Mr.AaronChirpich,CommunityDevelopmentSpecialist,gave backgroundontheplanningcase.HestatedDennisBatty,onbehalfof MorganIII,LLC,wishestoredevelopthesitelocatedat3535Winnetka Avenuebyremovingthemajorityoftheexistingsiteimprovementsand constructinga1,555squarefootrestaurantȠ¹§´ª½¯©®¹®µ¶ȡwithdrive throughandoutdoordiningarea.Theexistingsitecontainsanoperational gasstationwithdormantcarwash.Theapplicantproposestoremovethe carwashportionofthebuilding,allexistingpavementandallgasrelated infrastructure.However,theprimarybuildingwheretheconvenience storeislocatedwillstayintact.Thisportionofthebuildingwillbe remodeledintothenewrestaurantspace. Chirpichwentontopresentazoninganalysis.Theproposedbuilding placementmeetsallsetbackrequirements,excepttherearsetback,which isanexistinglegallynonconformingcondition.Duetotheplacementof theexistingbuildingthatisbeingsaved,theplacementofthedrive throughservicelanebecomesrestrictedandisproposedtobesetbacktwo feettoprovideadequatevehiclemaneuvering,thoughtheminimum setbackpercodeisfivefeet.Duetothisrestriction,theapplicantis seekingtheflexibilityaPlannedUnitDevelopmentzoningdistrict provides.Proposedpedestrianaccess,numberofparkingspaces,and bicycleparkingmeetcityrequirements.Drivethroughscreeningprovided bythefencethatisdescribedinthenarrativeshouldbedetailedonthe siteplan.Thelandscapeplanshouldbeamendedtoshow:fulllength parkinglotscreening,groundcoverthatisoutsideofplantingareas, retainingwalllocationsandrelevantplansets,andirrigationplans;it shouldalsobeadjustedtoaccommodatetheFireDepartmentConnection andrevisedpedestrianconnections.Thephotometriclightingplanmeets citystandards,andthoughthefreestandingpolesdonotmeetsetback requirements,theConditionalUseofPlannedUnitDevelopmentwould provideflexibilitytoallowthis.Proposedsignageonthesiteplanmeet citycoderequirements,thoughtheapplicantwillneedtoprovidedetails onmenuboardandtrafficdirectionalsigns.Theapplicantwillneedto addressFireMarshalcommentstotherevisedplansubmittalsprovidedat thismeeting.Thedrivethroughservicelaneandoutdoordiningareaare administrativeusesintheCBdistrictandwillrequireadministrative permits.Aloadingareawillnotberequired,buttheapplicantmust providesiteplanswithturningradiishowinghowdeliveryvehiclesand garbagehaulersnavigatethesite.Thetrashenclosuremeetscity standards.BuildingmaterialsanddesignmeetNewHopeDesign requirements,thoughthelocationandheightofrooftopscreeningmustbe provided.Snowstorageisaconcernduetothe¹¯º«ȟ¹smallsize. Mr.ChristoperLong,CityEngineer,waspresenttoprovidecommentson the¹¯º«ȟ¹stormwateranddrainage.The¶¸µ¶«¸º¿ȟ¹locationintheBasset CreekWatershedwillrequireareviewoftheerosioncontrolplan.He explainedthedrainagepatternsofthesitecatchsedimentinstormwater beforegoinginbasins.Furtherresearchneedstobedonetodeterminethe sizeofthelineaswellasavisualTVinspection. ChirpichsummarizedfindingsofthesiteplanandConditionalUsePermit forPlannedUnitDevelopment.Accordingtostaff,theproposedsiteplan meetstheintentoftheComprehensivePlanandisconsistentwiththe intentoftheCityCode.Stafffindsthattheproposalmeetsthestandards ofaPlannedUnitDevelopment;thefindingsofthesestandardswere presented. Mr.ChirpichstatedthattheDesignandReviewCommitteemetwiththe applicantonDecember17,2015andwasinfavoroftheproposed developmentandrequestforPUDflexibility.Propertyownerswithin350 feetofthepropertywerenotifiedbymail,andapublichearingnoticewas publishedintheSunPost.Staffhasnotreceivedanyinquiriesregarding theproject. Whentheopportunityforquestionstostaffarose,concernaboutthe locationofthecrosswalkoffofWinnetkaAvenueNorthwasraisedby CommissionerBrinkman.Therewasdiscussionevaluatingthetwo proposedlocationsofthecrosswalk;theproposedlocationinthemiddle ofthesiteoffofWinnetkaAvenueNorthpromotedconcernabout crossingbetweentwoparkedcars,limitingvisibility,andtheproposed locationnearthesouthendofthelotwasseenaspotentiallydangerous duetoincomingtrafficturningimmediatelyrightintothe©¸µ¹¹½§²±ȟ¹ path.CommissionerMcKenziefavoredutilizingparkingstall17ofthe currentsiteplanasacrosswalk,creatingaraisedislandtoprevent collision.Mr.AlanBrixius,CityPlanner,mentionedraisedislandswere considered,buttheycouldcausesnowremovaltobeproblematic. 2 PlanningCommissionMeetingJanuary5,2016 Furthercommentsregardingtheproposalweremade.Commissioner McKenzienotedthatsnowstorageonthenorthwestcornerofthesite wouldinhibitpedestrianaccessandmayimpactturningmovement.It wasquestionediftherampdetailprovidedwiththeplansiscompliant withthestandardssetforthbytheAmericanswithDisabilitiesAct.He inquiredhowthesiteisbeingbackfilled.Discussionregardingthefence abuttingtheretainingwalltothewestofthepropertyincludedcleanup ofthenookbetweenandalternativeoptionsforplacement.Itwasclarified thatthepropertyownerortenantwouldcleansumps,andifthiswasnot beingdone,thecitywouldintervene,providedaccessbytheeasement. Mechanicalplans,itwasexplained,woulddetermineFireDepartment Connectionlocation.CommissionerSmithaskedfordetailonthe proposedfence,anditwasexplaineditwouldbecompositeorwood; chainlinkfencingisnotallowed.Healsoinquiredabouttheheightofthe bollardsandwasansweredthattheywouldbeatleast48incheshigh. ChairSvendsenquestionediftheproposalwouldbereadyforCouncilon January25.Thusfartherehavebeenmanychangestothesubmitted documents,andtheystillnecessitatefurtherchange.Mr.Chirpichfelt confidentitwouldbeready;theapplicanthasbeenresponsivetorequests andhasproducedthechangesinatimelymanner. ChairSvendsenmotionedtheapplicanttocomeforward.DennisBatty, ProjectArchitectofDennisBatty&AssociatesGroup,of22770Imperial AveNorthinForestLake,MN,approachedthepodium.Battyexplained thechallengesfacedwithproposedchanges,asapprovalfrommultiple sourcesmustbegivenbeforealterationstoplanscanbemade.Hestated heiswillingtomakeproposedchangesandtouchedoncommentsmade regardingturningradius,landscapeplan,pedestriancrosswalk,fencing, andproposedsnowremovalinplaceofsnowstorage.Headdedthatthere areplanstorebuildtheretainingwallsintheirexistinglocations. CommissionerSvendsenquestionediftherewasanagreementwiththe adjacentpropertyownerstorebuildtheretainingwallsandaskedifthe drivethroughroofwouldclearagarbagetruckateightfeethigh.Batty answeredplacingthefenceontopoftheretainingwallwithspacein betweenmaybeanoptionandthattheroofwouldbealtered.Battyalso iteratedhebelievesthedeadlinetopresenttheproposaltotheCity Councilandrequirementssetforthcanbemet. ChairSvendseninquiredifanyoneintheaudiencewishedtoaddressthe Commission.Beingthatnoonespoke,heaskedforamotiontoclosethe PublicHearing. Motion byCommissionerLandy,seconded byCommissionerSchmidt,to closethepublichearing.Allpresentvotedinfavor.Motioncarried. FurtherdiscussionabouttheproposalmeetingthedeadlinetogotoCity Councilensued.Confidencewasreiteratedbyseveralsourcesthatthe proposalwouldbeready. 3 PlanningCommissionMeetingJanuary5,2016 Mr.BrixiusaskedforconsensusfromthePlanningCommissionastowhere thecrosswalkfromWinnetkaAvenueNorthshouldbeplaced.Mr.Long wasinvitedtothepodiumtoprovideinput.Heconcurredtherewascause forconcernabouttrafficturningintothecrosswalkwhenlocatedonthe southsideofthepropertyandspokeoftheincreasedvisibilitythislocation provides.Heexpressedapprovalofthelocationbetweenparkingspotsin themiddleofthepropertyonlyiftheareawasraisedtoprovidedistinction andincreasedvisibility.Itwasalsoassuredthatthesoilboringsandramp wouldbefurtherexamined.Battywasreceptivetoplacingthecrosswalk wherethePlanningCommissionsawfit.FurtherdiscussionensuedandMr. Brixiusconfirmedthepreferencewastoplacethecrosswalkthroughstall17, raisingthesurfaceandchangingmaterial.Mr.Chirpichclarifiedthatdoing thiswouldpossiblydecreasethenumberofparkingspacestobelowthe minimumrequiredamount,andtherewasconsensusthiswasacceptable becauseofPUDflexibility.
