AN ORDINANCE AMENDING SECTION 8.09
TO LICENSE AND R~GULATE POOL TABLES
The City 'Council of the City of New Hope ordains:
Section 1. Sections 8.09 "Pinball Machines", 8.091 "License
Required", 8.092 "Fee", 8.093 "Form and Display" and 8.094
"Gambling Prohibited" of the New Hope City Code shall be amended
to read as follows:
8.09 PINBALL MACHINES AND POOL TABLES
8.091 License Required. No person shall maintain, keep
or sell within the City, a pinball machine or pool
table without a license therefor obtained in
accordance with Section 8.02. This section shall
not apply to pinball machines or tables held or
kept in storage or for sale, and which are not
actually in use or displayed for use.
8.092 Fee. The annual license fee for each pinball
machine or pool table shall be as prescribed in
Chapter 14.
8.093 Form and Display. Each license shall accurately
describe the machine or table; show the name of
the owner, address where such machine or table is
located, the license fee and the period for which
a license is granted; and such license shall at
all times be conspicuously displayed where such
machine or table is operated.
8.094 Gambling Prohibited. No person shall permit the
operation of such a machine or table for the
making of side bets or gambling in any form. No
prize, award, merchandise, gift, money or anything
of value shall be given to any player of such
machine or table.
Section 2. Effective Date. This Ordinance shall be
effective upon its passage and publication.

AN ORDINANCE AMENDING CHAPTER 14
RELATING TO CITY LICENSE FEES BY
ESTABLISHING A PARTIAL REFUND POLICY
FOR WITHDRAWN LICENSE APPLICATIONS
The City Council of the City of New Hope ordains:
Section 1. Section 14.01 "Purpose" of the New Hope City
Code is hereby amended by the addition of subsection 14.011
"License and Permit Fee Refund Policy" to read as follows:
14.011 License and Permit Fee Refund Policy. In the event
that an applicant for any permit or license for which a
fee is charged under this Chapter withdraws his
application, the City shall retain not less than 50% of
the fee for reimbursement of the City's administrative
expenses for processing the application. The amount of
the fee retained in excess of 50% of the fee shall be
based on the actual cost incurred by the City as
determined by the City Manager.
Section 2. Effective Date. This Ordinance shall be
effective upon its passage and publication.

Business District" is hereby amended by the repeal of subsection
(3) of section 4.32 in its entirety.
Section 2. Section 4.21A "Extent of R-5 Senior Citizen
Residential Housing District" is hereby amended by the additions
of subsection (3) to read as follows:

Section 3. Effective Date. This Ordinance shall be

AN ORDINANCE AMENDING SECTION 4.125
"CONDITIONAL ACCESSORY USE, B-3"
BY ADDING A SECTION TO ALLOW
FOR A TAKE-OUT SERVICE WINDOW
ACCESSIBLE BY AUTOMOBILE
The City Council of the City of New Hope ordains:
Section 1. Section 4.125 "Conditional Accessory Use, B-3"
of the New Hope City Code is hereby amended by the addition of
subsection (6) "Take-Out Service Window" to read as follows:
(6) Take-Out Service Window. For restaurants as defined in
Section 4.022 (120) of this Code provided that the
following requirements are satisfied in addition to all
general requirements for conditional use permits as
follows:
(a) On-Site Order Boards Prohibited. Outdoor on-site
food order boards may not be utilized by restaurants
and are prohibited. Food orders delivered at the
take-out service window must be placed in person,
or by telephone.
(b) Automobile Stacking. Not less than ninety feet of
segregated automobile stacking must be provided for
the service window.
(c) Traffic Control. The stacking lane and its access
must be designed to control traffic in a manner
to protect the buildings, green area, and other
automobiles on the site.
(d) Use of Street. No part of the public street or
boulevard may be used for stacking of automobiles.
(e) Noise. The stacking and window placement shall
be designed and located in such a manner as to
minimize automobile and communication noises,
emissions and headlight glare as to adjacent
premises, particularly residential premises, and
to maximize maneuverability of vehicles on the
site.
(f) Hours. Hours of operation may be limited as
necessary to minimize the effect of nuisance
factors such as traffic, noise and glare.

(g) Sale of Alcohol Prohibited. No on-sale or off-
sale sale of alcoholic bevera~es,,may be made
through the take-out service window.
Section 2. Effective Date. This Ordinance shall be
effective upon its passage and publication.

Workers Compensation coverage, all insurance coverages
required by this subsection shall be in a minimum

The City Council of the City of New Hope ordains:
Section 1. Section 2.111 "Mayor and Councilmembers Salaries"
of the New Hope City Code is hereby amended to read as follows:

AN ORDINANCE AMENDING THE NEW HOPE
ZONING CODE BY ESTABLISHING A CONVENIENCE
FOOD TAKE-OUT/DELIVERY ESTABLISHMENT
AND ALLOWING SAID ESTABLISHMENT AS A
CONDITIONAL USE IN A B-1 ZONE
The City Council of the City of New Hope ordains:
Section 1. Section 4.022 "Definitions" of the New Hope City
Code is hereby amended by renumbering subsection (30) "Cooperative
Housing" to subsection (31), by renumbering subsection (31)
"Courts" to subsection (32) and by renumbering subsection (32)
"Day Care Facility" to subsection (33).
Section 2. Section 4.022 "Definitions" of the New Hope City
Code is hereby amended by adding a new subsection (30)
"Convenience Food Take-Out/Delivery Establishment" to read as
follows:
(30) Convenience Food Take Out/Delivery Establishment.
An establishment where the exclusive operation is
limited to the preparation and sale of food in
disposable containers for consumption off the
premises. All food sales shall be over the
counter sales to customers who pick up and take
out food orders or to food sales which are
delivered directly to the customer at a place
designated by the customer. Over the counter
pick-up and take-out food sales shall not include
sales from a drive-through service window.
Section 3. Section 4.104 "Conditional Uses, B-i" of the New
Hope City Code is hereby amended by adding subsection (4)
"Convenience Food Take-Out/Delivery Establishment" to read as
follows:
(4) Convenience Food Take-Out/Delivery Establishment.
A convenience food take-out/delivery establishment
provided that:
(a) Compatability with Surrounding Property. The
architectural appearance and functional plan
of the building and/or site shall not be so
dissimilar to existing buildings or area as to
cause impairment in property values or
constitue a blighting influence.

(b) Operation Limited. The establishment must be
exclusively used as a take-out and delivery
facility for over the counter food sales as
defined in section 4.022(30) of this Code.
On-premises consumption of food in any form
or manner shall be prohibited.
(c) Street Access. The establishment must
have access to a collector or arterial street.
(d) Parking Requirement. The establishment must
have sufficient parking spaces to comply with
the requirements of section 4.036(10)(p) of
this Code, but not less than six spaces. The
parking facilities must also comply with all
other off-street parking requirements
required by section 4.036 of this Code.
(e) Sanitation Requirement. All food preparation,
packaging, sale and delivery shall be subject
to regulation and approval by the City
Sanitarian. The Sanitarian shall provide
specific written sanitary requirements for
such establishments pursuant to applicable
state and county regulations.
(f) Hours of Operation. Hours of operation may
be limited as necessary to minimize the
effect of nuisance factors such as traffic,
noise and glare.
Section 4. Section 4.036(10)(p) "Retail Store and Service
Establishment" of the New Hope City Code shall hereby be amended
by changing its title to read as follows:
(p) Retail Store, Service or Convenience Food
Take-Out/Delivery Establishment.
Section 5. Effective Date. This Ordinance shall be
effective upon its passage and publication.

AN ORDINANCE REPEALING ORDINANCE 86-12
AND ADJUSTING THE SALARIES
OF THE NEW HOPE CITY COUNCIL
The City Council of the City of New Hope ordains:
Section 1. Ordinance 86-12 "An Ordinance Adjusting the
Salaries of the New Hope City Council" adopted on September 22,
1986 is hereby repealed.
Section 2. Section 2.111 "Mayor and Councilmembers Salaries"
of the New Hope City Code is hereby amended to read as follows:
2.111 Mayor and Councilmembers Salaries. The ~alary of
the Mayor is hereby established at $~6~4 $266.38
per two week pay period and the salary of each
Councilmember at $~86=~9 $188.50 per two week pay
period.
Section 3. Effective Date. This Ordinance shall become
effective on January 5, 1987 after its passage and publication.
