided the degree of protection is not
reduced thereby.
Subd. (b) Other Protection.
The Council of the Village of New Hope
may permit other protective devices or structures
to be used so long as the degree of protection
afforded by the substitute devices or structures
is not less than the protection afforded by the
fence, gate and latch described herein.
Subd. (c) Extensions.
Upon the application of a property owner
the Council may grant extension of time for com-
pliance~ in individual cases, upon the showing of
good cause; such extension of time shall not

exceed thirty days at a time.
Section 2. Effective Date. This ordinance shall be in full
force and effect from and after its passage and publication.

3.28, 3.49 AND 3.62 SUBD. (3)~ AND ADDING SECTIONS 3.50,
AND SECTIONS 3.150 THROUGH 3.156 TO THE VILLAGE CODE
RELATING TO CONSTRUCTION AND REGISTRATION OF MULTIPLE
DWELLINGS.

The Village Council of the Village of New Hope ordains:
Section 1. Section 3.49 of the Village Code is amended
"3.49 Adoption of Publications by Reference.
Subd. (1) Uniform Building Code.
There is hereby adopted and incorporated
into this Code, by reference, that certain
published code prepared by the Pacific Coast
Building Officials Conference, for general
circulation and use, which is entitled
"Uniform Building Code, 1961 Edition,
Volume 1", except to the extent that the
provisions of said "Uniform Building Code",
are inconsistent with the other sections
of this Code, and save and except such
portions as are amended or modified in
Sections 3.49 (2) and 3.50. In the event of
inconsistency between the said "Uniform
Building Code" and this Code, the more
restrictive provision or provisions shall
govern. Three copies of said "Uniform
Building Code, 1961 Edition, Volume 1",
shall be marked as "Official Copy" and
filed for reference and inspection in the
Office of the Clerk-Treasurer.
Subd. (2)
Certain Amendments Made in Uniform
Building Code.
The said Uniform Building Code is amended
and changed in the following respects:
Section 3712 is amended by adding thereto
Subd. (m) to read as follows:
(m) Ashpit. Any fireplace hereafter con-

structed in any single-family,
two-family or apartment house
as defined in Section 402 of this
Code, that utilizes an ashpit in
its construction shall have:
(1) at least one cleanout; (2)
a flat floor no more than 6" below
the bottom of the cleanout; (3) no
hidden or recessed areas. Ail por-
tions of the ashpit shall be easily
accessible from the cleanout."
Notwithstanding the provisions of the Uni-
form Building Gode or Section 3.41 of this
Gode, the use of truss construction is
permitted provided the following procedures
and regulations are complied with:
Before using truss construction, anyone
wishing to use this construction shall
apply to the Building Inspector for a
special permit and with such application
shall submit detailed plans and designs
for which such permit is requested.

The detailed plans and designs of the
truss and roof assembly submitted shall
be certified by a registered architect
or structural engineer as providing
safe and effective construction.
If the building inspector approves the
design, a permit shall be issued subject
to any conditions and objections rec~n-
mended by the building inspector.
The construction shall, in all cases,
follow the approved design, together
with any such conditions and objections
and all manufacturer's recommendations.

Ail wood used shall be stress graded
and so stamped.
Truss assemblies shall not be greater
than 24 inches apart from center to
center.
(G) Section 3805 is amended to raad as follows:
"Every Group A and B Occupancy of any

equipped with interior standpipes."
Subd. (3) Adoption of Minneapolis Elevator
Ordinance.
Chapter 170'(Elevators, etc. General
Regulations) and Chapter 171 (Elevators, etc.
Construction and Operation) of the Minneapolis
Code of Ordinance, as amended, and as the same
appears from pages 1-26, inclusive, in a pam-
phlet entitled "Minneapolis Code of Ordinances,
Elevators", are hereby adopted and incorporated
by reference into the Building Code and shall
be in full force and effect in the Village in-
sofar as applicable to the regulation, con-
struction and operation of the elevators
within the Village. Ail references in said
chapters to the City of Minneapolis shall be
interpreted as meaning the Village of New Hop~~
and all references to the Inspector of Buildings
shall be interpreted as the Building Inspector.
Three copies of the said Chapters 170 and 171
as contained in said pamphlet, shall be marked
as "Official Copy" and filed for reference and
inspection in the office of the Clerk-Treasurer.
Section 3.50 of the Village Code is amended to
Requirement for Construction of Multiple
Family Dwellings.
In addition to said Uniform Building Code pro-
visions relating to construction of all build-
ings, the following provision shall apply to

construction of multiple-family dwelling
with three or more living units (apart-
ment house):
Subd. (1) Dead-Locking Bolts:
Exit doors of each living unit, storage
and utility room shall be equipped with a lock
that has a dead-locking bolt, provided, how-
ever, that it shall be openable from the inside
without the use of a key or any special know-
ledge or effort.
Subd. (2) Elevators:
Ail apartment houses exceeding 3.5 stories
in height shall be equipped with a passenger
elevator.
Subd. (3) Carpeting and Storage.
The floors of exitways of buildings used
for apartment houses shall be carpeted by a
'commercial grade' of carpeting approved by
the Building Inspector. The term 'exitways'
includes passageways, stairways and landings
of stairs, provided, however, that an area not
to exceed 40 s~uare feet adjacent to each ex-
terior doorway may be surfaced by other build-
ing material.
Regardless of any other provisions of this
Code, no storage mhall be permitted in any apart-
ment house building under stairs or stairways,
and space under such stairways shall be enclosed
in a manner to prevent storage use.
Subd. (4) Fire Extinguisher.
In each apartment house there shall be
provided and placed at least one portable
Class A fire extinguisher of a type suitable
for the portable class of fire, such fire
extinguisher to be approved by Underwriters'
Laboratory, Inc., or other nationally recog-
nized testing agency, for each 2500 square
feet of living area in such building, in
boiler rooms, storage rooms, laundry areas, and
in any other area of such building where the
absence of a fire extinguisher is found by the

Fire Marshal to create a hazardous condition.
Extinguishers shall be so placed on each floor
of such building that there shall be at least
one at a distance no greater than 50 feet from
an exit door of each apartment unit.
Subd. (5) Soundproofing.
Ail partywalls, and all floors and
ceilings shall be constructed of an assembly
with a Sound Transmission Class (STC) rating
of not less than 50. Ail corridor walls and
door frames shall be constructed of an as-
sembly with a Sound Transmission Class rating
of not less than 40, except that exit doors
to corridor shall have a Sound Transmission
Class rating of not less than 30. The Build-
ing Inspector shall require sufficient evi-
dence or proof be submitted to substantiate
any claims that may be made regarding sound
transmission of an assembly or door including
certification by a nationally recognized test-
ing laboratory.
Subd. (6) Door Closers.
Ail exit doors from living units, storage
and utility rooms to corridors or common areas
and all stairwell doors (exit enclosures) or
exterior doors shall be equipped with a rack and
pinion type automatic door closer, such closing
device to be approved by the Fire Marshal and
shall insure closing and latching after having
been opened for use. Existing users or build-
ings and buildings now under construction shall
be made to comply with said requirement not
later than Jannary .1, 1970.
Subd. (7) Stairwells Enclosed.
In buildings hereafter constructed all
interior stairwells (exit enclosures) shall be
enclosed, and the interior walls, ceilings
and doors of interior stairwells shall be not
less than one-hour fire-resistive construction.
Subd. (8) Incinerators.
Incinerators shall not be installed in
buildings hereafter constructed. The owner of

existing uses or buildings and of buildings
now under constr~ction shall, not later than
September 30, 1969, seal in a permanent man-
net all service openings for chutes and charg-
ing doors, except that the owner may leave
unsealed and operable the charging door leading
directly into an incinerator installed in the
basement or ground level of the building. The
work of sealing shall be subject to the approval
of'the Fire Marshal.
Subd. (9) Security Device.
An approved security system shall be pro-
vided for each building to control access. The
secured area provided by such system shall be
the entire building, except for foyers. Dead
latch type door locks shall be provided with
key cylinders on foyer side and lever knobs
(or door knobs) on hall side. Latches to be
type that are permanently locked from foyer
and permanently unlocked from hall side.
Subd. (10) Window Width Minimum.
All living rooms, kitchens and other rooms
used for living ~ sleeping purposes having an
exterior wall shall be provided with at least
one window with a minimum glass width of 19
inches.
Subd. (11) One-hour Fire Resistive Gonstruction.
In buildings all wall's, partitions, floor-
ceiling assemblies, roofs, and other assemblies
shall be of nOt less than one-hour fire-resistive
construction, except doors within individual
living units and windows in exterior walls.
Subd. (12) Automatic Fire Detector and Alarm
Systems.
(A)
Local Protective Signaling System
1967 Adopted.
There is hereby adopted by the Village
and incorporated into this Code for
the purpose of prescribing standards
for the installation, maintenance and

use of local protective signaling
systems, that certain code known as
"Standard for the Installation, Main-
tenance and Use of Local Protective
Signaling Systems for Watchman, Fire
Alarm and Supervisory Service", pre-
pared by the National Fire Protection
Association, for general circulation
and use, as the same appears in a pam-
phlet entitled "Local Protective Signal-
ing Systems 1967" (hereafter referred
to as NFPA No. 72A) save and except
such portions as are hereafter modi-
fied or amended, of which Code three
copies have been marked "Official Copy"
and filed for reference and inspection
in the office of the Clerk-Treasurer.
(B) De finitions.
The following words and phrases
when used in this Subd. (12) shall
have the meanings as set out herein:
(1) App r ova 1.
"Approval" means all equipment
shall be listed and meet approval
of Underwriters' ~aboratories, Inc.,
Fire Mutual, or other nationally
recognized testing agency.
Manual stations and fire detectiond
systems shall be used for fire
protective signalling purposes only.
(2) Approved.
"Approved" means accepted by the
Fire Marshal as a result of his
investigation and experience, or
by reason of test, listing or ap-
proved by Underwriters' Laborator-
ies, Inc., Factory Mutual or other
nationally recognized testing
agencies.
(3) Automatic Fire Detection and
Alarm System.

"Automatic fire detection and
alarm syStem'' means an approved
System of automatically operated
heat sensing devices, together with
manual pull stations as required,
which through approved coding trans-
mitters, annunciator panels, or com-
bination thereof and an approved super-
visory type fire alarm panel shall
actuate audible and/or visual alam~
throughout the building, and shall pro-
vide a light or bell on exterior of
building as specified by the Fire
Marshal for said purpose.
(4) Listed.
"Listed" means equipment or materials
included in a list published by a
nationally recognized testing labora-
tory that maintains periodic inspec-
tion of production of tested equip-
ment or materials, and whose listing
states either that the equipment or
materials mee~ nationally recognized
standards or has been tested and found
suitable for use in a specified manner.
(C) Automatic Fire Detection andAlarm System
Required.
Every building shall be provided with an
automatic fire detection and alarm system.
(D) Detailed Requirements.
(1) Wiring.
Ail wiring shall comply with the re-
quirement~of NFPA No. 72A, provided,
however, that cable, including cable
for operation at 150 volts or less
(low voltage applica~on) shall be
installed in metallic raceway ap-
proved for concealment, and shall
comply with paragraph number 725 of
the National Electric Code.
(2) Electric Service.
Electric service to fire alarm system

control panel shall be taken from
a point ahead of the mahbuilding
disconnect and through a circuit
breaker or fused disconnect~ clearly
labeled, painted red and locked in
"ON" position.
(3) Control Panels.
The control panel shall be electrically
supervised, closed circuit, non-coded,
with automatic standby emergency power
supply capable of complete operation
independent of local power conditions,
automatic lock-in and two signal cir-
cuits. The electrical circuits connect-
ing the control panel, alarm stations
and detector circuits shall sound in
the event of failure on any of the
electrical circuits. In addition, a
remote trouble signal shall be provided
in a corridor or other approved oc-
cupied area. The panel shall be enclosed
in a locked metal case, red in color.
(4) Manual Pull Stations.
Manual pull stations finished in red
enamel shall be located in each cor-
ridor of each story, basement or cellar,
so that from each corridor door, not
more than one hundred (100) feet will
be transversed in order to reach a man-
ual station. Stations shall be located
as near as possible, and not more than
five (5) feet from each stair exit.
Where corridors are not provided,
manual stations shall~ be located so
that no point in the building is
more than one hundred (100) feet from
a station. Manual stations shall be
located at or near each exit from the
building. The height of the manual
stations shall be not more than six (6)
feet and not less than four and one-
half (4~) feet, measured vertically
from the floor level. Pull stations
shall be located in the normal path
of exit frOm the area.

(5) Sounding devices.
Alarm sounding devices shall be
provided of such character and
so distributed as to be effec-
tively heard in every room above
all other sounds. Visual and
audible alarms shall be provided
in occupancies housing the hard
of hearing. Alarm sounding de-
vices shall be distinctive in pitch
and quality from all other sound-
ing devices in building. Sounding
devices shall not exceed 150 foot
spacing, and shall be located in
all high noise level areas such
as recreation rooms and indoor
pools. They may be of flush box
design, or painted the color of
the wall to neutralize their ap-
pearance.
(6) Fire Detection Devices.
Smoke or combustion detection de-
vices shall have full electrical
supervision to indicate internal
component failure. Fire detec-
tion devices shall be installed
in all bedrooms, or rooms for
sleeping quarters, in a living,
dining and kitchen combination.

ditional devices shall be installed.
Detection devices shall be installed
in all corridors at intervals not
to exceed 50 feet, in all boiler
rooms, laundry rooms, storage areas,
fire towers and at the top of all
elevator shafts and/or the loca-
tions noted in Paragraph 3431,
Chapter 3 of NFPA No. 72A.
(7) Annunciators.
Fire alarm annunciators or zone
indicator panels shall have power
and wiring electrically supervised,

shall lock in on alarm until the
system is manually reset, and
shall be located as approved by
the Fire Marshal. Annunciator or
zone indicator panels shall be
installed in all buildings having
12 or more living units. Such
buildings zoned as specified by
the Fire Marshal, shall provide
at least one zone for each floor
of each building, with no zone to
include more than 12 living units.
(8) Automatic Magnetic Door Closers.
"Automatic magnetic door holders to
be installed on all fire or smoke
barrier doors in corridors, they
must be installed so they will
autommtically close when the fire
alarm system in the building is
activated."
(E) Existing Buildings.
AutOmatic fire detection and alarm
systems provided or installed in an existing
building shall comply with the standards
provided in this subdivision, provided that
notwithstanding clause (D)(1) of this sub-
division, cable may be run in an approved
surface metallic raceway; and provided
further that notwithstanding clause (D)(6)
of this subdivision, fire detection devices
shall be installed as follows: In all bed-
rooms or rooms for sleeping quarters, and
one(l) in a living room or rooms connected
with the living room in the manner described
in Section 3.36, Subd. (2)(A) so that the
rooms so connected comply with the defini-
tion therein of '~ving room.' The fire
detection devices shall be located in the
rooms so that their operation will at least
be affected by structural characteristics
of the protected area~ possible drafts or
other conditions affecting detector opera-
tion~ which locations shall be subject to
the approval of the fire marshal."
Plans and Specifications.
With each application for a building -11-
permit, two sets of plans and specifications
for the automatic fire detection and alarm
system shall be submitted. If the fire
marshal is satisfied that the proposed work
described in the plans and specifications
filed conform to the requirements of this
Code, he shall endorse in writing or stamp
on'both sets of plans and specifications
"APPROVED". Such approved plans and speci-
fications shall not be changed, modified
or altered without authorization by the fire
marshal, and all work shall be done in ac-
cordance with the approved plans. No person
shall install or construct such system with-
out first having the fire marshal approve the
plans therefor.
(G) Testing.
Ail such alarms and systems installed under
this Code shall be subject to testing by the
fire marshal or other village inspector before,
acceptance, and shall thereafter be tested an-
nually by an agency approved by the village.
(H) Existing Systems;, Extensions.
If an existing automatic fire detection
and alarm system is in conformity with the
provisions of this Code, the system may be
extended into new additions, provided the
existing system is of sufficient capacity
for the new expansion, and provided the exist-
ing system be refurbished so that the completed
system shall comply in every way with the Code.
(I) Compliance Date for Non-Conformin~ Building --
Automatic Fire Detector and Alar~ Systems.
Ail existing uses or buildings and build-
ings now under construction, in non-conformity
h~rewith, shall be corrected, converted, modi-
fied, adjusted or otherwise made to comply with
the above requirement not later than January 1,
1970.
Subd. (13) Access to Roof.
Ail buildings of three or more stories in
height may provide access to roof surface by means
of a permanent ladder and hatch in lieu of a stairway

to roof surface. The detailed plans and specifi-
cations shall be submitted to the Building In-
spector for his approval which shall be given
provided the design or construction will not
create a dangerous condition.
Subd. (14) Application to Existing Buildings.
Ail existing buildings shall comply with
the provisions of Section 3.50 except as other-
wise provided in Subdivision (7) entitled:
"Stairwells Enclosed", Subdivision 12 (D)(1),
entitled: "Wiring" (note --wiring in existing
buildings must comply with NFPA 72A, except that
conduit is not required); Subdivision (12)(D)(7),
entitled; "Annunciators" and Subdivision (12)(D)
(8) entitled: "Automatic Magnetic Door Holders."
Section 3. Section 3.63, Subdivision 2, of the Village
Code is amended to read:
J'(2) Section 7, Minneapolis Electrical Code, is
further amended by adding thereto Subsection 11
to read:
'The off-street parking area or areas and the
area adjacent to such parking site and build-
ing exit door shall be illuminated with light
having an intensity of not less than one-
half foot candle power, measured at any
height between ground level and six feet
above ground level, and shall be regulated
by an automatic controlling device to turn
the lights on from sunset to sunrise, pro-
vided that if the lighting is on at all
times, no such controlling device shall be
required.'"
Section 4. Sections 3.150 through 3.156 of the Village
Code are amended to read:
"3.150 Housing Maintenance Code; Registration
of Multiple Dwellings.
3.151 Registration Required.
As used in Sections 3.151 through
3.156, the phrase "multiple dwelling" shall

mean only multiple dwellings with three ~
or more living units. No person shall
allow to be occupied or let to another
for occupancy any unit in a multiple
dwelling for wkich a registration state-
ment has not been properly made and filed
in duplicate with the Building Inspector.
Said registration statement shall be made
and filed within 60 days after May 15,
1968 on forms furnished by the Building
Inspector for such purpose and shall set forth
the following information:
(a)
(b)
Name and address of the owner or owners
of the multiple dwelling. In cases
where the owner of a multiple dwelling
lives outside of Hennepin County limits,
the registration shall be made by an
operator who shall be legally responsible
for compliance with this and other ordi-
nances and such operator shall live in
Hennepin County;
Name and address of any operator or agent
actively managing said multiple dwelling;
(c), Name and address of all partners (if
the registrant is a partnership);
(d)
Name and address of all officers of the
corporation (if the registrant is a corpo-
ration);
(e)
Name and address of the vendee if the
multiple dwelling is being sold on a
contract for deed;
(f) Legal address of the multiple dwelling;
(g)
Number and kind of units within the
multiple dwelling, (dwelling units,
tenement units, or rooming units);
(h)
Height of themultiple dwelling in
stories;
(i)
Construction of exterior of building --
wood or other.

Execution of Statement.
The registration shall be subscribed
and sworn to by the registra~ before an
officer duly qualified to take oaths and
shall be made by the owner if such owner
is a natural person; if the owner is a
corporation by an officer thereof; if a
partnership, by one of the partners; and
if an unincorporated association, by the
manager or managing officer thereof.
Notwithstandng, renewal of registrations
as required annually by this Code may be
made by filling out the required renewal
form furnished by the Building Inspector
to the owner, operator, or agent of a
multiple dwelling and mailing said form,
together with the required registration
fee, to the Building Inspector. Such re-
newal of registrations may only be made
where there has not been a change in the
ownership, operator, agent or type of
occupancy as originally registered.
Changes in Registration.
No such registration shall be assign-
able. If the name or address of any of the
persons required to be registered shall
change, or if any change is made in the
number or type of units registered, a new
registration statement shall be properly
made and filed with the Building Inspector
within 10 days from the date of such change,.
in the same manner and form as herein pre-
scribed.
Annual Registration.
All multiple dwellingswith three or
more living units shall be registered an-
nually as follows:
Ail registrations of multiple dwell-
ings expiring in the year 1968 shall be re-
newed not later than the first day of
ocotber, 1968. Thereafter, commencing
with the year 1969 the registrations of
all multiple dwellings shall expire and
shall be renewed not later than the first

day of October of each year.
A fee of $15.00 per multiple dwelling,
plus $1.00 for each unit therein, shall be
collected by the Clerk-Treasurer for each
registration required under this Code.
However, if the registration is not made
within the time set forth in this Section,
then the registration fee to be paid shall
be double the amount of the fee required
by this Section.
3.155 Postins.
Every registrant of a multiple dwelling
shall post a receipted copy of registration
received from the Building Inspector and
the occupancy record card issued by the Build-
ing Inspector. These items shall be con-
spicuously posted (in a frame with a g~ss
covering) by the registrant in a public cor-
ridor, hallway, or lobby of the multiple
dwelling for which they are issued.
3.156. Minimum Standards Required for Occupancy.
No person shall occupy as owner-
occupant or let to another for occupancy
any dwelling unit in a multiple dwelling
for the purpose of living, sleeping,
cooking or eating therein:
(1)
Which does not comply with the require-
ments set forth in the Village Code, or
(2)
Which has not been issued a "receipted
copy of registration" from the Building
Inspector and "occupancy record card"
issued by the Building Inspector.
Any multiple dwelling failing to comply
with the requirements set forth in the Village
Code shall not be issued a receipted copy of
registration and an occupancy record card
until compliance is made. The Building In-
spector shall inspect each multiple dwelling
to ascertain if it complies with such require-
ments before issuance.

Section 3.28 of the Village Code is hereby
"3.28 Permit.
The application and the plans and speci-
fications filed by an applicant for a permit
shall be checked by the Building Inspector and
if found to be in conformity with the require-
ments of this Building Code, the Zoning Ordi-
nance, Chapter 4, and all other laws and/or
ordinances applicable thereto,'the Building
Inspector shall, upon receipt of'the required
fee and upon compliance with all other pre-
requisites provided herein, issue a permit
therefor, within a reasonable time, together
with a suitable card showing that a permit
has been issued, to be posted at an entrance
to the structure.
No permit for a multiple dwellimg, com-
mercial or industrial building or buildings
mr public assemblage shall be issued until

Section 6. Subdivision 3 of Section 3.62 of the Village
Code is hereby amended to read:

Permits shall be issued only to an "Electrical
Contractor" licensed as such by the State Board of
Electricity, provided hoWever, that permits for the
installation and maintenance of low voyage (150 volts
or less) auxiliary fire alarm systems, shall be is-
sued to persons licensed as an Installer by the
State of Minnesota or holding a Class D license from
the City of Minneapolis, or licensed under equiva-
lent licensing procedures, except that an individual
may obtain a permit and do electrical work which com-
plies with the provisions of the minimum standards
herein prescribed on premises or that part of premises
owned and actually occupied by him as his homestead
if he shall file with the inspector an affidavit
showing that~he is performing the actual work himself
in such homestead."

Section 7. Subdivision 14 of Section 3.05 of the
Village Code is hereby amended to read:
Subd. (14) Fire Alarm Systems.
For the installation of auxiliary fire alarm
systems, for 1 to 5 stations, inclusive, Five
Dollars ($5.00); for each additional group of 10
stations, or fraction thereof, Five Dollars ($5.00).
The total fee shall in no instance exceed the sum
of FortY Dollars ($40.00).
Section 8. Should any section, clause or provision of
this Ordinance be declared by the courts to be invalid, the same
shall not affect the validity of the ordinance as a whole or any
part thereof, other than the part so declared to be invalid.
Section 9. This ordinance shall be in full force and
effect from and after its passage and publication.

The Village Council of the Village of New Hope ordains:
Section 1. That Section 2.21 of the Village Code
is hereby amended to read:
"2.21 Mayor and Councilmen Salaries.
The salary of the Mayor is hereby
established at $225.00 per month and the
salaries of each of the Councilmen is
hereby established at $150.00 per month."
Section 2. Effective Date. This ordinance shall not
be effective until January 2, 1970, provided that if within
30 days following the publication of this ordinance, a peti-
tion asking for an election on the proposition signed by
voters equal to 10 per cent of the number of voters at the
last regular election is filed'with the Glerk, this ordi-
nance shall not be effective until it has been approved by a
majority of the votes cast on the question at a regular or
special election.

Section 1. Section 3.27 of the Village Code is
amended by the addition of the following subdivision to be
inserted after subdivision (9) thereof:
"(10) Certification.
Ail plans and specifications shall
be prepared and certified by an archi-
tect or professional engineer registered
under the Laws of Minnesota, except
plans and specifications for:
(a) Dwellings for single families, and
outbuildings in connection therewith, such
as barns and private garages;
(b) Two family dwellings;
(c) Any farm building or accessory
thereto;
(d) Temporary buildings or sheds used
exclusively for construction purposes, not
exceeding two stories in height, and not
used for living quarters;
(e) Any public work or public improve-
ment done by a public body in this state,
the cost of which does not exceed $2,000,
provided that plans and specifications for
such work or improvement affecting water
supply or waste disposal are approved by
the appropriate state agency;
(f) Any building, structure, or work,
the total cost of which does not exceed
$30,000, or
(g) A building or other structure
prepared by a person for his exclusive
occupancy or use, unless such occupancy
or use involves the Public health or
safety or the health or safety of the
employees of said person."

the President of The Post Publishing Co., publisher and printer of the newspaper known as

sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly
and is distributed at least once each week. (3) Said newspaper has 50'% of its news columns devoted to

Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500

Villages of New Hope and Plymouth
in the County of Hennepin and it has its known office of issue in the City of Crystal in said county, estab-
lished and open during its regular business hcurs for the gathering of news, sale of advertisements and sale of
subscriptions and maintained by the managing officer of said newspaper or persons in its employ and, subject
to his direction and control during all such regular hours and at which time said. newspaper is printed.
(6) Said newspaper files a copy of each issue immediately with the State Historical Society. (?) Said
newspaper has complied with all the foregoing conditions for at least two years preceding the day or
dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of
Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in 'the form prescribed

AN ORDINANCE AMENDING SECTIONS 2.182 AND. 2'.85
OF THE VILLAGE CODE RELATING TO COMPOSITION
AND PROCEDURES OF THE PARK AND RECREATION
COMMISSION.
The Village Council of the Village of New Hope ordains:
Sec'tiiOn 1. Section 2.82 of the Village Code (added by
Ordinance No 6-7-32) is hereby amended to-read as follows:
"2.82 C'o'mpositiOn.
Subd. (1.)Number.
The Commission shall consist of seven
members who shall be appointed by the Council.
Of these, five shall be adults, with at least
one member of each sex, and two shall be minors.
The members shall be appointed by a majority of
the Council.
Subd. ('2.) Term.
Each 'adult member shall serve a term of
office for ther. ee years; and each' minor member
shall serve a term of office of one year, except
for the members of the original Commission. One
adult member of the original Commission shall
se'rye a term of one year, two a term of two years,
and two a term of three years.' Ail members shall
se:rve until a successor is appointed and qualified.
Terms of office shall expire December 31st. The
Council shall have authority to reappoint members.
Subd. (3) VacanCies.
Any of the following shall be sufficient
ground for the office of a .member to become vacated
upon the adoption of a resolution by the Council
thereon:
(A) Death;
(B) Disability or failure to. serve, shown
by failure to attend any of tkree
consecutive meetings without good
reason.
(C) Removal of residence outside of the
Village of New Hope;
(D)
Resignation in writing, or
Conviction of a crime constituting
a felony or an offense involving
moral terpitude.
Subd. (4.) Filling of Vacancy.
Vacancies shall be filled for the unex-
pired portion of the term by the Village Council,
The remaining members of the Commission shall inter-
view candidates for Commission membership and make
recommendations thereon to the Council. The appoint-
ment of the initial minor members shall be made in
the same manner and shall not be made until recommen-
dations 'are submitted.
Subd. (5.) Defin'itions.
The following terms used in this'Ordinance
are defined as follows:
(A) AdUlt.
"Adult" means a person 21 years 'of
age or over.
(B) Minor.
"Minor" means a person under the age
of 21 years."
'S'eCtion '2. Section 2.85 of the. Village Code (added by
Ordinance No. 6'7-,32) is hereby amended to read as follows:
"2.85 Meeting procedures.
The Commission shall adopt the rules for
the transaction of its business and shall establish
regular monthly meeting dates. SPecial meetings
may be called by any officer of the Commission upon
three days notice to all members. A majority of tke
membership shall constitute a quorum provided that
in the event of a vacancy, a majority of the appointed
and qualified members shall constitute a quorum at any
regular or special meeting. All questions presented
for a vote of the Commission shall be decided by a
simple majority of those present. Minutes 'of each
meeting shall be filed with the Village Clerk-Treasurer
as a permanent record of the Village and mailed to the
Village Manager and all Commission members within two
weeks after the meeting. The Secretary shall notify
all members of regular and special meetings of the
Commission."

The license's issued hereunder shall be numbered
and immediately after .the refilling, chaFging or rechargiFg
of any chemical fire extinguisher, the person who did so'
shall stamp upon a card a~tached to such fire extinguisher
his name and license number, and if-such person is an
employee or.member of a partnership, association or
corporation, the name of such partnership, association
or corporation shall also be stamped on the' card.

"Inspectors 'empl.oyed bY the Fire Department shall
have the r~ght to enter any premises during reasonable
hours to inspect fire extinguishers. If upon any inspec-
tion, the inspector shall find any fire extinguisher which

shall immediately impound such fire. extinguisher and de-
liver it to. the Fire Prevention Bureau afld shall notify in
w~iting the owner of the premises 'from which the extin-
guisher was removed and the person who last .refilled or
recharged the. extinguisher of the' defect or defects in

Section 2. P'e~alty._ Any person violating any provision
of this ordinance shall be guilty of a misdemeanor, and upon con-
viction th.elreo'f shall be p~nished by a fine not to exceed $300 or

AN ORDINANCE ADOPTING THE CODIFICATION
OF NEW HOPE VIIJAGE ORDINANCES AND GIVING
NOTICE OF THE AVAILABILITY THEREOF.
The Village Council of the Village of New Hope hereby ordains:
.Se.ctio~ !.,. Validity, The codification of ordinances
of the Village of New Hope contained in Chapters 1 through 13,
and Appendixes A through E her~in is hereby declared to be the
law of the Village of New Hope, made in accordance with
Minnesota Statutes §41&.191 (Subd. 5).
,Section 2, Reneals. Ail ordinances enacted by the
Village of New Hope prior to enactment of the codification of
the ordinances contained in Chapters 1 through 13, and Ap-
pendixes A through E, are hereby repealed, except Ordinance
5~-1, 55-3, 58-&, 59-2, 60-19 and 62-12.
Section S. Effective Date.. The codification of
ordinances and resolutions contained in Chapter 1 through and
including Chapter 12 herein is effective from and after the
date of publication of this adopting Ordinance.

copies of this codification are available at the office of
the Village Manager.

AN ORDINANCE AMENDING SECTIONS 11.01 AND 11.11 OF
THE VILLAGE CODE RELATING TO THE HIGHWAY TRAFFIC
REGULATION ACT AND DRIVERS LICENSE REQUIREMENTS
The Village Council of the Village.of New Hope ordains:
Section 1. Section 11.01 of the Village Code is amended
to read as follows:
"11.01 Highway Traffic Regulation Act Incorporated
by Reference.
The regulatory provisions of Minnesota
Statutes 1945, Chapter 169, as amended by
Laws 1947, Laws 1949, Laws 1951, Laws 1953,
Laws 1955, Laws 1957, Laws 1959, Laws 1961
(including both Regular Sessions Laws and
1961 Special Session Laws), Laws 1963, Laws
1965, Laws 1967 and Laws 1969 are hereby
adopted as a Traffic Ordinance Regulating
the Use of Highways, Streets and Alleys
within the Village and are hereby incorporated
in and made a part of this ordinance as com-
pletely as if set out here in full."
Section 2. Section 11.11, Paragraph numbered (5) of the
Village Code is amended to read as follows:
"(5)
Section 111.22 of Minnesota Statutes, 1957,
as amended by Laws of 1961 and 1969 (Ficti-
tious or altered driverts license prohibited)."
Section 3. This ordinance shall be in full force and effect
from and after its passage and publication.

AN ORDINANCE AMENDING SECTIONS 5.52 AND 5.169,
AND REPEALING SECTIONS 5.70 THROUGH 5.76, RE-
LATING TO WATER AND SEWER RATES AND USE CHARGES.
The Village Council of the Village of New Hope ordains:
Section~ 1. Section 5.52' Subdivision (1) of the Village
Gode is amended to read:
· '"Subd. (1) Minimum Gharges.
The minimum quarterly charge, whether use of
water is metered or not, shall be as follows:
(a)
For each business, plant,
institution or similar
unit
$ 6.00
(b) For each grade school
6.25
(c)
For each junior high
school or high school
15.00
(d) For each residence, resi-
dent unit or other unit

Section 2.

Section 5.169 of the Village Code is amended
"5.169 Water Rates.
Water billings shall be concurrent with sewer
billings. The rates'for water, furnished to con-
sumers by the municipal water system shall be as
follows'
Subd, (1) Single Family Residence.
(a)
The minimumquarterly charge shall
be $7.00 for each connection.
(b)
The first 30,000 gallons metered
during each quarter shall be billed
at the rate of 35¢ per 1,000 gallons;
all water metered thereafter for the
quarter shall be billed at the rate

of 30¢ per 1,000 gallons.
Subd. (2) Multiple Dwellings.
(a)
The minimum quarterly charge shall be
$7.00 for each housekeeping unit.
Rates for each housekeeping unit
shall be computed on the same basis as
for a single-family residence.
(b)
Where a multiple dwelling has one meter,
which shall be read quarterly, the same
rate as specified in Subdivision (1)(b)
of this section shall apply, except that
the reduction of rate from 35¢ to 30¢
per gallon shall take effect on all gal-
lons metered in excess of 30,000 gallon
times the number of housekeeping units
in the dwelling.
Subd. (3) Schools.
The rates shall be 30¢ per 1,000 gallons.
Subd. (4) Fire Protection Hydrants.
There shall be an annual charge of $50 for
each private fire hydrant. Ail private hydrants
shall be installed at no expense to the Village,
and shall be approved as to plans and specifi-
cations by the Village, and all such construc-
tion shall be inspected and approved by the
Village, and all costs thus incurred by the
Village shall be reimbursed to the Village by
the owner of the property.
Subd. (5) Miscellaneous.
The rate specified in Subd. (1) of this
Section shall apply to every connection with the
municipal water system unless either covered by
a specific subdivision of this section or where
other rates have been provided for by a written
agreement between the consumer and the Council."

Section 3. Sections 5.70 through 5.76, inclusive, be
