AN ORDINANCE AMENDING THE NEW HOPE
ZONING CODE BY AMENDING PERFORMANCE STANDARDS
REGULATING ALTERATIONS, OPEN SPACE AND UNIT TYPE
FOR MULTIPLE FAMILY DWELLINGS
The City Council of the City of New Hope ordains:
Section 1. Section 4.031 (11) "Alterations" of the New Hope
City Code is hereby amended to read as follows:
(11) Alterations. Alterations may be made to a building
containing lawful non-conforming residential units when
they will improve the livability thereof, provided they
will not increase the number of dwelling units , or the
number of bedrooms in any dwelling unit, or size or
volume of the building.
Section 2. Section 4.035 (3) "Useable Open Space" of the New
Hope City Code is hereby amended to read as follows:
(3) Useable Open Space.
a. Single and Two Family Dwellings. No dwelling may
occupy in excess of twenty percent of the lot area
on single or two-family dwelling sites. Each

ii. 4 or more Bedrooms - 600 square feet per unit
c. Recreation Areas. Each multiple family buildin~ or
complex of two or more buildings containing eight
(8) or more dwelling units shall include visually
defined or fenced active recreation areas, Said
areas need not be contiguous. The size of the
recreation area shall be determined by multiplying
the number of dwetlin9 units times 50 square feet
exclusive of parking or loading areas. This
section shall not apply to R-5 senior citizen or
physically handicapped multiple family dwellings,
Section 3. Section 4.035 (7) "Efficiency Apartments" of the
New Hope City Code is hereby amended to read as follows:
(7) Maximum Unit Type.
a. Efficiency Apartments. Except for elderly (senior
citizen or R-5) housing, the number of efficiency
apartments in a multiple dwelling shall not exceed
five percent of the total number of apartments. In
the case of elderly (senior citizen or R-5)
housing, efficiency apartments shall not exceed
twenty percent of the total number of apartments.
b. Three (3) or More Bedroom Apartments. The number
of dwelling units containing three (3) or more
bedrooms in a multiple dwelling containing eight
(8) or more units shall not exceed forty (40)
percent of the total number of apartments within a
single building.
Section 4. Section 1.56 "Suspension of Residential Apartment
Conversions Increasing Bedrooms Per Unit" of the New Hope City Code
is hereby repealed in its entirety.
Section 5. Effective Date, This Ordinance shall be effective
upon its passage and publication.

LICENSE REQUIREMENTS
The City Council of the City of New Hope ordains:
Section 1. Section 7,041 (2)"Cat Shelter License" of the New
Hope City Code is hereby amended to read as follows:
(2) Cat Shelter License. No person shall maintain or operate
any cat shelter without a cat shelter license. In no
event shall cat shelter licenses be issued un]ess the
property wherein the cat shelter is to be situated is
zoned "B-4" Community ~ Business District under
Chapter 4.

OF THE NEW HOPE CITY CODE
REGULATING GARBAGE AND RECYCLING COLLECTION
BY AMENDING THE RECYCLING REQUIREMENTS FOR
MULTIFAMILY DWELLINGS CONTAINING MORE
THAN EIGHT DWELLING UNITS
The City Council of the City of New Hope ordains:
Section 1. Section 9.121 (3)"Mandatory Recycling/Multifamily
Dwellings" of the New Hope City Code is hereby amended to read as
follows-
(3) Mandatory Recycling/Multifamily Dwellings. Owners of
Multifamily Residential Buildings containin9 more than
eight dwelling units shall either contract directly with
a recycling hauler licensed under the provisions of
Chapter 8 of this Code to provide recycling collection
services to all residents of the dwellin9 or privately
provide recycling collection services to all residents of
the dwelling. If the owner provides the latter option,
a written description of the specific recycling
collection plan must be submitted to the City as
verification of the existence of said services to the

Section 2. Section 9.124 "Penalty" of the New Hope City Code
is hereby amended to read as follows-

9.11 through 9.124 is hereby declared to be a petty
misdemeanor. A third violation of these sections within
a 10 year period shall be punishable as a misdemeanor.
Section 3. Section 1.208B "Recyclable Materials" of the New
Hope City Code is hereby amended to read as follows:
1.208B "Recyclable materials" means materials that are separated
from mixed municipal solid waste for the purpose of
recycling, including paper, glass, metals, plastics,
automobile oil, and batteries. Refuse derived fuel or
other material that is destroyed by incineration is not
a recyclable material.
Section 4. Effective Date. This Ordinance shall be effective
upon its passage and publication.

BY REDUCING THE GREEN AREA REQUIREMENT
IN THE I-1 ZONING DISTRICT
The City Council of the City of New Hope ordains:
Section 1. Section 4.145 (3) "Green Area" of the New Hope
Zoning Code is hereby amended to read as follows:
(3) Green Area. At least twenty ~ct ~c~ th~n th~rt¥-fivc
percent of the lot, parcel or tract of land shall remain
as a grass plot, including shrubbery, plantings or
fencing, and shall be landscaped. Required minimum green
area should be emphasized in the front and side yards
abutting streets or residential property. The word
"landscaped" means a controlled surface and grade and
plantings to allow a smooth surface flow and being under
continual maintenance for the preservation of scenic
harmony.
Section 2. Effective Date. This Ordinance shall be effective

Code is hereby amended to read as follows:

all other joint tenants, tenants in common or contract
vendees in title to the property may not exceed

Section 1. Section 14.082 (1)(b)"Fee Amount" of the New Hope
Code is hereby amended to read as follows:
(b) $5.00 additional for each gasoline, diesel, liquified
petroleum gas or other fuel pump in excess of one at each
station. If a pump has more than one distributional-
service outlet, each such outlet is considered an
additional pump.

AN ORDINANCE AMENDING SECTION
14.507 (2) OF THE NEW HOPE CITY CODE
DEALING WITH SAC CHARGES ESTABLISHED
BY THE METROPOLITAN WASTE CONTROL COMMISSION
The City Council of the City of New Hope ordains:
Section 1. Section 14.507 (2) "Amount of Charges" of the New
Hope Code is hereby amended to read as follows:
(2) Amount of Charges. The charge for each building or
structure shall be equal to the number of units of sewage
volume which it will discharge, multiplied by~,vv.~v'~^ ~^ the
rate established by the Metropolitan Waste Control
Commission. A unit of sewage volume shall be 100,000
gallons per year and shall be assigned as follows:
Section 2. Effective Date. This Ordinance shall be effective
upon its passage and publication,

REGULATING RECYCLING SERVICE FEES
The City Council of the City of New Hope ordains:
Section 1. Section 14.139 "Recycling Service Fees" of the New
Hope Code is hereby amended to read as follows:
14.139 Recycling Service Fees. The fee charged to each owner or
occupant for recycling collection services shall be as
follows:
(1) Basic Fee $1..,25 ~ per month
(2) Carryout Collection Fee Fee set by HennePin

Section.2. Effective Date. This Ordinance shall be effective
