AN ORDINANCE AMENDING THE NEW HOPE
ZONING CODE REGULATING THE REQUIRED PARKING SPACES
FOR OFFICE BUILDINGS AND WAREHOUSES
The City Council of the City of New Hope ordains:
Section 1. Section 4.036 (lO)(m) "Office Buildings, Animal
Hospitals and Professional Offices" of the New Hope City Code' is
hereby amended to read as followS:
(m) Office Buildings., Animal Hospitals and Professional
Offices. Three spaces plus at least one space for each
two hundred fifty square feet of floor area.
Section 2. Section 4.036 (10)(cc) "Warehousing, Storage or
Handling of Bulk Goods" of the New Hope City Code is hereby amended
to read as follows:

landscaping in compliance with §4.033(3) of this
Code shall be provided.
Section 4. Section 4.104 (4) "Convenience Food Take-
Out/Delivery Establishment" of the New Hope Code is hereby amended
by deleting subsection (b) ""Operation Limited" in its entirety and
renumbering subsections (c) "Street Access" to (b), (d) "Parking
Requirements" to (c), (e) "Sanitation Requirement" to (d), and (f)
"Hours of Operation" to (e).
Section 5. Section 4.104 "Conditional Uses, B-I" of the New
Hope Code is hereby amended by adding subsection (5) "Restaurant"
to read as follows:

The City Council of the City of New Hope ordains:
Section 1. Section 3.465 (5) "Awning or Canopy Signs" of the
New Hope Code is hereby amended to read as follows:

Section 2. Section 3.466 "Signs Accessory to Automobile
Service Stations" of the New Hope Code is hereby amended to read as
follows:
3.466 Signs Accessory to Gas Sales in Conjunction with
Automobile Service Stations or Convenience Stores. The
following signs accessory to automobile service stations
and convenience stores with gas sales are permitted in
addition to the signs permitted under Subsection 3.465.
(1) Oil Racks. Racks for the orderly display of cans of
engine oil for convenience in dispensing said oil may be
located on or at the ends of pump islands (limit of two
to each island).
(2) Tire Racks. Two open portable tire racks (not more than
seven feet in height including signs, and six feet in
length) on casters for the purpose of displaying new tire

(3) Portable Signs, Placards, Pennants. Portable signs,
placardS, pennants, streamers, flags (except the U.S.
flag), revolving placards and all other signs not
specifically permitted in this section are prohibited,
except for grand openings, as provided in Subsection
3.441.
(4) Gasoline and Price Sign. One sign (single or double
faced) per frontage on a public street, suitable for
apprising persons of the total sale price per gallon.
The area of such price sign shall not exceed sixteen
square feet on either side. Each such sign shall be
affixed to the standard of a ground sign or light
fixture, and shall state the tOtal price. No sign
posting an incomplete price or less than the total sales
price is permitted.
(5) Informational Signage. Signs denoting operation
instructions associated with self service gas facilities
including gas pump, air supply and car washes are exempt
from the maximum sign area standards of section 3.465 of
this Code.
Section 3. Effective Date. This Ordinance shall be effective
upon its passage and publication.

AN ORDINANCE AMENDING THE NEW HOPE
ZONING CODE BY PERMITTING
PUMP ISLAND CANOPIES AT GAS STATIONS AND
CONVENIENCE STORES AS AN ACCESSORY STRUCTURE
AND ALLOWING ADDITIONAL SIGNAGE ON CANOPIES
The City Council of the City of New Hope ordains:
Section 1. Section 4.032 (3)(k) "Pump Island Canopy" of the
New Hope City Code is hereby added to read as follows:
(k) Pump Island Canopy. Canopies located over pump islands
shall be allowed as accessory structures in the B-3
zoning district for automobile service stations and
convenience stores with gasoline allowed by §§4.124 (1)
and (2) of this Code.
i. Canopy setbacks shall be a minimum of fifteen (15)
feet from the property line. Adequate visibility
both on and off site must also be maintained.
ii. Canopies shall not be allowed in rear yards not
abutting a public street.
iii. Maximum canopy height may not exceed twenty (20)
feet, and shall provide a minimum clearance of
fourteen (14) feet.
iv. Canopy facades may not exceed three (3) feet in
height.
v. Reflected glare or spill light may not exceed five-
tenths (0.5) foot candles, as measured on the
property line when abutting residentially zoned
property and one (1) foot candle measured on the
property line when abutting other commercial or
industrially zoned property.
vi. Signage may be allowed on the canopy as permitted
in §3.465 of this Code.
Section 2. Section 4.124 (1)(o) "Canopy" of the New Hope City
Code is hereby added to read as follows:
(o) Canopy. Canopies located over pump islands shall be
allowed as accessory structures subject to the
specifications set out in §4.032 (3)(k) of this Code.

ORDINANCE NO. 94-05
AN ORDINANCE AMENDING CHAPTER 14 OF
THE NEW HOPE CITY CODE BY INCREASING WATER
RATES AND SANITARY SEWER USE FEES
The City Council of the City of New Hope ordains:
Section 1. Section 14.502 (1) "Metered Water Sewer Rates;
Adjustments" of the New Hope Code is hereby amended to read as
follows-
(1) Metered Water Sewer Rates; Adjustment. For all premises
where the sewer rate is based upon metered water, the
fees shall include a minimum charge of~.,v~ ~ $5.80 per
quarter plus ~1.73 $2.25 for each 1,000 gallons of water
consumption over and above the initial 1,000 gallons.
For single family residences only, sewer charges shall be
computed on the basis of actual gallons of water metered
during the winter billing quarters; winter quarters are
the quarters billed from January to the following May;
sewer charges for the summer quarters, quarters billed
from June to the following November, shall be determined
by averaging the gallonage of water metered during the
winter billings; provided, however, that the gallons
charged for the summer billings shall not exceed an
amount equal to the actual metered water, if actual usage
is less than the amount determined by the averaging
method. The quarterly periods shall be as uniform as
feasible throughout the City.
Section 2. Section 14.510 (2) "Water Rates" of the New Hope
City Code is hereby amended to read as follows:
(2) Water bills shall be concurrent with sewer billings. The
rate for water furnished to consumers by the municipal
water system shall be as follows: The minimum quarterly
charge will be ~: :: ~6 25 for each meter plus ~ ~°
$1.40 for each 1,000 gallons of consumption over and
above the initial 1,000 gallons recorded on said meter
for the quarter. $1.30 of the minimum quarterly charge
is assessed by the Minnesota Commissioner of Health and
shown on the billing statement as a miscellaneous charge.
This charge is authorized by Minn. Stat. §144.3831.
Section 3. EffeCtive Date. This Ordinance shall'be effective
upon its passage and publication.

The City Council of the City of New Hope ordains:
Section 1. Section 4.29A "Residential/Office PUD District" of
the New Hope Code is hereby added to read as follows:
4.29A Residential/Office PUD District. The following areas of
the City shall comprise the R/O PUD District. This area
is distinguishable from the R/O Zoning District in that
all properties within the R/O PUD District are subject to
a development agreement restricting use as a condition to
this zoning classification. A certified copy of all
development agreements shall be filed with the County
Recorder per Minn. Stat. §462.36.

REGULATING DOG LICENSES AND RABIES VACCINATION
The City Council of the City of New Hope ordains:
Section 1. Section 7.021 (2)"Rabies Vaccination Required" of
the New Hope Code is hereby amended to read as follows:
(2) Rabies Vaccination Required. All licensed dogs must have
a current rabies vaccination during the entire license
period. To obtain a dog license a certificate from a
duly licensed veterinarian shall be provided showin9 that
the dog proposed to be licensed has been given a
vaccination for protection against rabies, approved by
the City Clerk, in compliance with the standards for
rabies vaccinations. If the application for a dog
license is by mail, the applicant shall include a copy of
the current Vaccination Certificate with the application.
No dog license shall be issued unless the current
Vaccination Certificate shows the vaccination shall be
effective at least until dune 30 of the license year

Code is hereby amended to read as follows:
9.702 Notice to Destroy. On or before June I May 15 of each
year and at such other times as ordered by resolution of
the Council, the Clerk shall publish once in the official
newspaper as prescribed by Minnesota Statutes I",27"~ .
18.83, a notice directing owners and occupants of
property within the City to destroy all weeds declared by
this section to be a nuisance and stating that if not so
destroyed within ten days after publication of said
notice, the weeds will be destroyed by the Department of
Public Works at the expense of the owner and if not paid,
the charge for such work will be made a special
assessment against the property concerned.

AN ORDINANCE PERMITTING THE CITY COUNCIL TO TRANSFER
THE POWERS AND DUTIES OF THE CHEMICAL HEALTH AWARENESS
COMMISSION TO THE CITIZENS ADVISORY COMMISSION
The City Council of the City of New Hope ordains:
Section 1. Section 2.401 "Establishment" of the New Hope Code
is hereby amended to read as follows:
2.401 Establishment. The New Hope Chemical Health Awareness
Commission is hereby established as an advisory body to
the Council, which Commission shall have the powers and
duties set forth hereafter and as the Council may
designate from time to time. The City Council at its
discretion may by resolution transfer the powers and
duties of the Chemical Health Awareness Commission as set
out in §2.40 et.al, to the Citizens Advisory Commission.
In the event the City Council does make said transfer of
powers and duties, the rules governing the Citizens
Advisory Commission shall also govern its conduct in
transacting business as the Chemical Health Awareness
Commission notwithstanding any code section to the
contrary.
Section 2. Effective Date. This Ordinance shall be effective
upon its passage and publication,

AN ORDINANCE AMENDING SECTION 1.613
OF THE NEW HOPE CITY CODE
BY AMENDING THE GUIDELINES TO QUALIFY
FOR SPECIAL ASSESSMENT DEFERRAL PROGRAM
The City Council of the City of New Hope ordains:
Section 1. Section 1.613 "Net Income" of the New Hope City
Code is hereby amended to read as follows:
1.613 Net Income. The applicant's net income and net income of
all other joint tenants, tenants in common or contract
vendees in title to the property may not exceed
$20,400.00 $10,~v.~v"=~ ~ during the preceding year from the
assessment levy. Net income determination shall be made
under a formula as set forth on a form provided by the
City.
Section 2. Effective Date. This Ordinance shall be effective
upon its passage and .publication.

2.11i BY INCREASING THE SALARIES OF THE
MAYOR AND CITY COUNCIL
The City Council of the City of New Hope ordains:
Section 1. Section 2.111 "Mayor and Councilmembers Salaries"
of the New Hope City Code is hereby amended to read as follows:
2.111 Mayor and Councilmembers Salaries. The salary of the
Mayor is hereby established at ~ $335.38 per two
week pay period effective January 2, 1993 1995 and shall
increase to ~ $344.60 effective January 2, ~
1996. The salary of each Councilmember is hereby
established at $225.3~ $237.34 per two week pay period

AN ORDINANCE AMENDING NEW HOPE ZONING CODE
TO ALLOW OPEN OUTDOOR STORAGE AS A PERMITTED
ACCESSORY AND CONDITIONAL USE WITHIN THE
INDUSTRIAL ZONING DISTRICTS
The City Council of the City of New Hope ordains:
Section 1. Section 4.143 "Permitted Accessory Uses" of the
New Hope City Code is hereby amended by adding subsection (3)"Open
Outdoor Storage" to read as follows:
(3) Open Outdoor Storage. Open outdoor storage as a permitted
accessory use provided that:
(a) Accessory Use. The open outdoor stora§e must be an
accessory use, as defined by Section 4.022 (1) of this
Code, to a permitted or conditional principal use on the
site,
(b) Maximum Space. The open outdoor storage area may not
exceed twenty (20) percent of the gross floor area of
principal structure,
(c) Setbacks, The open outdoor storage area shall not be
located within any front yard or side yard abutting a
public right-of-way, Open outdoor storage shall be set
back five (5) feet from all side and rear lot lines and
shall not be located within a utility or drainage
easement,
(d) Surfacing. The open outdoor storage area shall be
surfaced to control dust.
(e) Fencing, A wire weave/chain link security fence shall be
required around the open outdoor storage area in
conformance with §4.033(3)(c) of this Code. Open outdoor
storage areas intended for the exclusive storage of semi-
trailers may be exempt from the required security fencing
provided the storage area is delineated and the
individual trailers are secured.
(f) Screening/Landscaping, The open outdoor storage area
shall be screened and landscaped from adjacent
residential uses and public rights-of-way in accordance
with the provisions of Section 4,033 of this Code,
(g) Required Space. The open outdoor storage area shall not
utilize any required off-street parking, loading areas,
or access space, as required by Section 4.036 (6)(a) and
4.037' (4) of this Code.
(h) Hazardous Materials. The open outdoor storage area shall
not be used for storage of hazardous liquids, solids,
gases or wastes. This provision does not prohibit the
property owner from obtaining a conditional use permit
for the outdoor storage of propane or LP gas per
§4.144(12) of this Code.
(i) Refuse and Upkeep. The property owner shall keep the
open outdoor storage areas free of refuse, trash, debris,
weeds, and waste fill.
Section 2. Section 4.144 (1) "Open Storage, Accessory" of the
New Hope City Code is hereby amended to read as follows-

of the property. Outdoor storage shall not include the
temporary parking of motor vehicles in designated parking
stalls, or trucks being serviced in designated loading
areas.
Section 4. Effective Date. This Ordinance shall be effective
upon its passage and publication.

Section 2. Sections 7.06 "Limitations on Keeping of Animals"
through 7.066 of the New Hope City Code are hereby added to read as
follows:
7.06 Limitations on Keeping of Animals. It is hereby declared to
be a public nuisance and unlawful to allow, permit, keep,
maintain, ride, herd, drive or harbor animals within the City,
in violation of the following regulations:
7.061 Dogs. Four or more dogs over six months old, to a
limit of ten dogs including puppies under six
months old, unless a kennel license is obtained.
7.062 Cats. Four or more cats over six months old, to a
limit of ten cats including kittens under six
months old, unless a kennel license is obtained.
7.063 Fowl. Chickens, ducks, geese, pheasants, turkeys
or other domestic, agricultural or wild fowl if the
minimum lot area where the animals are kept does
not exceed 54,450 square feet and then no more than
six animals are permitted.
7.064 Wild Animals. Live wild animals except household
pets not exceeding 20 pounds confined to a cage
within a dwelling. All wild animals kept per this
section shall be licensed, registered, vaccinated
and tagged in accordance with the same regulations
for dogs in §§7.021 and 7.022 of this Code.
7.065 Hoofed Animals. Any horses, cows, sheep, goats,
pigs or any other hoofed animals with the exception
of one pot-bellied pig.
7.066 Any combination of animals and/or fowl of any age
kept in such numbers or under conditions which
unreasonably annoy, injure, or endanger the health,
safety, comfort, repose or welfare of the public or
of said animals or fowl.
Section 3. Sections 7.O7 "Exempt Animals" through 7.074 of
the New Hope City Code is hereby added to read as follows:
7.07 Exempt Animals. The provisions of this code shall not apply
to the following circumstances:
7.071 Owners or possessors of wild animals where such
animals are exhibited in the City for the education
and entertainment of the public by a person
authorized by either Federal law or Minnesota
Statute §97A.041 provided the following conditions
are met:
a. The animals are not permanently sheltered,
kept or maintained in the City.
b. The animals are kept as part of a show or used
in a parade that is licensed by the City, or
the animals are kept in an animal hospital or
clinic for treatment by a licensed
veterinarian.

in a totally enclosed facility constructed to
comply with the noise regulations of this Code.
Section 4. Effective Date. This Ordinance shall be effective
upon its passage and publication.

AN ORDINANCE TEMPORARILY PROHIBITING
POOL OR BILLIARD CENTERS WITHIN
THE CITY OF NEW HOPE
The City Council of the City of New Hope ordains:
Section 1. Section 1.57 "Temporary Prohibition of Pool Halls
or Centers" of the New Hope City Code is hereby added to read as
follows:
1.57 Temporary Prohibition of Pool Halls or Centers. Pursuant
to the authority of Minn. Stati §§.462.355(4) and 412.221
(25) a total prohibition is hereby, imposed on the
location of any pool or billiard hall or center or any
other commercial recreational facility with more than two
pool or billiard tables, coin operated or otherwise,
a.pywhere within the New Hope City limits. Said
prohibition shall be effective through May 28, 1995. Any
application for issuance of building or occupancy permits
under Chapter 3 of this Code, text changes, variances,
conditional use permits and rezoning requests under
Chapter 4 of this Code and subdivision requests under
Chapter 13 of this Code for any new use, Construction,
development or subdivision of property for a pool or
billiard hall or center as herein defined shall be denied
until May 28, 1995.
Section 2. Effective Date. This Ordinance shall be effective
upon its passage and publication.

a rebate of $150 from the normal building permit fee if
they choose to follow the EPA Guidelines (1991) for radon
resistant construction. The builder must sign an intent
letter prior to pouring the basement slab and th~
Building Official must inspect and confirm that radon
resistant techniques have been followed,
