  13. ADJOURNMENT   Memorandum          To:  New Hope City Council  From: Kirk McDonald, City Manager  Date: March 10, 2022  Subject: Agenda Items for Monday, March 14, 2022   Open Forum  We are not aware of anyone who intends to address Council for the open forum.     Item 5.1  Commissioner Marge Beard of the Three Rivers Park District will provide an update to Council on the Park  District’s activities. The last update was provided on October 14, 2019.    Items 6.1, 6.2, and 6.3  Item 6.1 – there are no new business license requests.   Item 6.2 ‐ involves routine financial claims.   Item 6.3 – there are no new liability claims to report.    Item 6.4  Cities must establish precincts and polling places after the state redistricting process which occurs  every ten years. Previously, a legislative district split part of New Hope’s southern precincts. With the  new redistricting plan New Hope is entirely in legislative district 43/43A. Staff recommends changing  the boundary between precincts 1 and 2 to follow Boone Avenue. The change would help even out  voter population and provide a well‐known street as a boundary. Polling places would remain the  same as the 2020 election cycle. City Clerk Leone and I recommend approval.    Item 6.5  This item accepts a donation of $6,035.86 from the police explorers. At the recommendation of the  finance department, the police explorers closed their checking account. The funds were deposited into  the city’s General Fund. All revenue and expenses for the police explorers will be handled through the  police department budget. Abdo staff and I recommend acceptance of the donation.    Item 6.6  Affinity Plus Federal Credit Union of New Hope donated $3,750 for this year’s Safety Camp. The  generous donation will pay for registrations for all 75 campers. Similar to prior years, a full list of all  sponsors and donations will be presented to Council following the August safety camp program. Staff  wanted to call attention to the unique situation of one business sponsoring all registrations. The  generosity of Affinity Plus was published in the program description. Director Rader and I recommend  acceptance of the donation.     Page 2  Item 8.1  A bid opening was held February 24 for the construction of the 2022 infrastructure project located north  of Bass Lake Road near Liberty Park. The low bid was submitted by Northwest Asphalt, Inc. for  $1,296,606.60. Northwest Asphalt has worked in the city in the past with good results. The stormwater  filtration system proposed along 60th Avenue near Liberty Park was reviewed further with the Shingle  Creek Water Management Commission prior to the bid opening. Due to the depth and scope of the  storm sewer and the limited treatment levels, the stormwater filtration system was removed from the  bid package. The project cost is $416,337.66 less than the CIP budget due to favorable bid pricing for the  water main work and elimination of the storm water filtration system. If the project is awarded, it  would begin this spring with substantial completion by fall. There is one tax‐exempt property, Liberty  Park, that will be assessed for the mill and overlay street work. The project will be funded by street  infrastructure funds and utility funds. Director Weber and I recommend approval.    Item 8.2  The 2022 CIP includes burying the overhead power lines along 42nd Avenue North between Boone  Avenue North and Gettysburg Avenue North.  Removal of the existing power poles in the right of way  will allow the city to construct a bituminous trail along the south side of 42nd Avenue North in 2023.  Along with the trail the city will replace existing watermain, replace existing signals with new  traffic/pedestrian signals at Boone and 42nd Avenue North, place new decorative streetlights with  banner arms and work with the county on ADA and mill and overlay improvements along 42nd  Avenue. The city’s trail will connect to the new trails being constructed across TH 169 as part of  MnDOT’s new bridge and interchange improvements scheduled for 2023. Staff shared this information  with Council at the January 14 work session. The cost estimate for Xcel Energy’s work is $727,515, and  that is the amount budgeted in the CIP. This is a private utility project so there should not be indirect  costs associated with the project, and Xcel includes contingencies in their estimates. The project would  be funded by the street infrastructure fund. Director Weber and I recommend approval. CALL TO ORDER The New Hope City Council met in work session pursuant to due call and notice thereof; Mayor Hemken called the meeting to order at 6:30 p.m.    ROLL CALL Council present: Jeff Sargent, Director of Community Development  Stacy Woods, City Attorney    2022 SURVEY WITH  MORRIS  LEATHERMAN  Item 11.1    Mayor Hemken introduced for discussion item 11.1, Discuss professional community‐ wide survey in 2022 with Morris Leatherman Company.    Mr. Brandon Bell, Community Development Coordinator/Management Analyst,  explained the city has conducted a professional community‐wide survey every ten  years since 1995 with the most recent survey being conducted in 2015. He explained  the professional survey scheduled to be conducted in 2020 was delayed in 2020 and  2021 due to the COVID‐19 pandemic. He stated the 2022 budget contains funds for a  professional survey. He stated some of the questions included in the 2015 survey  regarding replacement of the City Hall and pool facility and some redevelopment  activities are no longer relevant. He recommended inclusion of a question regarding  organized garbage collection as the topic was frequently mentioned in the 2021 city  services survey.    Mr. Peter Leatherman of the Morris Leatherman Company was introduced. He  explained the phone survey includes 400 samples from New Hope residents with a  combination of land lines and cell phone numbers. He stated the cost of the survey is  tied to the number of questions and the number of households that are surveyed. He  stated over the past two years other cities have added questions regarding perceptions  of public safety, perceptions of diversity, equity, inclusion, and impact of COVID (how  residents felt the city handled communications concerning the pandemic). He also  recommended changing the question on income level to more of a financial situation  question.   City Council Work Session February 22, 2022  Page 2     Council reviewed the 2015 survey questions. Council Member Elder expressed interest  in adding questions that could help the city uncover challenges with mental health  issues.     Mr. Leatherman indicated he will provide a draft survey to city staff within two weeks,  and Council can still provide additional input.    Mr. Kirk McDonald, city manager, stated it is necessary for Council to approve the  expenditure for the survey. An agreement will be placed on a future council agenda  after the final number of survey questions are determined.    Mr. Leatherman stated after the survey results are summarized, he will meet with the  City Council at a work session and again at a council meeting to share the results.    VALUES AND  VISION STATEMENT  Item 11.2    Mayor Hemken introduced for discussion item 11.2, Reaffirm Values and Vision  Statement.    Mr. Kirk McDonald, city manager, explained as part of the state performance  measurement program, the Council must reaffirm the values and vision statement on  an annual basis. He stated the statement was last reaffirmed in February of 2021.    Council reaffirmed the Values and Vision Statement.     FAIR HOUSING  POLICY  Item 11.3    Mayor Hemken introduced for discussion item 11.3, Discuss Fair Housing Policy.    Mr. Jeff Sargent, community development director, explained in recent years several  metro cities have developed Fair Housing Policies, including Brooklyn Park, Golden  Valley, Plymouth, and St. Louis Park. One of the common goals of the policy  throughout other cities is to ensure that fair and equal housing opportunities are  available to all persons in all housing initiatives and development activities funded by  the city regardless of race, color, religion, sex, sexual orientation, marital status, status  with regard to public assistance, creed, familial status, national origin, or disability.  This is achieved through external practices that provide access to fair housing  information and referral services and through internal practices and procedures that  promote fair housing inclusion. He stated some grant opportunities require or give  preference to cities that have adopted Fair Housing Policies.    He reviewed the draft policy with Council. He noted the policy designates the Director  of Community Development as the responsible entity for the intake and referral of all  fair housing complaints. It also states that the city will publish information about fair  housing on its website. This includes links to resources such as the Department of  Housing and Urban Development and Minnesota Department of Human Rights, as  well as links to state and federal fair housing complaint forms.      Council Member London questioned whether having a housing policy in place would  present any legal issues if the city placed limitations on rental housing or group homes.  He noted the city of Waconia may limit the amount of rental housing as it requires  extra city resources.  City Council Work Session February 22, 2022  Page 3     Mr. Sargent noted the policy is a guiding document only and is not the same as a city  ordinance. He commented that currently the city cannot prohibit group homes from  residential neighborhoods but may be able to limit the number of group homes in the  future as a result of potential federal law changes.    Ms. Stacy Woods, city attorney, stated the city cannot legislate group homes out of the  city. She stated language in the housing policy directs the city to follow federal housing  laws and prevent discrimination.     Mr. Jeff Alger, community development specialist, pointed out that both Minneapolis  and St. Paul are first class cities and are permitted to restrict the number of group  homes within a quarter mile. He stated both cities have elected not to enforce the rule.  He noted if a law came into effect that would limit group homes for New Hope, the  housing policy would not impact such a law.    Mr. McDonald questioned training opportunities.     Mr. Sargent stated community development staff would be trained in official and fair  housing laws, and training opportunities are available for staff and potentially for  elected officials.     Council expressed support for the policy and directed staff to place the item on a future  agenda.    EXTERIOR  IMPROVEMENT  REBATE PROGRAM  Item 11.4    Mayor Hemken introduced for discussion item 11.4, Discuss exterior improvement  rebate program.    Mr. Jeff Alger, community development specialist, explained staff is requesting that  the City Council consider implementation of an exterior improvement rebate program  for single‐ and two‐family homes. He stated in the last three years residents have been  asked in the city services survey whether they would be interested in financial  assistance for home repair and improvement projects if offered by the city, and last  year 56% of participants responded affirmatively. He stated the goal of the program  could be to encourage homeowners to make improvements to the exterior of their  home, specifically in areas that are visible from the street. Improving the curbside  appeal of properties within the city would aid in improving the overall housing stock,  instill confidence into neighborhoods, and increase home values. Staff believes an  exterior improvement rebate program would complement the city’s existing housing  programs and would be a good use of some general fund surplus and EDA funds. The  cities of Blaine, Coon Rapids, and Fridley have implemented “Front Door Grant  Programs” in recent years to incentivize improving the curb appeal of homes. New  Hope’s pilot program could utilize some aspects of these programs with a heavy  emphasis on improving the exterior appearance of a property as opposed to interior  remodeling projects or the build‐out of unfinished living space. Staff has prepared the  framework of what an exterior improvement program might involve. The program  could be adjusted after the first year depending on demand and feedback. He  recommended allocating $100,000 from the general fund surplus to support  implementation of the program in its first year. Any unused funds from the initial year  City Council Work Session February 22, 2022  Page 4   of the program would be held over to provide funding in subsequent years. Funds in  the EDA reserves could cover the costs of an exterior improvement rebate program in  future years. He emphasized the goal of the program is to provide an incentive for the  homeowner to go above and beyond what they may have originally planned to  accomplish.     He asked Council for feedback on the framework of the program.    Council Member Hoffe asked how residents would learn about the program.    Mr. Alger indicated the city would work with the communications coordinate to  advertise the new program in various ways (city newsletter, website, flyers, social  media posts).     Mr. Alger stated if Council is supportive of a program, he would present a draft for  formal approval at a future EDA meeting. He stated decisions need to be made  regarding whether there would be eligibility restrictions based on income, home value,  or age of home.     Mayor Hemken asked whether the program would include driveway repair or  replacement.     Mr. Alger stated a repair or replacement would not be eligible; however, an upgrade  from a gravel driveway to asphalt, concrete or brick pavers would qualify. He noted  the goal of the program is for homeowners to make visible improvements; it is not  intended for general maintenance issues.    Director Sargent indicated many of the improvements made at Fridley and Coon  Rapids were for driveway improvements.     Mayor Hemken stated New Hope’s program could possibly be expanded in the future  to include driveway improvements if there is a high demand for it.    Council Member London stated although he supports beautification of the city, he does  not support an exterior improvement rebate program through the use of tax dollars.    Mr. Sargent noted a 25% rebate may be sufficient incentive to residents to undertake  improvements that might not have otherwise taken place.    Council Member Isenberg indicated the program could be instituted and phased out if  it is not successful.     Mr. Kirk McDonald, city manager, stated the guidelines must be as well defined as  possible including the types of qualifying projects.    The majority of the Council was supportive of creating an exterior improvement rebate  program with an initial funding of $100,000.        City Council Work Session February 22, 2022  Page 5   WMFRD UPDATE  Item 11.5    Mayor Hemken introduced for discussion item 11.5, Update from West Metro Fire‐ Rescue District.    Ms. Sarah Larson, fire chief of West Metro Fire‐Rescue District, updated Council on  district activities. She stated in the year 2021 there were 1,169 total calls for service for  New Hope and 890 calls for service for Crystal. She stated the higher call volume in  New Hope is due to more commercial properties (fire alarm systems) and nursing  homes (medicals).    Chief Larson indicated police and fire command staff will be meeting on a quarterly  basis beginning in 2022 to increase communications. She stated the first meeting will  be held March 1 to discuss policy and procedures, areas of improvement, and any new  events or awareness issues.    She reported on retirements and recruitments. She stated application was made for the  SAFER grant for three employees and grant awards should be known by this fall. Chief  Larson reported on the successful “Be a Santa to a Senior” program, ballistic vests  purchase, and security camera/controls planned for fire station entrances. She also  updated Council on fire vehicles. She stated the new engines are in the engineering  phase of construction and the tentative delivery date of the first truck is December of  2022 with the others to follow in 2023. She stated an existing engine has been sold to a  company in Mexico for $200,000.     Council Member London inquired regarding the process if the district is awarded the  SAFER grant since Crystal was not in agreement. Chief Larson stated she would need  to meet again with Crystal to determine if they agree to acceptance of the grant.    Council thanked the fire chief for the report.     CITY MANAGER  POSITION VACANCY  PROCESS  Item 11.6    Mayor Hemken introduced for discussion item 11.6, Discuss process regarding city  manager position vacancy.    Mayor Hemken reported City Manager Kirk McDonald will retire June 1, 2022, and it  is necessary to decide whether to proceed with an internal promotion or utilize a  recruitment firm to conduct an external recruitment process. She asked Mr. Rich  Johnson, director of HR/Administrative Services, to present information from search  firms.    Mr. Johnson shared information submitted by four recruitment firms (Baker Tilly,  DDA Human Resources, Inc., Gov HR USA, and Mercer Group Associates). He stated  the cost ranges from $17,500 to $24,500, and the timeline is four to five months. He  stated some of the firms offer a 12‐month guarantee for employee retention (no cost to  repeat a recruitment process if new employee leaves within a certain period). He stated  a firm would screen applicants and Council could view the semi‐finalists’ information  to determine which candidates to interview as finalists.     Mayor Hemken spoke of the benefits of promoting from within the organization and  the need to have an interim city manager.     City Council Work Session February 22, 2022  Page 6   Discussion ensued regarding the importance of the city manager position.    Council directed staff to invite employees who are qualified and interested in the  position to submit a letter of interest and resume to City Clerk Valerie Leone by March  1 for interviews on March 7. Council also directed staff to request presentations by  Baker Tilly and Mercer Group Associates on March 7 to help Council make a  determination on whether to conduct an external recruitment process or not. Chief Tim Hoyt introduced and provided information regarding the background  of Officer Rajaneé Michael and Officer Corey Cracknell. City Clerk Leone  administered the oath of office. Council extended their congratulations and  thanked the department and family and friends for attending the ceremony in a  show of support. Approval of financial claims through February 28, 2022.  RESOLUTION 2022‐21  Item 6.4    Resolution approving LG230 application to conduct off‐site lawful gambling by  Armstrong Cooper Youth Hockey Association at the New Hope Ice Arena.  RESOLUTION 2022‐22  Item 6.5    Resolution approving agreement between the city of New Hope and Home Free  for the 2022 Domestic Assault Intervention Project.    Ms. Elsa Swenson, program manager of Missions, Inc. was recognized. She stated  the agency served 149 New Hope residents in 2021. She explained that Home Free  provides 24‐hour emergency housing and advocacy services for victims of  domestic assault. The agency works cooperatively with the police department and  provides a variety of counseling, intervention and support services. She stated  Home Free serves 15 cities in the northwest area. Ms. Swenson stated the shelter is  typically at capacity but as a result of New Hope’s partnership, the agency will  always make room for any New Hope resident in need. She explained during the  COVID‐19 pandemic the agency reduced the number of families it could serve  from 30 to 15, which resulted in a funding surplus at the close of year 2020. She  stated the surplus allowed the agency to provide direct financial assistance to  clients.      Council expressed support for the domestic assault intervention program.    RESOLUTION 2022‐23  Item 6.6    Resolution adopting Fair Housing Policy.  RESOLUTION 2022‐24  Item 6.7  Resolution authorizing final payment to Hydro‐Klean in the amount of $2,871 for  the 2021 Sanitary Sewer Lining project (Improvement Project No. 1073).    MOTION  Item 6.8 PROJECT NO. 1071)  Item 8.1  Mayor Hemken introduced for discussion Item 8.1, Resolution approving Change  Order No. 1 for $9,656.20 with Met‐Con Construction, Inc. for the purchase and  installation of a central garage mechanics bay 50,000 lb. vehicle lift (Improvement  Project No. 1071).    Mr. Dan Boyum, city engineer, stated Council is asked to approve change order  no. 1 for $9,656.20 with Met‐Con Construction related to the installation of a  mechanics bay vehicle lift. The lift cost through the state’s cooperative purchasing  program was $108,356. In September of 2021, the city contracted with Met‐Con  Construction for installation of the lift for $111,500. Change order no. 1 includes  additional work that was required to scan the floor to locate the main electrical  conduits, labor for concrete removal and routing of flammable waste trap venting,  and plumbing costs. Scanning and additional labor were necessary because some  items were not shown on record plans from the addition completed in 2000. The  change order results in a revised contract amount of $121,156.20 and a total project  cost of $229,512.47 (including cost of vehicle lift). The capital improvement fund  has $200,000 allocated for the lift replacement. The difference of $29,512.47 will be  funded by the central garage reserve fund.    Council Member London inquired if a contingency has been included in the  budget.    Mr. Boyum stated contingency funds are typically included in construction  projects but not for equipment purchases. He noted staff will consider  incorporating a contingency fund for certain equipment purchase situations.    Mr. Kirk McDonald, city manager, stated the topic can be discussed at the March  work session as Council will be reviewing the CIP for public works and parks and  recreation.    RESOLUTION 2022‐25 Mayor Hemken introduced for discussion Item 8.2, Resolution approving Change  Order No. 4 for $11,888.30 with Rochon Corporation for Phase 1 Improvements at  the Public Works Facility (Improvement Project No. 1039).    Mr. Dan Boyum, city engineer, explained that Council awarded a construction  contract on May 24, 2021, to Rochon Corporation for the improvements at the  public works facility in the amount of $2,316,000, and three change orders have  been approved to date. Change order no. 4 for $11,888.30 includes four items:  New Hope City Council  February 28, 2022  Page 4   spreading and compacting class 5 aggregate base in the parking lot, relocation of  RTU‐2 unit (electrical and gas line relocation and adding steel reinforcement),  replacement of three‐phase with single phase exhaust fan due to wiring (three‐ phase fan will be used in future), and temporary asphalt ramps and striping in  parking lot in fall of 2021 as final lift of bituminous was delayed until 2022. Change  order no. 4 brings the revised contract amount to $2,433,735.82. There are adequate  funds in the public works facility fund to cover the change order. He reviewed the  project funds and project schedule.    Council Member London commented on the extra costs as a result of incorrect  documentation of prior work. He requested assurance that the current project is  being properly documented.    Mr. Boyum agreed with the need for good record plans and that Stantec will ensure  that proper as‐builts are submitted at the close of the project.    RESOLUTION 2022‐26  Item 8.2  Council Member Hoffe introduced the following resolution and moved its Mayor Hemken introduced for discussion Item 10.1, Resolution authorizing the  purchase of equipment and appropriation of funds in the amount of $199,059.28  for purchase of a 2022 Caterpillar 926M Wheel Loader and ancillary equipment  from Ziegler Inc.    Mr. Bernie Weber, director of public works, stated this item approves the purchase  of a 2022 Caterpillar 926M wheel loader and ancillary equipment for $270,559.28  through the Minnesota Cooperative Purchasing Program. Ziegler Inc. has been  awarded as the vendor for Caterpillar equipment on the state contract. The  Caterpillar 926M wheel loader would replace the city’s 12‐year old loader (unit  #203). He stated a trade‐in of $71,500 will reduce the purchase price to $199,059.28,  and the CIP replacement fund currently has $217,975.25 designated for this  equipment.    Mr. Kirk McDonald, city manager, stated the purchase is $18,915.97 under the CIP.    Mayor Hemken inquired of the delivery schedule.    Mr. Weber stated the equipment will be delivered this fall. candidates and recruitment firms for city manager position.    Interviews were conducted for internal candidates Director Tim Hoyt and Director Jeff  Sargent.    Presentations were provided by Ms. Sharon Klumpp and Patty Heminover of Baker  Tilly and Mr. Jim Miller of Mercer Group. Representatives described the process of  utilizing a recruitment firm for a nationwide search for city manager candidates.    After a lengthy discussion of various options, Council agreed to offer the position of  Acting City Manager to Tim Hoyt for a six‐month trial period ending December 1,  2022, which affords him the opportunity to work with City Manager Kirk McDonald  prior to McDonald’s retirement on June 1, 2022. Director Hoyt would retain his  position of police chief if he is not appointed as City Manager following the trial period.   Council also agreed upon the need to define the Council’s expectations of the candidate  to achieve by the end of the trial period and directed staff to place the topic on the next Staff requests Council to adopt a resolution to establish precincts and polling places to comply with redistricting  requirements.   Policy/Past Practice  The city adopts resolutions required by state statutes. MS 204B.14 subd. 3(d) requires that precinct boundaries be  established at least 19 weeks before the state primary election (or by March 29, 2022).   Background  State redistricting is the process of redrawing the boundaries of election districts to ensure that the people of  each district are equally represented. It is typically completed every 10 years, after the completion of the  decennial Census. In mid‐February the Minnesota Judicial Branch Special Redistricting Panel released its  redistricting plan for congressional and legislative boundaries based on the 2020 census.     Cities must establish precincts after state redistricting. In 2012 the city had to change a boundary in the  southern part of the city to accommodate legislative district 45B. With the current redistricting plan New  Hope does not have a congressional or state legislative boundary going through the city (the city will be  entirely in legislative district 43/43A). Staff recommends changing the boundary to Boone Avenue between  precincts 1 and 2, as there is currently a difference of 752 voters between the two precincts. The change moves  480 voters from precinct 2 to precinct 1, makes the voting population more equal, and provides a well‐known  street as a boundary. Precinct 6 is the smallest precinct and works well as the majority of voters are from  senior apartments and North Ridge nursing home. Due to the Covid pandemic which began in 2020, the  polling place for precinct 6 was changed from North Ridge Apartments to City Hall.      The Maptitude software utilized for redistricting shows “population over age 18”. While this is a useful guide  to help establish precinct size, it is not representative of past voting history as some neighborhoods, with high  renter populations or senior population, may have many eligible voters who have not exercised their right to assist the county in purging the voter registration system of obsolete voter information. The county will pay  for all mailing costs so it behooves the city to make all precinct/polling place changes now. Typically when Requested Action  Staff recommends that the City Council accept a donation from Affinity Plus Federal Credit Union in the  amount of $3,750 for the New Hope Safety Camp.   Policy/Past Practice  It is past practice for the City Council to formally accept donations.  Background  The city departments of Parks and Recreation and Police, as well as West Metro Fire‐Rescue District together  plan and sponsor the annual Safety Camp program, which has been in existence since 1992. The 2022 Safety  Camp will be held August 16‐18 at Civic Center Park. Prior to the camp, staff reaches out to various  organizations and businesses to inquire if they would like to donate or sponsor and typically a few  organizations graciously donate to the program.     In 2022, Affinity Plus Federal Credit Union of New Hope generously donated $3,750 for the Safety Camp  program and specifically stated that these funds were to be used so all 75 campers could register for free. The  Safety Camp registration opened on March 1 for New Hope residents and then any remaining registrations  will be available for non‐residents starting May 1. City staff and campers greatly appreciate their generous  donation and support.    A thank you letter has been sent and their business name is posted in the Spring/Summer Recreation  brochure as one of the sponsors of Safety Camp. Resolution awarding contract to Northwest Asphalt, Inc. for construction of the 2022 Infrastructure  Improvement Project (Improvement Project No. 1074)  Requested Action  Staff recommends that the Council pass a resolution awarding contract to Northwest Asphalt, Inc. for  construction of the 2022 Infrastructure Improvement Project (Improvement Project No. 1074).  Policy/Past Practice  The City Council routinely considers public infrastructure improvement projects to extend the useful life of  the infrastructure and/or improve the level of service. The city’s pavement management has identified areas  for street infrastructure projects in 2022.  Background  The project consists of street and utility improvements north of Bass Lake Road in the Liberty west  neighborhood as shown on the attached figure drawing.  Streets included in the project were recommended  based upon pavement conditions identified in the 2021 Pavement Management Plan as well as underlying  utility conditions.     The base bid includes plans for water main, sanitary sewer, storm sewer, mill and overlay, and reclaim and  overlay improvements. A large share of the utility work is associated with water main improvements along  Bass Lake Road and Independence Avenue. The city has experienced several water main breaks in those two  areas. Based on feedback from residents during the walk and talk meeting and at the public hearing,  additional storm sewer structures and piping were added to the project at the south end of Independence  Avenue to help with drainage issues.      The stormwater filtration system proposed along 60th Avenue near Liberty Park was reviewed further with  the Shingle Creek Watershed Management Commission prior to the bid opening. Due to the depth and slope  of the storm sewer and the limited treatment levels, the stormwater filtration system was removed from the  bid package.    The feasibility report was presented and approved on September 27, 2021, and identified specific street and  utility improvement strategies. A walk and talk meeting with residents on Independence Avenue was held  on October 20, 2021. A public hearing was then held on October 25, 2021, to further discuss the scope of the  project and proposed assessments. The feasibility report identified all tax‐exempt properties that will be  affected by this work and provides an estimated assessment rate for these properties. These assessments will  be one funding source for the project.    Agenda Section Development &  Planning Item Number  8.1  The city received five bids at the February 24 bid opening, and the complete bid tab is attached. The low bid  contractor was Northwest Asphalt, Inc. with a total base bid amount of $1,296,606.60. Bid specifics and a  comparison to the engineer’s opinion of probable cost can be viewed in the funding table below. Northwest  Asphalt, Inc. has previously worked in the city on various improvement projects. If awarded, the contractor  could start this spring, and most project work will be completed in 2022.   Funding  This project will be funded primarily by the city of New Hope street infrastructure and utility funds (water,  sanitary sewer, stormwater). Funding breakdowns are in the table below.     Item Due to the depth and slope of the storm sewer and the limited treatment levels, the storm water filtration system was removed from the bid package. Staff will look for another opportunity for storm water filtration systems in this area on future projects where more area can be treated and there are not storm sewer depth and slope restrictions. The City Council routinely considers public infrastructure improvement projects to extend the useful life of  the infrastructure and/or improve the level of service.   Background  The city’s Capital Improvement Plan for 2022 includes burying the overhead power lines along 42nd Avenue  North (CSAH 9) from Boone Avenue North to west of Gettysburg Avenue North. Burying of those lines and  removal of the existing power poles from the right of way of 42nd Avenue North will allow the city to place a  new bituminous trail along the south side of 42nd Avenue North in 2023. The city’s trail will connect to the  new trails being constructed across TH 169 as part of MnDOT’s new bridge and interchange improvements  scheduled for 2023. City staff reviewed this work with the City Council at the January 14, 2022, Council Work  Session.    Along with the new trail construction, the city will replace existing watermain, replace existing signals with  new traffic/pedestrian signals at Boone and 42nd Avenue North, place new decorative streetlights with  banner arms like those placed in 2019, and work with Hennepin County on ADA and mill and overlay  improvements along 42nd Avenue North in 2023.    City staff met with Xcel Energy to identify the scope of the project. Xcel Energy is finishing their design at this  time, and they will bury the new power line along the north side of 42nd Avenue North as well as some other  areas as shown on the attached Location Map. They need to place a new cabinet in the general location of the  northwest corner of Boone Avenue North and 42nd Avenue North as shown on the attached rendering.    Xcel Energy indicated that property owners along 42nd Avenue North will continue to have overhead  power serving their homes. A pole will be placed outside of the 42nd Avenue North right of way for those  purposes. If those property owners want to bury their power lines at this same time, they will need to work  with their own electrician and coordinate work with Xcel Energy.    Agenda Section Development &  Planning Item Number  8.2  Funding  Cost estimates for the requested work done by Xcel Energy is $727,515. This project will be funded by the city  of New Hope’s street infrastructure fund.  The Xcel Energy pricing was given to the city in 2021, so budgeted
