1982 ORD ORDINANCE NO. 82-1 AN ORDINANCE REPEALING THE AMOUNTS OF FEES AND CHARGES WHICH ARE REQUIRED BY CFRTAIN ORDINANCES TO BE PAID TO THE CITY AND ESTABLISHING SECTION 9.300 THROUGH 9. 309 CONSOLIDATING ALL FEES AND CHARGES INTO A SINGLE ORDINANCE City of New Hope, Minnesota The City Council of the City of New Hope ordains: Section 1. Repealer. The dollar amounts of the fees and charges hereto- fore set forth in the New Hope City- Code are hereby repealed; provided, however, that the right to collect any fee or charge due payable prior to the effective date of this ordinance is not hereby repealed, and the following new City Fees and Charges are substituted therefore. Section 2. Section 9.300 "City Fees And Charges" of the City Code is hereby established for the purpose of consolidating into a single ordinance the various fees and charges required by the City for licenses, permits and services provided by the City, and shall read as follows: Section 9. 300 CITY FEES AND CHARGES Section 3. Section 9.301 "Building Construction, l~.~odification and Maintenance Permit Fees" is hereby established to read as follows: 9.301 Building Construction, Modification and l~,~aintenance Permit Fees - The fees required by Chapter 3 of the l~.~ew Hope City Code pertaining to building and building related construction and maintenance permits and inspections are hereby established as follows: Subd. 1. Building Permits and Plan Checks (a) Code section: 3.04 and 3.21 (b) Fee amount: as set forth in the Uniform P. uilding Code, Table 3-A. (c) Double fee: Any construction work begun prior to the ac- quisition of the building permit will result in a doubling of the fee. Subd. 2. .p.l. umbing Permits . (or fraction thereof) 1.00 (v) Alterations or repairs to stokers or powdered fuel bur. ners or equipment where the cost does not exceed $500.00 7.00 (vi) For each additional $500.00 (or fraction thereof) 3.00 (c) Double fee: Any mechanical work begun prior to the acquisition of a mechanical permit will cause the fee to double. Subd. 5. Building Moving License, Permits and Inspections (a) Code section: 3.08 and 3.141 (b) Fee Amount: The state regulates the licensing, bonding ~ and insurance of movers. The cost of permits and inspection for moving buildings through or in the City is as follows: 1) On same lot with cost not exceeding $100 5.00 2) On same lot and work exceeds $100 each additional $100 or fraction thereof (plus initial $5.00 fee) 2.00 3) P.{inor buildings from one location to another or through the city 15.00 4) Buildings, other than minor from one location to another or through the City 65.00 5) Inspection of building prior to relocation in City (per building) 50.00 6) Relocation of building within City - Fee based on construction valuation. Sewer Building Permits (a) Code section: 3.11 Co) Fee amount: the following fees are hereby established: 1) Residential building 7.50 2) Commercial and industrial 11.50 3) Repair or alteration for each $500 or fraction in cost 1.00 4) Minimum 5.00 Subd. 9. Housing l~{aintenance Inspection (a) Code section: 3.2511 (b) Fee amount: the following fees are hereby established: 1)- Single Family 25.00 2) Multiple residences (i) 1st unit 25.00 (ii) Each additional unit 4.00 Subd. 14-~~ Fire Suppression Permits (a) Code section: 3. 550 (b) Fee amount: the following fees are hereby established: 1) Sprinkler Installation (i) First 10 heads 7.50 (ii) Charge for each additional 10 or fraction 1.50 2) Standpipe installation (i) Basic fee 15.00 (ii) Add $1.50 per floor served by standpipe . over 5 floors 1.50 3) Alterations (i) For each $500 of value of work or fraction thereof 5.00 Subd. 15. State Surcharges - The State of },qinnesota imposes a surcharge on the following permits: building, plumbing, heating, ventilating, air conditioning, refrigeration, building moving, sewer, water connection, well drilling and fire suppression. The surcharge amount imposed on each permit is set forth in the Minnesota State Building Code. Said surcharge will be collected in addition to the fees heretofore established by this section. Section 4. Section 9.302 "Zoning, Subdivision, and Platting Fees" is hereby established to read as follows: Section 9.302 Zoning, Subdivision and Platting Fees - The fees required by Chapters 4 and 13 of the New Hope City Code pertaining to zoning, subdiVisions, and platting of property within the City are hereby established as follows: Subd. 1. Service and Use, Sanitary Sewer (a) Code section: 5.52 (b) Fee amount: the following fees are hereby established. 1) Minimum quarterly charge for 1st 1000 gallons $ 3.00 2) Plus l~eter Flow Charge rate per 1000 gallons over first 1000 1.02 3) Unmetered flow charge determined by City l~anager Subd. 2. Sanitary Sewer Strength Charge (a) Code section: 5.70 (b) Fee amount: Fixed by Metropolitan Waste Control Commission for industrial users receiving waste treatment services. Subd. 3. Sewer Connection Charges (a) Code section: 5.83, 5.90, 5. 113 (b) Fee amount: the following fees are hereby established: 1) Charge A 100.00 2) Charge B based on Improvement 7 assessment - based on election of payment by the applicant pursuant to Section 5.95 of this Code. 3) Charge C - based on election of payment by applicant pursuarit to Section 5.113 of this Code. Subd. 4. Sewer Service Availabili .ty and Connection (a) Code section: 5. 135 (b) Fee amount: $425 per unit of sewage volume - a unit of sewage volume is 100,000 gallons per year. Subd. 5. I. Vehicle Impounds (a) Code section: 6.10(3) (b) Fee amount: fees for towing and storage are as stated in annual contract. Subd. 2. Street Lighting (a) Code section: 6..23 (b) Fee amount: Cost as billed to City plus 10%. Subd. 3. Public I{asement and I~ight of Way Vacation (a) Code section: 6.42 (3) (b) Fee amount: $125.00 plus $10.00 for each lot or parcel abutting the property interest proposed to be vacated. Subd. 4. Street Excavation Permit (a) Code section: 6.64 (b) Fee amount: $15.00 after approval by City Engineer. Subd. 5. Section 9.305 "Pet Licenses and Animal Boarding and Impound Fees" is hereby established to read as follows: Section 9.305 Pet Licenses and Animal Boarding and Impound Fees - The fees required by Chapter 7 of the New Hope City Code pertaining to the keeping and boarding of domestic and wild animals within the City are hereby established as follows: - 11- Subd. 1. Dog Licenses (a) Code section: 7.02 (3) Co) Fee amount: the following fees are hereby established: 1) M~t~ or spayed female - $3.60 per calendar year, prorated at $.30 per month for each full or partial month (l~inimum $2.00) 2) Unsp~y-ed f~ - $5.40 per calendar year, prorated at $.45 per month for each full or partial month (~,~inimum $2.00) 3) Free licenses for "seeing eye" dogs 4) Duplicate license - $1.00 Subd. 2. Food Handling License. (a) Code section: 8.23(3), 8.23(4) CO) Fee amount: The following annual fees are hereby established: 1) Fuel Pumps for Non-Public Dispensation - $10.00 each pump or dispensing device plus $1.00 for each device or pump in excess of one at each separate location annually. 2)Wholesale or Gasoline Storage Plant - $25.00. Subd. 4. Taxicab Certificate of Public Convenience and l~Tecessity (a) Code section: 8.40 (b) Fee amount: $20.00 per vehicle annually Subd. 5. If the ballot envelope is marked with the word "Accepted", the election judges shall record the fact that the voter has voted by absentee ballot on the voter registration card or alternate form. This shall be done by placing 'the letters "A.B." in the appropriate space. After a registration card or alternate form has been marked to record that an individual has voted by absentee ballot, the individual shall not be allowed to vote in person at that election. Subd. 3. Placement in Container. The ballot envelopes marked "Accepted" shall be placed by the election judges in a separate absentee ballot container. The container and each ballot envelope may be opened only after the last regular mail delivery by the United States postal service on election day. Subd. 4. Opening and Counting Ballots. After the last regular mail delivery the board shall count the absentee ballots by opening them. The ballots shall be initialled by the election judges in the same manner as ballots delivered by them to voters in person and shall be deposited in the appropriate ballot box. No duplicate ballot cards shall be prepared. The votes shall be tabulated in such a manner that indicates each vote of the absentee voter and the total absentee vote cast for each candidate or question in each precinct. The vote totals provided by the absentee ballot counting board shall be added to and included in the vote totals on the summary statements of the returns for the precinct in which the absentee voters reside. -2- Subd. 5. Spoiled Ballots. If more than one ballot of any kind is enclosed in the ballot envelope, none of the ballots of that kind shall be counted but all ballots of that kind shall be returned in the manner provided by Minnesota Statutes Section 204C.25 for return of spoiled ballots. Section 4. Section 2.16 "Appointment of Members" of the City Code is hereby amended to read as follows: 2.16 APPOINTMENT OF ELECTION JUDGES . The New Hope City Council shall appoint the number of election judges they deem necessary to carry out the duties of the Absentee Ballot Counting Board. However the board shall consist of a minimum of three election judges and all appointments made by the Council shall be pursuant to Minnesota Statute Sections 204B. 19 through 204B.22. Section 5. The New Hope Chemical Health Awareness Commission shall be composed of from 5 to 15 members to be appointed by a majority of the Council, and shall be composed of citizens of the City of New Hope. Each appointee shall serve a two-year term, except for seven members of the first appointees who shall be appointed for terms expiring on December 31, 1983. The other eight shall be appointed for terms ex- piring on December 31, 1984, in order to provide for staggered terms. Each member shall serve until his successor is duly appointed. 2.804 Organization and Meetings. A. Adoption of Rules. The Commission shall adopt its own rules governing its meetings, procedures and functions except that Robert's Rules of Order shall govern questions of parliamentary procedures. The rules may be amended from time to time, upon notice being given to all members of the proposed amendments, to be acted upon at a specified meeting. A majority vote of the Commission shall be required to approve any proposed amendments. B. Meetings. (1) Regular Meetings. The Commission shall meet at such times as it shall designate at the City Hall, unless otherwise agreed upon by a majority vote of the Commission. (2) Open Meetings. Ail meetings of the Commission shall be open to the public. (3) Minutes of Meetings Minutes shall be kept of each meeting and a copy of the minutes shall be filed promptly after each meeting with the City Clerk as the official record of the activities of the Commission. 2.805 Vacancies and Removal From Office. A. Vacancies. A membership on the Commission shall become vacant upon the occurrence of any of the following: (1) the death of a member; (2) physical or mental disability rendering him incapable of service; (3) a change to residence outside of the City of New Hope; (4) resignation in writing directed to the Commission chairperson or the City Council; (5) failure to serve as evidenced by failure to attend three consecutive meetings without good cause being given to the chairperson prior thereto; (6) violation of the By-laws of the Commission providing for declaration of a vacancy. B. Removal From Office. The Commission by a 2/3 vote of its members may petition the Council to remove by a majority vote any member when, it its judgment, the best interests - 2- of the City would be served thereby, after first giving the person so named an opportunity to be heard before the Commission and Council. A majority vote of the Council shall be required to order such removal. 2.806 Compensation. The Commission members shall serve without compensation. 2.807 Powers and Duties. The Commission shall have the following powers and duties: A. To Confer with and advise the Council concerning all matters pertaining to chemical health awareness, as described in Section 2. 802. B.
