(Improvement project 841) Requested Action Staff requests the Council consider approval of a resolution awarding a contract to the low and responsible bidder, Minnesota Native Landscapes Inc., in the amount of $9,218.10 for the preparation and replanting of the runoff channel located at 55th Avenue North and Sumter Avenue North with a three -year site maintenance agreement. Policy /Past Practice The city of New Hope has utilized native plants in past water quality projects to both beautify areas within the city and serve as an ecological benefit to the city's natural areas. Also, the city of New Hope identifies areas where species deemed noxious by the Minnesota Department of Agriculture have become established and seeks methods of controlling such species. Background The 55th and Sumter Avenue North storm water runoff channel was installed as part of the Ryland redevelopment project, to satisfy the project's storm water management requirements. The initial seeding performed by Ryland's subcontractor was composed of a mix that was not approved by city staff and engineers. Staff required the contractor to replant the site with the approved seed mix in the spring of 2006. Initially, desired plant species performed well; unfortunately, due to extreme growing conditions, noxious species became well established on the site. Because of environmental concerns, the city received recommendations from the Shingle Creek Watershed Commission consultants to maintain the site as a storm water runoff channel and use different plant communities to resolve initial problems with the site. In addition to the recommendations by the Shingle Creek Watershed Commission, the commissioners and city staff offered an opportunity to the students of Cooper High School to attend a meeting to listen to the concerns, problems and thoughts on the site and, in turn, develop a landscape design for the site. On January 29, 2008, staff invited residents in the 55th and Sumter neighborhood to discuss their site concerns along with city staff, a member of the Shingle Creek Water Shed Commission, Council members and students and staff from Cooper High School. Some of the concerns presented included weed issues, pollen /allergy concerns, need for a manicured look, unwanted foot traffic, and maintainability. Cooper High School students took the information and, together with high school staff and a volunteer ecologist, put together a landscape plan for the site. At a meeting on March , 2008, the student representative from Cooper High School presented their site plan to neighborhood residents. Both of the residents directly adjacent to the site gave favorable comments on the students' plan and how the students addressed each issue with the site individually. A request for quotes was sent to five contractors that specialize, or have departments that specialize, in restoration projects in line with the 55th and Sumter Avenue site. The city received two quotes; from Minnesota Native Landscapes Inc. in the amount of $9,218.10; and Top Notch Treecare, Urban Ecosystems division in the amount of $21,056.75. Staff recommends acceptance of the lowest responsible quote provided by Minnesota Native Landscapes, Inc. Initial site preparation which includes application of an herbicide, and physical removal of some undesired plant species, will be completed by city staff prior to the contractor prepping and replanting the site. At the April 21 work session, the New Hope City Council requested that staff return to the April 28 Council meeting for approval of the project and awarding of the contract. Funding The cost of $9,218.10, tax included, for completion of the project will come from the city's storm water fund. For valuable consideration as set forth below, this contract dated the 28 day of April, 2008, is made and signed by the City of New Hope (hereinafter "City') and Minnesota Native Landscapes, Inc. (hereinafter "Contractor"). 1. CONTRACT DOCUMENTS The Contractor hereby promises and agrees to perform and comply with all the provisions of this Contract and specifications, all of which are incorporated hereby by this reference. This Contract shall compromise the total agreement of the parties hereto. THE WORK The work to be performed by Contractor under this Contract (hereinafter the "Work "), is defined in Exhibit A (request for proposal and proposal submitted by Minnesota Native Landscapes, Inc.). CONTRACT PRICE The City agrees to pay the contractor $9218.10 dollars (nine thousand two hundred eighteen dollars and ten cents), $6668.10 payable upon completion of the landscape portion of the contract, $850.00 payable upon completion of the maintenance agreement for three consecutive years totaling $2550.00. Contractor will be charged liquidated damages assessed in the amount of $100 per day for every calendar day that the landscape portion of the contract remains uncompleted beyond the 15th , day of July, 2008. Total amount of this contract shall not exceed $9218.10. 4. COMPLETION DATE Contractor shall complete his performance, with the exception of the three year maintenance agreement, under this Contract by the 15th day of July, 2008 (hereinafter "Completion Date "). 5. INSURANCE /BOND Before beginning actual work under this Contract, the Contractor shall submit to the City and obtain the City's approval of a certificate of insurance on Standard Form C.I.C.C. -701 or ACORD 25 forms, showing the following insurance coverage and listing the City as a loss payee under the policies: a. General Contractor Liability: $1,000,000.00 b. Automobile Liability for all Automobiles: $1,000,000.00 c. Workman's Compensation: Statutory Amounts Contract Page 2 This certificate must provide for the above coverages to be in effect from the date of the Contract until 30 days after the Completion Date and must provide the insurance coverage will not be canceled by the insurance company without 30 days written notice to the City of intent to cancel. The certificate must further provide that the contractor's insurance coverage is primary coverage notwithstanding any insurance coverage carried by the City that may apply to injury or damage relating to the maintenance or repair of the City's streets or right -of -ways by either the City or any employee, agent, independent contractor or any other person or entity retained by the City to perform the services described herein. The Contractor shall furnish Performance and Materials /Labor Bonds, each in an amount at least equal to the Contract Price as security for the faithful performance and payment of all Contractor's obligations under the Contract Documents. These Bonds shall remain in effect at least until one year after the date of final payment, except as otherwise provided by law. All Bonds shall be in the forms prescribed by the Contract Documents and be executed by such Sureties as (A) are licensed to conduct business in the State of Minnesota, and (B) are named in the current list of "Companies Holding certificates of Authority as Acceptable Sureties on Federal Bonds and as Acceptable Reinsuring Companies" as published in Circular 570 (amended) by the Audit Staff Bureau of Accounts, U.S. Treasury Department. If the Surety on any Bond furnished by Contractor is declared bankrupt or becomes insolvent or its right to do business is terminated in the State of Minnesota or it ceases to meet the requirement of clauses (A) or (B) in the previous paragraph, Contractor shall within five days thereafter substitute another Bond and Surety, both of which shall be acceptable to City. LAWS REGULATIONS AND SAFETY The Contractor shall give all notices and comply with all laws, ordinances, rules and regulations applicable to performance under this Contract. 7. INDEMNIFICATION The Contractor agrees to indemnify, defend and hold the City harmless from any damages, including costs and attorney's fees, from any claims, demands, actions or causes of action arising out of any act or omission on the part of the Contractor or its agents, servants or employees in the performance of or with relation to any of the work or services performed or furnished by the contractor under this Contract. 8. At the April 28 City Council meeting, the 55th and Sumter planting restoration project was approved. Preparatory work by city staff began shortly after. An agreement between Minnesota Native Landscapes and the city of New Hope stated that removal of cattails would be completed by city staff prior to the contractor's site restoration. On several occasions, City staff worked to both physically and chemically destroy and /or remove the cattails from the site, with limited success. On June 25, city staff along with a Council member and a Shingle Creek Watershed Commissioner discovered that water in the bottom of the channel was evident even during extended periods with no rainfall, and determined that the standing water should be eliminated from the site through installation of drain file in order to have a successful restoration project. This information was presented to the City Council at its work session of July 21 at which time staff was directed to seek quotes for the drain tile and landscaping work. A request for quotes was sent to nine contractors that were identified as having experience in drain file installation projects. The city received five quotes; from Minnesota Native Landscapes Inc. in the amount of $3,270; Morris Excavation in the amount of $3,780; G.F. Gedlicki Inc. in the amount of $7,953.42; Sunram Construction Inc. in the amount of $8,000; and Penn Contracting Inc. in the amount of $8,900. Staff recommends acceptance of the lowest responsible quote, provided by Minnesota Native Landscapes Inc. Upon completion of discussions, staff is requesting direction from the Council on whether or not the city should proceed with the replanting and associated work related to proper establishment of plants in the storm water retention basin. If the decision is to proceed with the replanting of the storm water retention basin, the city needs to identify an acceptable quote as soon as possible so the work can be completed early this spring. Preparation of the site and replanting of the storm water retention basin ideally should be completed prior to July, 2008, in order to allow the best opportunity for plant survival and establishment. Policy /Past Practice The city of New Hope has utilized native plants in past water quality projects to both beautify areas within the city and serve as an ecological benefit to the city's natural areas. Also, the city of New Hope identifies areas where species deemed noxious by the Minnesota Department of Agriculture have become established and seeks methods of controlling such species. Background The 55th and Sumter Avenue North storm water retention basin was installed as part of the Ryland redevelopment project, to satisfy the project's storm water management requirements. The initial seeding performed by Ryland's subcontractor was composed of a mix that was not approved by city staff and engineers. City staff took necessary actions to prepare the site for a second attempt to get the proper seed mix dispersed and established in the spring of 2006. Complaints from residents on the current condition of the site, and city staff involvement in noxious weed control, sparked discussions of potential solutions to the issues with the site. Because of environmental concerns, the city received recommendations from the Shingle Creek Watershed Commission consultants to maintain the site as a detention basin and use different plant communities to resolve initial problems with the site. In addition to the recommendations by the Shingle Creek Watershed Commission, the commissioners and city staff offered an opportunity to the students of Cooper High School to attend a meeting to listen to the concerns, problems and thoughts on the site and in turn develop a landscape design for the site. On January 29, 2008, staff invited residents in the 55th and Sumter neighborhood to discuss their site concerns along with city staff, a member of the Shingle Creek Water Shed Commission, Council members and students and staff from Cooper High School. Some of the concerns presented included weed issues, pollen /allergy concerns, need for a manicured look, unwanted foot traffic, and maintainability. Cooper High School students took the information and, together with High School staff and a volunteer ecologist, put together a landscape plan for the site. At a meeting of March 5, 2008, the student representative from Cooper High School presented their site plan to neighborhood residents. Both of the residents directly adjacent to the site gave favorable comments on the students' plan and how the students addressed each issue with the site individually. A request for quotes was sent to five contractors that specialize, or have departments that specialize, in restoration projects in line with the 55th and Sumter Avenue site. The quotes are due on April 21, and staff will bring that information to the work session. Funding Funding for the project would be from the city's storm water fund. Subject: Planting at 55 and Sumter Retention Basin The city of New Hope is currently requesting price quotes for the replanting of a New Hope Storm Water Detention Basin located at the intersection of 55 and Sumter Avenue North. Approximately four years ago this basin was seeded with a mixture of upland and lowland prairie seed. Unfortunately, we had limited success getting the plants established. Over the past several months, Residents, City staff, and Members of the Shingle Creek Watershed Commission solicited students from Cooper High School to develop a plan for the site that we now wish to implement. Plant selection was based upon residents' feedback to address pollen counts, height, maintenance, mosquito issues and aesthetics. The entire Basin is approximately 135' in length and 60' in width. Both ends contain Rip Rap as part of the original plan as the basin also acts as an emergency overflow for the properties directly west of the site. Prior to planting the city will perform necessary applications of Round -up /Rodeo and mowing of the site to help prepare the surface for planting. The quote estimate shall include the contractor providing all services, materials and labor necessary to complete revitalization of the site. This includes: • Reshaping the top edge of the basin to make a mowing transition for the adjacent property owners to easily maintain the turf grass. • Extending the turf grass over the lip of the basin, approximately three feet down the slope of the basin. • Provide secured weed control, preferably a spun landscape fabric or approved equivalent. • Plant basin according to the plan developed by the Cooper High School students (see planting plan and layout included), utilizing a balanced composition of the listed plant varieties (please note if unavailable and offer equivalent). • Plants, when available, shall consist of 1" plugs. Shrubs sized in 5 gallon pot or equivalent (please note if unavailable and offer equivalent). • Provide erosion control (organic and biodegradable) to be placed along the sloped sides. Please specify type of erosion control to be used. • As an alternate, please provide a three year maintenance plan to be completed by the contractor, including but not limited to a breakdown of prescribed maintenance activities (watering, weeding, seasonal care, frequency) and costs. *Please provide any warranty information for the plantings as well as warranty on all work performed.
