The Village Council minutes of December 27, 1966, were read and dtscussed~ It wa~ pointed out that the double bungalow located in the 5700 block of Winnetka Avenue North has been finished as per the drawings presented and approved by the Council and that there has been no violation of such. The New Hope Planning Commission recommends that the New Hc~pe Village Council appoint the. ~ollowtng named three individuals to the New Hope Planning Co remission for three-year terms to begin as soon as approved by the Council and to expire on December 31, 1969, or until their successors are duly appointed and take office: a, Richard Plufka b, Wilfred W'ahl Mel Ohman The following were placed in nc~mination for election of officers of the Commission: Chairman: Wahl, Plufka b, Vice Chairman: Wahl, Sueker~ Bonnet Secretary: Johnson~ Krueger, Swanson, Sueker The officers will be elected at the meeting of January 17~ 1967~ by secret ballot~ o Discussion of possible no burning ordinances. Eliason of Midwest Federal Savings and Loan and a representative of Harry So Johnson Associates, lnCo presented site plan of proposed Winnetka Chateau development. The Commission pointed out that the lil~hting ordinance would have to be met° Motion by Member Waltl, seconded by Member Johnson, that the Commission recommend to the Council that the site plan be approved subject to items 3a, 3b, and 3c of the Planner's report~ and any other non-conforming portions that may be found° Motion carried. · Mr. Cliff Frazier~ and Mro Talberg, of Enterprise Properties, Inc., presented site plans of proposed development at 49th and Winnetka. Mr. Dale Pollock pointed.out that the drainage plans would have to be revised and submitted to the Village Engineer, Mr. Bill Dupayo Discussion of the 'd~dicati0n of? feet for widening of Winnetka Avenue and variance on the setback requirement of 50 feet, lighting facilities for parking lot, and landscapir~o Motion by Member Bonner, seconded by Member Krueger, to recommend to the Council approval of the proposed site plan subject to consultation with the ViLlage Engineer regarding drainage, and that a variance be granted on the setback requirement of 50 feet - the variance not to exceed ? feeto ' Motion carried° Member Ohman arrived at 9 po m. Motion by Member Olioi~ seconded by Member Wahl. ~o recommend to the Village Council that it adopt the above stated ~hange in Seotion 4 of Ordinance Nco 65-8~ Planning Commission Minutes Maroh ?~ 1967 Disoussion~ Consideration was given to the acceptable standards of the two-hour fire=resistive requirements° It was concluded that 1/~" sheet rock was not acCeptable and that 5/8,, sheet rock on each side of the studs would meet this requirement. It was also concluded that the passage of the proposed substitute for point #~ of Section 4 of Ordinance 65-8 constitutes no change but rather a codification of what is already stated in the Ordinance and is consistent with standards in the ,ode. There being no further discussions the vote was called for° carried. Motion carried° Meeting adjourned at 11~30 pom~ ~e NEW HOPE PLANNING COMMISSION Planning Commission Minutes March 21~ 1967 Meeting of the New Hope Planning Commission was called to order by Chairman Plufka at 8 p. mo on March 21, 1967o Members Present: Bonner.~ Click, Johnson, Ohman~ Plufka~ Sueker~ Swanson, Wahl Members Absent: Dyson~ Krueger The Commission minutes of March 7, 19§?, were reviewe& There being no corrections or additions° motion by Member Bonnet.. seconded by Member Johnson, to approve the minutes as printed~ Motion carried~ Mro Richard Reimer appeared before the Commission for further discussion of the possibility of the construction of a dental building at the N~ Wo corner of 50th and Winnetka Avenue {see Commission minutes of March ?, 1967 -- item #5}~ Mr. Reimer stated that the proposed building would be a perfect buffer for that area with limited industry across the street. It was pointed out by the Commission that the adjacent property was zoned SFR and that if the property in question were to be rezoned,, it would constitute spot zoning~ After further discussion '~vith the Commission, Mro Reimer indicated that he will proceed to apply for rezoning.~ Stating that he had been informed that there is no requirement for a public hearing on such matters, Mro Joe Pazandak appeared before the Commission to request a variance from 3 acres required for limited industry to 1.8 acres for the proposed construction of a bakery {a retail outlet included} at 35th and Winnetka Avenue° The matter had been referred to the Commission by the .Village Council /see Council minutes of March 14, 1967 -- item #4}~ Noting that the building plans included a possible expansiom Member Sueker asked what the approximate total number of employees would be when the bakery was fully expanded° Mr0 Pazandak stated there would be possibly 50 employees~ The Commission pointed out that the proposed parking facilities would not meet the parking code if and when the bakery were fully expanded~ Planning commission Minutes March 21, 1967 The Commission also pointed out that in order to grant a variances a reason must be given for requesting the variance; however, there seemed to be no sufficient reason given to grant the variance requested. After further discussions motion by l¥Iember Suekero seconded by i~iember Bonners that the Commission recommend to the Village Council that the request for variance from 3 acres to 1o 8 acres be denied° Motion carried,. The proposed plat of the Science Industry Center - 2nd Addition was presented for review by the Commission by Mr. Ralph Wagnor of Egil Wefald & Associates~ It was noted by the Commission that some of the lots were under {less than} the required 3 acres. After discussion~ the Commission suggested that the plat be given to Midwest Planning (Mr. Dale Pollock} for fruther study and for possible suggestions~ The Commission also stated that possibly consideration should be given to including a "building-to-land" ratio in the re~uirement for limited industry since some businesses may not re iuire or desire a 3-acre site~ Mr~ Herbert Margolis and associate presented preliminary site plans for an apartment building to be constructed at 27th and Hillsboro Avenue,. Discussion relative to setback requirements,> lighting, garages {particularly to 2-hour fire code),, etc~ Review and discussion of the Council minutes of March 14s 19~7, · Appointment of Members Johnson. Click, and Wahl by Chairman Plufka to inquire and report to Commission as to what constitutes a 2-hour fire wall and the possibility of requiring a 1-hour fire wall, Member Bonner inquired as to what constitutes a "completed" buildin~ After some discussion, Chairman Plufka requested that the Village Building Inspector~ Mr~ Bob Crandall, appear at the Commission meeting of April 18, 1967~ for general discussion of the building ordanances, building permitss etc.. MEMBERS PRESENT: Bonner, Johnson, Ohman, Ouimette, Plufka (8:25), Sueker, Swanson, Wahl MEMBERS ABSENT: Click, Krueger Reports from the chairmen of the "Village Control of Garbage Pick-up, "Area Development, "and "Upgrading" Committees were called for. There were no reports at this time and the chairmen stated there would be reports given at the Planning Commission meeting of December 7, 1967. Village Councilman Thorson reported on SSDA giving a brief history of its formation and purpose. Mr. Thorson stated that the SSDA has had offers to purchase the disposal site in New Hope now owned by the SSDA, one being from Automatic Reduction Systems, Inc. who are proposing to install one of their units on the site. The SSDA feels that they should not sell the site but they have discussed the possibility of leasing the property to Automatic Reduction Systems, Inc. Mr. Thorson stated that the matter will be studied and further reports will be given. Member Plufka arrived at 8:25 p. m. The Village Council minutes of November 14, 1967, were reviewed and discussed with the Village Manager reporting on CommissiOn items acted upon by the Council. After review, the Commission felt the plans were inadequate. A question of drainage was raised. After~rther discussion, motion by Member Plufka, seconded~y Member Bonner, that the Commission recommend to the Village Council that the preliminary site plan be rejected on the basis of incompl~te lighting and landscape plans. Motion carried. The Commission would like to point out that if more complete plans are submitted, the Commission would then recommend that th~ site plan be approved. 2. Case #67-38 Request for approval on proposed preliminary plat by Mr. Donald Prall. Mr. Prall presented his request to remove Lo& C, from Lot A, add 10 feet to Lot B; remove 5 feet from Lot B, add 5 feet to Lot C to make lot C useable with required sq. uare feet -- ref: Tract A, Registered Land Survey No. S~8 and part of the NE ¼ of NT; ¼, Section 18, Twp. ll8, Range 21, all in Hennepin County, Minnesota, The question of lot width was raised by the Commission. The request for rezoning was presented to the Commission by ~ir. Moen, stating he would build a double bungalow on the property in question if rezoning is granted. After some discussion, the Commission stated that the general consensus was that although the rezoning would constitute spot zoning, it would not be incompatable with the surrounding area. Again the Commission stressed that it felt the present zoning ordinance is lacking and needs revising in reference to double bungalows. The question of square footage meeting the requirements was raised by the Commission. The following were present and expressed their views: Mr. Gerry Oesterreich - 7940 - 60½ Avenue North - questioned what constituted spot zoning Mr. Richard Ceass -- 7911 -60th Avenue North - stated he would rather see a double bungalow (as proposed by Mr. Noen) on the property in question rather than what is presently there. ~r. Themeo Ellis -- 8050 - 60~ Avenue North - stated he was not specifically opposed to double bungalows but was not in favor of the rezoning. Mr. S. J. Rudolph -- 7930 - 602 Avenue North - presented the following peti%ion of 40 signatures: "~e the undersigned property owners in the vicinity of Lot l, Block l, 51oen'a Second Addition, Hennepin County, Minnesota, which is being under consideration for rezoning from a single family residential to a multiple family residential area, are opposed to this rezoning, as it is not in the best interest of the neighborhood nor following the best use of the land. Embretson presented his request for rezoning of Property in the vicinity of northeast corner of 56th and Boone Avenues North~ The Commission inquired as to the zoning of the surrounding are to the property in question, which is now almost an "island" as far as zoning is concerned. After further discussion, motion by Member 0hman, that the matter be tabled until the next scheduled meeting of the Commission. The Commission recommends that the proposed multiple-dwelling plan for the property in question be resubmitted as a planned development~ Case #67-41 Request for rezoning from SFR to RB by Broadway Village Apartments., Mr. Loren Knott, attorney for Broadway Village Apartments~ presented the request for rezoning stating the intention is to construct a convenience center (grocery store, cleaner, barber and beauty shops) for the people in the development. The Commission suggested the possibility of requesting a special use permit for the convenience center instead of rezoning the property to Retail Business - the concern being that if rezoning is granted as requested and for some reason or another the convenience center fails$ what would be developed on the property? The question of whether or not the entire plan for the complex could be submitted as a planned development was also raised by the Commission, After further discussion, motion by Hemher Plufka, seconded by Hember Fahl, that the Planning Commission recommend to the Village Council that it grant rezoning to ~R instead of RB, along with the recom- mendation of the Commission that the Council amend the zoning ordinance to allow for a special use permit for the establishment of a convenience center (of small and retailed businesses) in multiple residential dwellings of lO0 units or more for use by the people in the multiple complex. ~Iotion ca~riedo Planning Commission Minutes -4- December 5, 1967 6. Case #67-42 Request by Mr. George W. Robinson to waive platting ordinance. Mr. Robinson presented his request to waive platting ordinance to permit the division of Lot ll (Block l, Midland Terrace 1st Addition) from the balance of the tract. After some discussion, motion by ~'Iember Plufka, seconded by ~ember Wahl, that the Commission recommend to the Village Council that it grant the request to waive the platting ordinance. Motion carried. 7. Case #67-43 Request for approval of preliminary plat by Mrs. Hazel Tuseth. Mrs. Tuseth presented her request for plat approval of Lot i of Block i of H~,el Hills Second Addition and stated that although some of the surrounding property is being considered as a park site, there has been no action by the park board and someone is very interested in purchasing the property in question. After some discussion of the situations that could arise if Mrs. Tuseth sells the property in question, motion by Member Bonnet, seconded by Member Ohman, that the Commission recommend to the Village Council that it approve the preliminary plat of Lot 1. Motion carried with ~ember Plufka opposed. The Planning Commission would like to call to the attention of the Co mucil that the Commission is aware of the fact that this could create a problem in future development. e Mr. Joe Pazandak appeared before the Commission to discuss possible developments of property owned by Mr. Ellis which is presently zoned industrial. Nr.~ Loren Knott, attorney for Broadway Village Apartments, presented the request for variances on density, lot and building size, along with a request for approval of site plan. A complete site plan - including lighting,, landscape and drainage plans -was also presented to the Commission by Nr. Knott.- The Village Nanager r~eported on the action taken by the Council at the meeting of December l~, 1967 (see item ~9 of Council minutes) that th~ request to rezone from SFR to RB was granted. After some discussion,, motion by Member Plufka, seconded by Nember 0ulmette, that the COmmission recommend to the Village Council that it deny the variance of size of lot and building. Notion carried. The matter of density was then considered by the Commission. Knott stated the density is based only on the property zoned ~IFR and does not include the property now rezoned RB. Discussion of possibility of cl~osing off the Louisiana access to discourage using the driveway of the complex as a short cut to Broadway Avenue. After further discussions motion by Member Bonnet, seconded by Nember Krueger, that the Commission recommend to the Village Council that it deny the request for variance of density and deny approval of the site plan because of the variance required, l~otion carried. Planning Commission ~inutes December 19, 1967 Feeling that the matter warranted further consideration, motion by ~ember %~ahl, seconded by I~Iember Swanson, that the Commission recom- mend. to the Village Council that it approve this plan as a planned development, including the RB portion as provided in the ordinance; and, that the Commission recommends the Louisiana access be removed and all easements and dedications on Louisiana and Broadway be granted in compliance with all ordinances. Notion carried. The Commission would like to point out that it feel.s the above motion still meets the intention of the ~ordinance when the green area and RB portion of the property as a whole is taken into consideration since the relationship of size, etc. to building density is of sufficient excess to make the density variance less than 1/10 of lfj and is in- c~rzs eq ~ent i al.
