President Hemken introduced for discussion EDA Item 4, Resolution approving
purchase and redevelopment agreement with Fieldstone Family Homes, Inc. for
the sale of 5306 Rhode Island Avenue North (improvement project no. 1080).
Mr. Jeff Alger, community development specialist, stated the public hearing is to
approve the sale of 5306 Rhode Island Avenue North to Fieldstone Family Homes, Inc.
He explained the EDA acquired 5306 Rhode Island Avenue North in January of 2022
as part of the city’s scattered site housing program for $130,000. He reported since 2006
the city has facilitated the construction of 37 new homes in the neighborhood, and the
average sales price for a home constructed in the Windsor Ridge subdivision was
$430,000.
Mr. Alger stated the home at 5306 Rhode Island Avenue North was demolished in
April, and the lot has been prepared for construction of a new single‐family home. He
stated a Request for Proposal was sent to 40 builders, and the city received five
proposals. Staff reviewed the proposals with the city manager and selected “Macalester
Elevation B” from Fieldstone Family Homes as the preferred proposal. He reviewed
the proposals and explained Fieldstone Family Homes’ two‐story home includes the
highest projected sales price ($575,000), the highest lot purchase price ($87,000), several
upgrades including high‐end interior finishes. The finished square footage will be 2,259
and the buyer would have the option of finishing the basement. The estimated

expenses for the project are $253,072, and the lot would be sold for $87,000 resulting in
a net loss of $166,072. If the property were valued at $575,000 the total taxes paid to the
city would increase by $2,100 in 2024, as compared to 2022. The closing would occur
within 60 days, and construction is expected to begin this summer. Fieldstone Family
Homes is a custom home builder based out of Burnsville and this will be their first
project in New Hope. Funding for the project would be through the EDA budget.
Council Member London complimented staff on the advancement of the scattered site
housing program and successful projects.
Mr. Matt Bruels and Mr. Brian Bruels of Fieldstone Family Homes, were recognized.
They thanked the city for the opportunity to work in New Hope.
President Hemken opened the floor for the public hearing. There was no one in the
audience desirous of addressing the EDA for the public hearing.

CURBSIDE APPEAL
REIMBURSEMENT
PROGRAM
Item 5
President Hemken introduced for discussion EDA Item 5, Resolution approving
curbside appeal reimbursement program.
Mr. Jeff Alger, community development specialist, stated the program is intended to
encourage homeowners to make improvements to the exterior of their homes and
garages in areas that are visible from the street. The city will reimburse a portion of the
costs for projects that meet eligibility requirements. All projects must be pre‐approved
by city staff. There are no income limits to participate in the program, and
reimbursement amounts range from a minimum of $1,000 to a maximum of $5,000.
Applicants are responsible for 75% of project costs up to $20,000 and 100% of costs
beyond $20,000. Staff recommends allocating $100,000 per year for the program
through the EDA budget. Implementation of the program in 2022 will be funded by
the general fund surplus generated by ARPA (America Rescue Plan Act) funding
received in 2021 and 2022.
Mr. Alger responded to inquiries by Council. He stated applications will be reviewed
on a first‐come, first served basis and if funding is depleted in a given year, applicants
can be placed on a wait list for the next year. He confirmed there are no income
restrictions or requirements for participants to remain in the home a certain length of
time.

Requested Action
Staff requests the EDA to adopt the attached resolution establishing the HRA levy of $437,850 for the 2023
budget.
Background
The city is adopting an EDA levy and an HRA levy. The preliminary budget presented at the August work
session included a $160,650 EDA levy and a $437,850 HRA levy for a total of $598,500 for redevelopment
activities, etc).
The HRA levy was implemented with the 2022 budget year. At that time the city attorney informed staff that
with the addition of the HRA levy, the EDA levy must be included in the city tax rate and the HRA levy
established as a special taxing district. Also, the EDA has authority to approve an HRA levy (a special taxing
district levy).

RESOLUTION NO. 2022‐
RESOLUTION AUTHORIZING THE PROPOSED HRA LEVY
PURSUANT TO MINNESOTA STATUTES,
SECTION 469.033, SUBDIVISION 6 AND APPROVAL
OF A PRELIMINARY BUDGET FOR FISCAL YEAR 2023
WHEREAS, pursuant to Minnesota Statutes, Section 469.001 to 469.047 (the “HRA Act”), the City Council
of the City of New Hope created the City of New Hope Housing Redevelopment Authority (HRA); and
WHEREAS, in 1989 the City Council of the City of New Hope established the Economic Development
Authority (“Authority”) to replace the HRA; and Section 469.033, subdivision 6, permits the Authority to
levy and collect a special benefit levy of up to .0185 percent of estimated market value in the City upon all
taxable real property within the City; and
WHEREAS, the Authority desires to levy a special benefit levy in the amount of up to .0185 percent
estimated market value of the City; and
WHEREAS, pursuant to Minnesota Statues, Section 275.065, the Authority is required to adopt a
proposed budget and a proposed tax levy and submit the same to the County Auditor by September 30;
and
WHEREAS, the Authority has before it the amount of the proposed HRA levy for collection in 2023,
subject to any adjustments in the final levy.
NOW THEREFORE BE IT RESOLVED by the New Hope Economic Development Authority:
1. The proposed budget of $437,850 for the operations of the HRA in fiscal year 2023, as presented for
consideration by the City Council, is hereby in all respects approved, subject to final approval by the
Authority before certification of the tax levy under Minnesota Statutes, Section 275.07.
2. Staff of the Authority are hereby authorized and directed to file the proposed budget with the City in
accordance with Minnesota Statues, Section 469.033, Subdivision 6.
3. The proposed special benefit levy pursuant to Minnesota Statutes, Section 469.033, Subdivision 6, is
hereby approved in maximum amount equal to .0185 percent of estimated market value in the City of
New Hope, currently estimated to be $2,382,189,700 subject to final approval by the Authority before
certification of the special benefit levy pursuant to Minnesota Statues, Section 275.07.
4. Staff of the Authority are hereby authorized and directed to seek the approval by resolution of the
City Council of the levy of special benefit taxes payable in 2023 and to take such other actions as are
necessary to bring before the Board the preliminary budget and levy to be sent to the county auditor
by September 30, 2022.
Adopted by the Economic Development Authority on September 12, 2022.

Requested Action
Staff requests approval of a resolution awarding a contract for hazardous material abatement, tree
removal, demolition of building and site improvements, well sealing, site grading, sewer lining, water
service valve replacement, and the installation of new sewer and water services for a future second lot at
4201 Boone Avenue North, to the low and responsible bidder, Kevitt Excavating, LLC, in the amount of
$77,300.
Policy/Past Practice
It is a past practice of staff to present contracts to the Economic Development Authority for consideration when
public bidding is required for scattered site housing projects.
Background
The Economic Development Authority (EDA) acquired the property located at 4201 Boone Avenue North for
$245,000 in June of 2022, as part of the city’s scattered site housing program. The property was previously
owned by TreeHouse, a nonprofit organization that serves teenagers. In November of 2021, TreeHouse merged
its New Hope and Plymouth locations and elected to sell the property to the EDA. The 0.6‐acre parcel is zoned
R‐1, Single‐family Residential and is large enough to split into two lots without a variance in order to
accommodate the construction of two new homes. The existing lot abuts 42nd Avenue North to the south and
Boone Avenue North to the east, locating it near one of the busier intersections in the city. Extensive work must
be completed in order to prepare the lot for the construction of two new homes, including:
Removing hazardous materials from the home and garage.
Demolishing the home and garage.
Sealing an old well.
Removing a large number of trees, shrubs, and bushes. Healthy trees at the southeast corner of the site
will be preserved to assist with the screening of traffic and noise from Boone and 42nd avenues. Aside
from one large tree near the west property line, all other trees at the property will be removed. The
property owner to the north has signed a right of entry agreement to allow for access to remove trees,
shrubs, and bushes from the northeast corner of the lot. As a result, the demolition contractor will be
able to properly grade land in the area.
Removing several small and large boulders, asphalt, and pavement.
Re‐grading the site as per specifications developed by Stantec. This includes the creation of a small berm
near the southeast corner of the lot, extending west from the existing hill in the area to assist with the
screening of traffic and noise.
Lining the existing sewer line and replacing the existing water service valve (alternate).

Staff requested quotes from five contractors for the work. The project specifications requested a base quote for
hazardous material abatement, tree removal, demolition, well sealing, and re‐grading and an alternate quote
for utility work. Due to the extensive scope of work associated with the project, demolition contractors were
required to meet with city staff on site prior to submitting a bid. The following quotes were submitted:

The EDA has worked with the low bidder, Kevitt Excavating, LLC, on previous scattered site housing
demolition projects. Staff had a good experience working with the contractor and has no concerns with
awarding them the contract.
Funding
Funding is available in the EDA budget for the demolition contract.
Recommendation
Staff recommends approval of a resolution awarding a contract for hazardous material abatement, tree
removal, demolition and disposal of site improvements, sewer lining, utility improvements, well sealing, and
site grading at 4201 Boone Avenue North to Kevitt Excavating, LLC in the amount of $77,300.

BE IT RESOLVED by the Economic Development Authority in and for the City of New
Hope as follows:
WHEREAS, the Economic Development Authority in and for the City of New Hope
(“EDA”) purchased that certain real property located at 4201 Boone Avenue North, New Hope,
MN (the “Property”) with the intentions of demolishing and redeveloping the Property; and
WHEREAS, City staff intends to redevelop the Property in accordance with the City’s
scattered site housing program and policy and return the Property to the tax rolls for the benefit of
all taxing jurisdictions; and
WHEREAS, City staff is exercising due diligence to demolish the Property by performing
hazardous material abatement at the Property to be followed by tree removal, the demolition and
disposal of all buildings and improvements on the Property, sewer lining, utility improvements,
well sealing, and site grading at the Property; and
WHEREAS, Kevitt Excavating, LLC submitted a proposal for hazardous material
abatement, tree removal, demolition and disposal of site improvements, sewer lining, utility
improvements, well sealing, and site grading at the Property (“Work”) that meets all of the Project
Specifications and is the low bid with the price of $61,500 to complete hazardous material
abatement, demolition and disposal, tree removal, well sealing and site grading plus $15,800 for
utility improvements for a total of $77,300; and
WHEREAS, it is in the best interests of the EDA to enter into a contract with Kevitt
Excavating, LLC for the purpose of performing the Work; and
WHEREAS, City staff is hereby seeking approval from the EDA of the selection of Kevitt
Excavating, LLC as the duly qualified contractor to perform the Work.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority in
and for the City of New Hope as follows:
1. That the above recitals are incorporated herein by reference.
2. That selection of Kevitt Excavating, LLC as the Contractor to perform the
hazardous material abatement, tree removal, demolition and disposal of all building
and site improvements, sewer lining, utility improvements, well sealing and site
grading at the Property pursuant to the Project Specifications is approved, it being
in the best interest of the EDA and City to prepare the Property for redevelopment
in accordance with the City’s scattered site housing program and policy.
3. That the payment of $77,300 to Kevitt Excavating, LLC to perform the Work is
hereby approved.
4. The President, Acting Executive Director, and New Hope City staff are authorized
and directed to sign all appropriate documents, and to take whatever additional
actions are necessary or desirable, to complete the Work at the Property in
accordance with the contract to be prepared by the City Attorney.

Specifications For Demolition & Related Work
1. General
a. Contractor shall furnish all labor, materials, and equipment, and shall perform
all service and work required to remove the buildings, structures, and
improvements from the site, and post demolition grading of the site, in strict
accordance with these specifications and in accordance with all applicable
ordinances and laws pertaining to removal of buildings, structures, grading, and
erosion control. Following demolition, the contractor shall install silt
fencing or erosion control logs around the entire perimeter of the
disturbed area.
b. Contractor shall thoroughly review these specifications and examine the site to
evaluate existing and proposed conditions prior to submitting a quote. Failure to
do so shall in no way relieve contractor from performing the work as required or
be grounds for a claim for extra payment.
2. Demolition & Disposal of Buildings & Site Improvements
a. All buildings and site improvements shall be removed and properly disposed.
Demolition to include, but not limited to stairs, ramps, floor slabs, equipment
bases, driveways, aprons, foundation walls and footings, and other structure
components, appurtenances, and contents associated with each structure,
unless otherwise noted. Include removal of all out-buildings and contents within
buildings (including furniture and appliances), items throughout the yard,
landscaping rocks and boulders, retaining wall blocks, sidewalks, pavement, and
miscellaneous items depicted in the attached photos. Right of entry agreement
(attached) shall allow contractor access to remove entirety of sidewalk extending
to the north parking lot, however contractor may not use parking lot to the
north to access the area or store equipment. Sidewalks adjacent to 42nd
Avenue North and Boone Avenue North shall remain in place. Retaining walls at
southeast part of lot shall not be disturbed.
b. Selected demolition contractor shall meet with city staff on-site prior to
beginning work to review scope of work.
c. All demolition materials, substrates, debris, waste, or other materials shall be
collected, stored, handled, managed, and disposed in accordance with currently
accepted practices at an approved, licensed, or permitted facility in accordance
with applicable federal, state, and local ordinances, rules, and regulations.

3. Tree & Vegetation Removal
a. All trees to be removed have been marked with spray paint. All stumps shall be
pulled from the ground and hauled away. Stump pits shall be backfilled.
Contractor is to include tree and stump removal in the demolition bid. All
trees, shrubs, and brush along the northeast property line shall be removed.
Right of entry agreement shall allow contractor access to remove such
vegetation extending onto the property to the north, however contractor may
not use parking lot to the north to access the area or store equipment.
4. Backfill, Compaction & Grading
a. No demolition material shall be left in or placed in any excavation. All
excavations, unless otherwise noted, shall be back filled with clean, imported
sand. Imported material shall be placed in one-foot lifts and compacted to no
less than 95% standard proctor density. Contractor shall provide the city with a
third-party sampling, analysis, and report to demonstrate that at least 95%
compaction has been achieved.
b. The finished grade shall meet specifications detailed in the attached
Figure 1: “Proposed Site Grading and Drainage.” This includes the addition of
a small berm along the south property line. The city of New Hope Public Works
Department has clay available at no cost, if needed, for backfilling purposes.
Material would be delivered to site by Public Works staff in coordination with
contractor’s schedule. Decomposing soil below trees that are removed shall be
spread across the top of the site and not used as fill material. Roots from
removed trees within soil shall be removed.
c. Upon completion of the finished grade, contractor shall immediately hydro-
seed all disturbed areas of the site.

5. Utilities
a. Contractor shall be responsible for contacting Gopher State One Call to locate
any underground utilities prior to beginning demolition and site grading work.
b. The city has ordered the disconnection of electricity (Xcel Energy) and natural
gas (CenterPoint Energy) services for the property. Contractor shall verify
disconnections in field prior to demolition. Other private communication utilities
such as telephone and cable may still be connected; if so, contractor shall roll
them back and secure them at the pole prior to demolition.
c. Alternate: An alternate quote for the lining of an existing sewer line and water
service valve replacement and the installation of new sewer and water services
for a future second lot is also being requested. Work shall be completed in
accordance with the specifications below (i-iii) and attached Figure 2:
“Proposed Utility Services.”
i. Water service has been shut off at the curb stop box off Boone Avenue
North. Contractor is to remove the water line all the way to the curb stop.
Contractor is to install new curb stop and box as part of the water
disconnection. Contractor shall install lid shown on “Water Valve Top
Sections” attachment. The location of the service termination shall be
documented and marked on-site. An inspection by the city is required prior
to backfilling.
ii. Contractor is to coordinate the termination of the private sewer line with
Public Works. The sewer line shall be removed to within three (3) feet of
the property line and the remaining service stub shall be lined with
CIPP lining all the way to the main. Once lined, cap the end in preparation
for connection to the new house. The location of the service termination
shall be documented and marked onsite. An inspection by the city is required
prior to backfilling.
iii. Contractor to coordinate installation of new sewer and water services for a
future second lot. Figure 2 illustrates location of future sanitary sewer and
water services as well as existing sewer and water connections.
d. If selected contractor is not awarded alternate, water line shall be removed all
the way to the curb stop and sewer line shall be removed to within three (3) feet
of the property line and capped during demolition process.
6. Asbestos & Other Hazardous Materials
a. Contractor shall submit “Notification of Intent to Perform a Demolition” form to
the MPCA. The city has contracted with Angstrom Analytical for the completion
of a demolition survey for the property. The survey is attached to this report.
Demolition contractor is to provide for the removal, and appropriate
disposal of all asbestos and other hazardous items listed in the report.
7. Well Abandonment
a. Staff believes there is an unsealed well located in the utility room to the west of
the southerly entrance to the house. Contractor shall hire a state-licensed
contractor to properly seal the well and record the sealing with the Minnesota
Department of Health. Contractor shall provide records of the well sealing to the
city upon completion. If the well cannot be located, contractor shall be
responsible for obtaining a well sealing variance through Minnesota Department
of Health (including $275 cost for application).
8. Permits & Inspections
a. Contractor shall submit building permit application prior to beginning
demolition work. Demolition permit fees will be waived, however the state
surcharge will still be collected, as the city cannot waive that portion. Permit fees
for sewer, water, and utility work will not be waived. Contractor shall have the
work inspected prior to backfilling the primary excavation. The private water and
sewer service terminations must also be inspected by the city’s Public Works
staff. A separate water and sewer disconnection permit shall be obtained from
the city. Before payment may be issued to the selected contractor, all
inspections must be completed, permits must be finalized, and the
compaction analysis and well sealing documents (or well sealing variance)
must be provided to the city.
b. If any permits from other governmental agencies are required, contractor shall
be responsible for securing such permits, paying any fees at their own expense,
and completing any required inspections. Copies of any such permits shall be
provided to the city.
c. Contractor shall submit “Notification of Intent to Perform a Demolition” form to
the MPCA.

9. Miscellaneous Provisions & Notices
a. Contractor shall erect and maintain all necessary barricades and warnings to
adequately safeguard workers, adjacent property, and public. All site access and
demolition activities shall be coordinated from Boone Avenue North with control
measures in place to minimize impacts to traffic along the street. Contractor
may not use parking lot to the north or 42nd Avenue North to access site.
b. The demolition and clearing of the site shall be carried out in such a manner to
preclude damage to adjacent property or public right-of-way. Contractor shall be
solely responsible for any such damage. This includes the replacement of any
damaged sidewalks adjacent to the property.
c. Contractor is to provide dust control during demolition process by
spraying water so as to suppress airborne dust. Water tank(s) can be filled at
no cost at the New Hope Public Works building at 5500 International Parkway.
Please notify Public Works staff one week in advance of the request.
d. Submission of a proposal will constitute an incontrovertible representation by
contractor that contractor has complied with every requirement of these
specifications and attachments thereto; that without exception the proposal is
premised upon performing and furnishing the work including but not limited to
the specific means, methods, techniques, sequences, procedures, or
precautions expressly required by these specifications and attachments thereto;
that contractor has received from city satisfactory written resolution of any
conflicts, errors, ambiguities, and discrepancies; and that these specifications
and attachments thereto are generally sufficient to indicate and convey
understanding of the terms and conditions for performing and furnishing the
work.
