In the event Purchaser determines in his sole discretion that it is in his best interest to obtain a Phase I environmental report for the Property, the Phase I environmental report shall be ordered at the cost and expense of the Purchaser. Seller shall allow Purchaser and Purchaser's agents, access to the Property at all reasonable times for the purpose of Purchaser's investigation and testing. Purchaser shall pay all costs and expenses of such investigation and testing and shall hold Seller and the Property harmless from all costs and liabilities relating to Purchaser's activities. Such notice must be given by the date hereinbefore specified for Purchaser to complete its inspection and investigation. Provided, however, and notwithstanding Purchaser's right to terminate and have all earnest money refunded, Seller shall have the right upon receipt of the above- described notice from Purchaser to cure the defect noted by Purchaser within sixty (60), days from the receipt of the notice from Purchaser.
