AN ORDINANCE AMENDING PLANNING COMMISSION
MEMBERSHIP AND APPOINTMENT OF
CITY COUNCILMEMBER AS A PLANNING COMMISSIONER
The City Council of the City of New Hope ordains:
Section 1. Section 2.132 (1) "Number" of the New Hope Code is
hereby amended to read as follows:

Number. The Planning Commission shall may consist of gQ
to ten members appointed by the Counci 1. Every appointed
member shall, before entering upon the discharge of his
duties, take an oath that he will faithfully discharge
the duties of his office.

§§462.355(4) and 412.221 (25) a total prohibition is
hereby imposed on the location of any pawn shop or pawn
broker businesses anywhere within the New Hope City
limits. Said prohibition shall be effective through
Sept ember 11, 1996. Any app 1 i cat i on for issuance of
building or occupancy permits under Chapter 3 of this
Code, text changes, variances, conditional use permits
and rezoning requests under Chapter 4 of this Code and
subdivision requests under Chapter 13 of this Code for
any new use, construction. development or subdivision of
property for a pawn shop or pawn broker business as
herein defined shall be denied until September 11. 1996.

and environmental review. All Special Zoning request
applications will require the applicant to accept this
120 days timeline for City Council action. If, upon
recei vi ng t he report sand recommendat ions of the P1 anni ng
Commission and City Manager, the City Council desires
further consideration, or finds that inconsistencies
exist in the review process, data submitted, or
recommended action, the City Council may, before taking
final action, refer the matter back to the Planning
Commission with a statement detailing the reasons for
referral. This procedure shall be followed only one time
on an application, except for a good cause. The Council
may refer an application back to the Planning Commission
if it determines that changes in the application after
Planning Commission recommendation require such action,
or such referral may be waived by the Council.
Section 9. Section 4.202 (1)(m) "Council Action" of the New
Hope City Code is hereby amended to read as follows:

AN ORDINANCE AMENDING NEW HOPE
CITY CODE BY AUTHORIZING THE USE OF INVESTIGATIONS
PRIOR TO EMPLOYMENT BY THE CITY
The City Council of the City of New Hope ordains:
Section 1. Section 1.70 "Employment Background
Investigations" of the New Hope Code is hereby added to read as
follows:

Criminal History Background Check. At the direction of
the City Manager, the police department is authorized to
conduct c r i mi na 1 history background i nvest i gat ions on
applicants for positions with the city, as provided bY
this section. This section applies only to applicants
who are finalists for paid or volunteer positions with
the city, where the city manager has determined that
conviction of a crime may relate directly to the position
sought. The police department may not perform a
background investigation unless the applicant consents in
writing to the investigation and to the release of the
investigation information to the city manager and other
city staff as may be appropriate. An applicant's failure
to provide consent may disqualify the applicant for the
position sought. If the city manager rejects the
applicant's application due, solelY or in part. to the
applicant's prior conviction of a crime, subject to the
exception set forth in Minnesota Statutes, section
364.09, the city manager must notify the applicant in
writing of the following:

AN ORDINANCE AMENDING CHAPTERS
1,8 AND 14 OF THE NEW HOPE CITY CODE
CONCERNING LAWN FERTILIZER APPLICATION CONTROL
The City Council of the City of New Hope ordains:
Section 1. Section 8.00 "Business and Amusement Regulations"
of the New Hope Code is hereby amended by adding subsection 8.32
"Lawn Fertilizer Application Control" to read as follows:
8.32 Lawn Fertilizer Application Control.
8.321
Purpose. The City has conducted studies and has
reviewed existing data to determine the current and
proiected water quality of various lakes and ponds
within its community. The data indicates that
water quality may be maintained and improved if the
City is able to regulate the amount of lawn
fertilizer and other chemicals entering the lakes
and ponds as a result of storm water runoff or
other causes. The purpose of section 8.32, et. al.
is to define regulations which will aid the City in
managing and protecting its water resources which
are enioyed bY its residents and other users.

Minnesota State Licenses. A COpy of all
licenses required of the applicant bY the
State of Minnesota regarding the
application of pesticides and
fertilizers.
License Fee. The 1 i cense fee i s
established in Chapter 14 of the New Hope
City Code. The license shall expire on
the 31 st day of Decembe r. The 1 i cense
fee shall not be prorated.
Conditions of License. Commercial lawn
fertilizer applicator licenses shall be issued
subiect to the following conditions which
shall be specified on the license form:
License Application Procedure. Applications
for a commercial lawn fertilizer applicator
license shall be submitted to the City Manager
or a designee. The application shall consist

Time of Application. Neither commercial
applicators or noncommercial applicators may
applY lawn fertilizer when the ground is
frozen or when conditions exist which will
promote or create runoffs. All applicators
shall provide the New Hope City Clerk with 24
hour verbal notice in advance of any
applications within the City. The notice must
include the approximate times and locations
where the applications are intended to be
made.
Sample Analysis Cost. The cost of analyzing
fertilizer samples taken from commercial
applicators shall be paid bY the commercial
applicators if the sample analysis indicates

Fertilizer Content. Neither a commercial
applicator nor a noncommercial applicator

waterways.
Buffer Zone. Fertilizers and pesticides shall

established bY the Minnesota Department

Warning Signs for Pesticide Application. All
commercial or noncommercial lawn fertilizer
applicators who apply pesticides to turf areas
must post or affix warning signs on the
property where the pesticides are applied.
The warning signs shall comply with the
following criteria and contain the following
information:

The warning signs must proiect at least
eighteen (18) inches above the top of the
grass line. The warning signs must be of
a material that is rain resistant for at
least a forty-eight (48) hour period and
must remain in place UP to forty-eight
(48) hours from the time of initial
application.

The following information must be printed
on the warning signs in contrasting
colors and capitalized letters measuring
at least one-half (1/2"). or in another
format approved bY the Minnesota
Commissioner of Agriculture. The signs
must provide the following information:

The warning sign must be posted on a lawn
or yard between two (2) feet and five (5)
feet from the sidewalk or street. For
parks. golf courses, athletic fields,
playgrounds, or other simi lar
recreational property. the warning signs
must be posted immediatelY adjacent to
areas within the property where

near the entrances to the property.
Exemption to Phosphorus Requirement. The
limitation pertaining to quantity of phosphorus
shall not apply to:

areas during first growing season: or
turn and lawn areas which soil tests confirm
are below phosphorus levels established bY the
University of Minnesota Extension Services.
The lawn fertilizer application shall not
contain an amount of phosphorus exceeding the
amount of phosphorus and the appropriate
application rate recommended in the soil test
evaluation.

Phosphorus applied as lawn fertilizer pursuant
to the aforementioned exemptions shall be
watered into the soil where it is immobilized
and generally protected from loss bY runoff.
At least 24 hours prior to applYing lawn
fertilizer that exceeds the phosphorus limits
specified in this Chapter, the City must
receive notice from the commercial license
applicator of the lawn fertilizer application,
the reason for exceeding the phosphorus
limitations provided in this Chapter and the
amount of phosphorus cont a i ned in the 1 awn
fertilizer to be applied.
Penalty. Any person violating §§8.30 through 8.325
shall be guilty of a petty misdemeanor. The City
may revoke a commercial applicator's license for
repeat violations of §§8.30 through 8.325.

Fees" of the New Hope City Code is hereby amended by adding
subsection 14.105 "Commercial Lawn Fertilizer" to read as follows:

Term of Suspension. Pursuant to the authority
of Minn.Stat. §462.355, subd. 4. a total
prohibition is hereby imposed on the
establishment. expansion, modification or
reconstruction of any transmission or
reception facilities as defined in §1.581 of
this Code anywhere within the New Hope City
limits. Said prohibition shall be effective
through December 1, 1996. Any application for
the issuance of a building permit under
Chapter 3 of this Code, text changes,
variances. conditional use permits or rezoning
requests under Chapter 4 of this Code and any
subdivision requests under Chapter 13 of this
