The City Council of the City of New Hope ordains:
Section 1. Section 4.27 (13)of the City Code, "E.x. ten. t of R'3: Medium' Density
'Residential DiStrict" is hereby amended by deleting therefrom
Outlot 1, leaving said section to read as follows:
"(13) Outlots 2, 3, 4, Holberg Heights"
Section 2: Section 4.27 of the' City Code ,Extent of R=3: Medium Density
Residential District" is further amended by the' addition thereto
of the following sub-section (18):
(18) Lots 1, 2, and 3, Block 1, New Hope Highlands
2nd Addition.
Section 3: Section 4.26 of the City Code "EXtent of R'2 Single and 'Two

The City Council of the City of NeW Hope Ordains:
Section 1. Section 4.041(1) of the City Code ~'"ReSidential~'DiStricts'', is hereby
'amended to read:
(1) Residential Districts.
(a) R-l, Single Family Residential District
(b) R-2, Single and Two Family Residential District
(c) R-3, MediUm Density Residential District
(d) R-4, High DenSity Residential District
(e) R-5, Senior Citizen Residential District
(O ' R-0~ Residential - Office District
Section 2. Section 4.08A is hereby added to the City Code to read as follows:
4.08A "R-5" SENIOR CITIZEN RESIDENTIAL HOUSING.
4.08A1 Purpose. The purpose of the"R-5" Senior Citizen Residential
Housing District is to provide for areas within the City whiCh are
particularly suitable as to location and amenities for elderly housing,
and to limit the development of such districts to this type of residential
construction, and directly related COmpl'ementary uses.
4.08A2 'Permitted USes.' Elderly (Senior Citizen) Housing which is
a conditional use under 4.084 in an R-4 District is the' only permitted
use in an R- 5 District, provided however that all of the conditions
of Section 4.084(4) except sub Paragraph '(m) shall apply.
Section 3. Section 4.035 of the City Code ~ :'"Area and Building Size' Regulations",
is amended to read as follows:

ORDINANCE NO. 80 - 02
AN ORDINANCE AMENDING CHAPTER 7.00
CONTROL OF DOGS AND OTHER ANIMALS
City of New Hope, Minnesota
The Council of the City of New Hope ordains:
Section 1. Section 7.05, Subd.(5) - Reclaiming. Animals and Fees
shall be amended to read as follows:
"The owner of any animals so impounded may reclaim such
animal upon payment of the license fee, if such license
is required but unpaid, the impounding fee and the board-
ing charges. .Fees~.in connection with the boarding, im-
poundinq, euthanasia and similar services shall be as set
forth bu ~itq contract with the animal pound or by Council
resolution."
Section 2. Section 7.08 - Rabies Vaccination shall be amended
to read as follows:
"No license shall be granted for a dog which has not been
vaccinated for rabies with a modified'live virus type of
vaccine within 18 months prior to June 1, of the license
year for which application is made, or with a killed virus
vaccine within 3 months prior to June 1, of the license
year in which application is made,.unless such license is
issued for a doq i~pounded under the animal pound contract
requiring proof of, or vaccination by, the poundmaster prior
to release. A certificate of vaccination or other statement
to the same effect, executed by a doctor qualified to prac-
tice veterinary medicine in the state in which the dog is
vaccinated, shall be prima facie proof of the required vaci-
nation."
Section 3. This ordinance shall be effective from and after
its passage and publication.

to represent an entire word or group of words denoting the
name or purpose of any business. For purposes of this ordinance,
a trademark may qualify as a symbol, but only if any brand name
or other word used therein is a single letter, character, or an
abbreviation.
Section 2. This ordinance shall be affeetive upon its passage and

AN ORDINANCE REQUIRING THE INSTALLATION OF
REMOTE WATER METER READING REGISTERS UNDER
CERTAIN CIRCUMSTANCES
City of New Hope, Minnesota
The City Council of the City of New Hope, Minnesota ordains:
Section 1. Section 5. 168 Subd (3) (a) of the City Code is hereby amended to
read as follows:
Subd. (3) Remote Meter Reading Registers.
(a) It is the policy of the City to require remote water meter
reading registers on all premises not regularly and readily
available and open in such a manner as to permit reading
of the inside water meter by authorized City personnel.
It is the further policy of the City to require such installation
for residential units at the time property changes ownership
either by deed or contract for deed, unless the water meter
is located in such a place as to be accessible for reading at
all reasonable times. The City shall not be obligated to
furnish water to any residence which does not provide
a remote water meter reading register. If the parties
to a sale and purchase do not provide for responsibility
for such installation, it shall be the responsibility of the
new owner to provide for the required installation.
Section 2. Paragraph B of Section 3.2311, "Minimum Plumbing Standards",
is amended to read as follows:
(b) Every fixture, facility, or piece of equipment requiring
a water connection shall have such a connecton, functioning
and free from defects, leaks, or obstructions with
sufficient capacity to adequately supply it and all other
fixtures, facilities, or pieces of equipment which it supplies
with an uncontaminated, controllable flow of water. At any
time the legal or equitable ownership of a residential
unit changes, a remote water reading register shall
be provided as required by Section 5. 168 Subd. (3) (a).
Section 3. This ordinance shall be in full force and effect from and after
its passage and publication.

Section 1. Section 2.21 of the Code, entitled Mayor
and Councilmen Salaries is amended in its
entirety to read as follows:

The salary of the Mayor is hereby established
at $165.00 per two week pay period and the
salary of each Councilperson is hereby esta-
blished at $125.00 per two week pay period.

'AN ORDINANCE AMENDING THE ZONING CODE OF
THE CITY OF NEW HOPE BY AMENDING THE FLOOD
PLAIN REQUIREMENTS, SECTION 4.17 THROUGH 4. 179C
City of New Hope
The City Council of the City of New Hope ordains:
Section 1. Section 4.022 of the Zoning Ordinance entitled "DEFINITIONS" is
amended by adding new subdivisions (3) "DEVELOPMENT", 55A "FLOOD-PROOFING",
101A "REACH", and by amending subdivision (104) to read as shown below:
(31) DEVELOPMENT. Any man-made change to improved or unimproved
real estate including, but not limited to, buildings and other structures,
mining, dredging, filling, grading, paving, excavation, drilling operations,
or storage of materials or equipment.
(55) FLOOD PROOFING. A combination of structural provisions, changes,
or adjustments to properties and structures subject to flooding, primarily,
for the reduction or elimination of flood damages.
(101A) REACH. A hydraulic engineering term to describe a longitudinal
segment of a stream, river or creek influenced by a man-made obstruction.
In New Hope, the segment of. a stream between two consecutive culverts.
under streets or highways would most typically constitute a reach.
(104) REGIONAL FLOOD. A flood which is representative of large floods
known to have occurred generally in Minnesota and reasonably characteristic
of what can be expected to occur on an average frequency in the magnitude
of the 100 year recurrence interval. Regional flood is synonymous with the
term "base flood" used in the Flood Insurance Study for the City of New Hope
prepared by the Federal Insurance Administration and dated July, 1980.
Section 2. Section 4. 171, PURPOSE" (of the FP District) is amended to read:
4. 171 PURPOSE. The Legislature of the State of Minnesota has, in Minnesota Statute
Chapters 104 and 462, delegated the responsibility to local governmental
units for adoption of regulations designed to minimize flood losses. The
purpose of the FP District is to provide for the protection and preservation
of water channels and those portions of the adjoining flood plains which are
reasonably required to carry and discharge a regional flood and are subject
to inundation by regional floods. It is the intent of the City that this district
be applied to those areas which if left unrestricted, loss of life and property,
health and safety hazards, disruption of commerce, utilities and governmental
services, extraordinary public expenditures for flood plain protection and
relief and result in impairment of the tax base could result, all of which adversely
affect the public health, safety and general welfare. This district is and shall
be applied in compliance with requirements of Minnesota Statutes, Chapters
104 and 462 as amended. In addition, Minnesota Regulations N. R. 85, as
amended, shall be consulted in administering this district. It is intended
that the regulations applying to the FP District be interpreted in such a manner
as to result in compliance by the City of New Hope with the Standards of section
60.3 (d) under Section 1361 of the National Flood Insurance Act of 1968, as amended.
Section 3. Section 4. 175, and sub-section (1) through (3), "METHODS USED
TO ANALYZE FLOOD HAZARD" are deleted in their entirety, and replaced by the
following Section 4. 175:
4.175 DELINEATION OF FLOOD PLAIN DISTRICT. The Flood Insurance Study
for the City of New Hope prepared by the Federal Insurance Administration and
dated July, 1980, and Flood Insurance Rate Maps contained therein are hereby
adopted by reference and declared to be a part of this ordinance. The Flood
Plain District for the City of New Hope shall include those areas which lie
within the 100 year Flood Boundary on the Flood Insurance Map.
Section 4. Section 4. 176, "RULE FOR INTERPRETATION OF DISTRICT
BOUNDARIES" is amended to read:
4. 176 RULE FOR INTERPRETATION OF DISTRICT BOUNDARIES. The
boundaries of the Flood Plain District shall be determined by scaling distances
on the Official Zoning Map. Where interpretation is needed to define more
exactly the location of the boundaries of the district as shown on the Official
Zoning Map, as for example where there appears to be a conflict between
a mapped boundary and actual field conditions, the City Engineer shall make
the necessary interpretation based on elevations on the regional (100 year)
flood profile contained in the Flood Insurance Study and other available
technical data. Any person contesting the location of the FP District boundary
shall be given a hearing to present his case to the City Council and to submit
his own technical evidence if he so desires, no more than 30 days following
an adverse ruling to the City Engineer.
Section 5. Section 4.177(3) Use Permit; Determination, is hereby amended
to read:
4. 177(3) DETERMINATION. Within ten (10) days after the application for use
permit, the City Engineer shall determine Whether the change ~ modification,
or alteration conforms to the requirements of all applicable City, State and
Federal regulations and ordinances, and that applicable state and federal
permits have been acquired. This time limit for determination of acceptability
shall be autOmatically extended should a referral to another governmental
jurisdiction be required. The applicant shall be advised in writing of the
City Engineer's determination and findings and if acceptable, a use permit shall
be granted.
Section 6. Section 4. 179 "'PERMITTED USES" is amended to read:
4. 179 PERMITTED USES. Uses having a iow flood damage potential and not
obstructing flood flows shall be permitted within the FP District to the
extent that they are not prohibited by any other ordinance and are allowed
within the Residential, Business, or Industrial District which jointly applies,
and provided they do not require fill, storage of materials or equipment,
or structure (except as structures are permitted in paragraph (5) hereafter)
In addition, no use shall adversely affect the capacity of the channels,
of floodway of any tributary to the main stream, drainage ditch or any
other drainage facility or system. Permitted uses are limited to the following:
(1) Agricultural uses such as general farming, pasture, grazing, outdoor
plant nurseries, forestry, horticulture, truck farming, sod farming,
and wild crop harvesting.
(2) Residential uses such as lawns, gardens, parking and play areas.
(3) Industrial and commercial: Loading areas and parking areas.
(4) Private and public recreational uses such as golf courses, tennis courts,
driving ranges, archery ranges, picnic grounds, boat launching ramps,
swimming areas, parks, wildlife and nature preserves, game farms, fish
hatcheries, shooting preserves, target ranges, trap and skeet ranges,
hunting and fishing areas, and single or multiple purpose recreational
trails.
(5) Public Utilities and facilities such as gas and electrical transmission
lines which have been'flood-proofed in accordance with the State
Building Code or elevated above the Regulatory Flood Protection Elevation;
also water and sanitary sewer mains, public storm sewer mains and
appurtenant structures, public streets, curbs, gutters, sidewalks,
and parking areas.
Section 7. Section 4. 179B "CONDITIONAL USE" and 4. 179B (1) and 4. 179B (1) (a)
are amended to read as follows:
4.179B CONDITIONAL USES. The following open space uses require accessory
structures (temporary or permanent), or fill or storage of materials or
equipment. These uses may be permitted in the Floodway District only after
the issuance of a Conditional Use Permit as provided in Section 4.20 of this
Ordinance.
(a) Uses shall be limited by the standards established by section (b)
below and as restricted by this ordinance as to the respective zoning
districts.
(1) Uses or structures accessory to open space or conditional uses.
(2) Signs.
(3) Extraction of sand, gravel, and other materials.
(4) Marinas, boat rentals, docks, piers, and water control structures.
(5) Railroads, streets, bridges, utility transmission lines, and pipe lines.
(6) Storage yards for equipment, machinery, or material.
(7) Kennels and stables.
(8) Drive-in theaters, car, machinery, or similar sales, roadside stands.
(9) Radio transmitter towers, and appurtenant cables, grounds and lines.
(b) Standards for Conditional Uses.
(1) No structure (temporary or permanent), fill (including fill for
roads and levees), deposit, obstruction, storage of materials
or equipment, or other uses may be allowed as a conditional use
which, acting alone or in COmbination with existing or anticipated
future uses, affect the capacity of the floodway, or increase flood
heights. Ail conditional use applications shall be acCOmpanied by a
flood impact statement drafted by a registered engineer. The City
Engineer shall be responsible for a review and recommendation on the
application and shall be responsible for submitting the proposal and
application to the Department of Natural Resources and any other
governmental unit having flood control jurisdiction over the area
for review and written comment. In determining the acceptability
of a proposed conditional use, the City Engineer and the City
Council shall consider all relevant factors specified in other
sections of the ordinance, and:
(i) The danger to life and property due to incresed flood heights
or velocities caused by encroachments.
(ii) The danger that materials may be swept onto other lands or
downstream to the injury of others.
(iii) The proposed water supply and sanitation systems and the
ability of these systems to prevent disease, contamination
and unsanitary conditions.
(iv) The susceptibility of the proposed facility and its contents
to flood damage and the effect of such damage on the individual
owner.
(v) The importance of the services provided by the proposed
facility to the community.
(vi) The requirements of the facility for a waterfront location.
(vii) The availability of alternative locations not subject to flooding
for the proposed use.
(viii) The compatibility of the proposed use with existing development
and development anticipated in the foreseeable future.
(ix) The relationship of the proposed use to the cOmprehensive plan
and flood plain management program for the area.
(x) The safety of access to the property in times of flood for ordinary
and emergency vehicles.
(xi) The expected heights, velocity, duration, rate of rise, and
sediment transport of the flood waters expected at the site.
(xii) Such other factors which are relevant to the purposes of this
ordinance.
Section 8. Section 4. 179B (2) "FLOOD'FRINGE" is hereby deleted in its
entirety.
Section 9. Section 4. 179B (b) 7, entitled "'FLOOD ~PROOFING ~REQUIREMENTS"
is added to the code to read as follows:
7. FLOOD PROOFING REQUIREMENTS: When flood proofing is
permitted or required under this ordinance, such structure or
use shall be flood-proofed in accordance with the requirements
of the State Building Code.
Section I0. Section 4.179C is added as follows:
4. 179C AMENDMENTS TO' SECTIONS 4.17 THROUGH~ 4. 179C
Pursuant to M. S. 104.04 subd. -'~4, amendments to sections 4.17 through
4. 179C shall be submitted to the Commissioner of Natural Resources of
the State of Minnesota for review and approval prior to adoption.

AN ORDINANCE RELATING TO CERTAIN
AMENDMENTS TO THE BUILDING CODE
City of New Hope, Minnesota
The City Council of the City of New Hope ordains:
Section 1. Section 3.21 "Building Code" of the City Code is amended to
read:
3.21 Building Code. The Minnesota State Building Code, effective September 1,
1980, which adopts the 1979 Uniform Building Code is hereby adopted by
reference as the Building Code of the City of New Hope, as authorized
by Minnesota Statutes 471.62, and incorporated in the City Code as if
set out in full herein. One copy of the 1980 Minnesota Uniform Building
Code and one copy of the 1979 Uniform Building Code is marked as the
Official Copy and filed for use and examination by the public in the office
of the City Clerk-Treasurer.
Section 2. Section 3.24 "Fire Zones", Subd. (1) through (4) are hereby
deleted in their entirety.
Section 3. Section 3.04 "Building Permit Fees" is hereby amended as to
Subd. (1) thereof to read as follows:
3.04 Building Permit Fees.
Subd. (1) "Fee Schedule".
The fee for a building permit shall be as set forth in Table 3-A of the
1979 Uniform Building Code, as incorporated in the 1980 Minnesota State
Building Code, according to the construction valuation.
Section 4. Section 3.14 "Swimming Pool Construction Permit" is hereby
amended to read as follows:
3.14 Swimming Pool Construction Permit. The applicant for a permit under
the Private Swimming Pool Ordinance, Section 3. 160 shall pay to the City
at the time of application, a fee as required in Table 3-A of the 1979 Uniform
Building Code.

AN ORDINANCE AMENDING CHAPTER 5 OF THE CITY CODE PERTAINING TO
SEWER AND WATER RATES, PENALTIES AND METER REPAIR
City of New Hope, Minnesota
The City Council of the City of New Hope ordains:
Section 1. Section 5.52, Subd. (1) of the City Code Minimum Charges is hereby amended to read as follows:
Subd.(1) Minimum Charges
The minimum quarterly sewerage charge, whether use of
water is metered or not, shall be Three Dollars ($3.00)
plus Eighty Five Cents($.85) for each 1,000 gallons
over and above the initial 1,000 gallons for the quarter.
Section 2. Section 5.52, Subd. (2) of the City Code Sewer Rates Based on
Metered Water is hereby amended to read as follows:
Subd. (2) Sewer Rates Based on Metered Water
For all premises where the sewer rate is based upon the
metered use of water, the rates shall include the mini-
mum charge provided in Subd.(1) of $3.00 per quarter,
plus Eighty Five Cents ($.85) for each 1,000 gallons of
water consumption over and above the initial 1,000 gal-
lons of sewerage included in the minimum charge in
Subd. (1). Pot single family residences only, sewer
charges shall be computed on the basis of actual gallons
of water metered during the winter billing quarters;
winter quarters are the quarters billed from January to
the following May; sewer charges for the summer quarters,
quarters billed from June to the following November,
shall be determined by averaging the gallonage of water
metered during the winter billings; provided, however,
that the gallons charged for the summer billings shall
not exceed an amount equal to the actual metered water,
if actual usage is less than the amount determined by
the averaging method.
The quarterly periods shall be as uniform as feasible
throughout the City.
Section 3. Section 5.62 of the City Code Collections is hereby amended to
read as follows:
5.62 Collections
All bills shall be due and payble when rendered. If pay-
ment is not made on or before the last city working day
of each month next succeeding the mailing of the bill,
a penalty of 5% or $.50 whichever is greater, shall be
added to the bill. Sewer bills shall be considered to
be in default on the first day of the month next succeed-
ing the date the above penalty attaches.
When a charge is more than 45 days past due civil action
may be begun on behalf of the city for the collection of
said sewage service charge, and if such charge is not
paid within 60 days after due the said unpaid charge plus
penalty may be certified to the County Auditor with the
taxes against such property and shall be collected with
other taxes on such property.
Section 4. Section 5.168, Subd. (6) of the City Code Testing Meters is hereby ~mended to read as follows:
Subd.(6) Testing Meters
A water or sewer meter connected to the municipal system
shall be considered accurate if it records within 3% of
actual flow. If upon testing by the city, the meter is
found to be inaccurate, it shall be replaced without
charge to the consumer, unless the meter has been damaged
by the consumer. If damaged by the consumer, the consu-
mer shall pay the cost of a new meter. No refund or ad-
ditional charge shall be made for billings based on an
inaccurate meter.
Section 5. Section 5.169 of the City Code Water Rates is hereby amended to
read as follows:
5.169 Water Rates
Water bills shall be concurrent with sewer billings. The
rate for water furnished to consumers by the municipal
water system shall be as follows: The minimum quarterly
charge will be $3.00 for each meter plus Sixty One Cents
($.61) for each 1,000 gallons of consumption over and
above the initial 1,000 gallons recorded on said meter
~for the quarter.
Section 6. Section 5.173 of the City Code Payment is hereby amended to read
as follows:
5.173 Payment
All bills shall be due and payable when rendered. If
payment is not made on or before the last city working
day of each month next succeeding the mailing of the bill,
a penalty of 5% or $.50, whichever is greater, shall be
added to the bill. Water bills shall be considered to be
in default on the first day of the month next succeeding
the date the above penalty attaches.
Section 7. This ordinance shall be effective January 1, 1981.

OF THE CITY CODE PERTAINING TO
CONTROL OF DOGS
City of New Hope, Minnesota
The City Council of the City of New Hope ordains:
Section 1. Section 7.08 Rabies 'Vaccination of the City Code is hereby
amended to read as follows:
7.08 'Rabies Vaccination
Subd. (1) Vaccination Required
Except as provided in Subd. 4, no license shall be issued
for a dog which has not been vacccinated for rabies. A Certificate
of Vaccination or other written statement to the same effect executed
by a doctor qualified to practice veterinary medicine in the state
in which the dog is vaccinated shall be prima faeie proof of the required
vaccination.
Subd. (2)'EffeCtiVe 'Period 'of VacCine
To be accepted, a Certificate must show on its face that the vac-
cination will be effective for the balance of the license year. The
Certificate of the Veterinarian stating the effective period of the
vaccination is sufficient. Absent such a statement, all vaccinations
and boosters are deemed to be effective one year from the date
administered except that if identified by the Veterinarian on the
Certificate modified live virus vaccines as follows shah be deemed to
be effective for 36 months:

The City Council of the City of New Hope ordains:
Section 1. Section 4. 179B (b) 7, entitled "Flood ProOfing' Requirements" is
amended to read as follows:
7. FLOOD PROOFING REQUIREMENTS: When flood proofing is permitted
or required under this ordinance, such structure or use shall be flood-
proofed in accordance with the requirements of the State Building Code.
The City Engineer shall maintain a record of the elevation of the first
floor (including basement) of all new structures or additions to existing
structures in the Flood Plain District. He/she shall also maintain
a record of the elevations to which structures or additions to structures
which are flood-proofed.
SeCtion 2. This ordinance shall be in full force and effect frOm and after
its passage and publication.

The City Council of the City of New Hope ordains:
Section 1. Section 11.27"'Issuance of' Temporar. y Permit", paragraphs 1 through
3 are amended to read as follows:
11.27' Issuance of Temporary Permit
The following shall govern the issuance and use of temporary 'on-street
parking permits by the Police Department:
(1) Refusal of the permit would create an unnecessary and
undue hardship.
(2) Granting of the permit would not present an unreasonable
threat to the public health, safety, and general welfare.
(3) The circumstances resulting in the request for a temporary
permit shall be of a temporary nature, such as driveway repair, social
occasions, numerous guests, and similar situations where the advantage
of the City having vehicles off the street in the early morning hours
is outweighed by the practical problems created by such prohibition
of on-street parking.
· 'section 2. This ordinance shall be in full force and effect from and after
