1966 RES & ORDl;:,l RESOLUTION AWARDING CONTRACT FOR STREET IMPROVEMENT NO. 186 BE IT RESOLVED by the Village Council of the Village of New Hope as follows: 1. That bids for the construction of Street Improvement No. 186 were duly opened at the New Hope Village Hall, 7701 -42nd Avenue North at 2:00 o'clock p. m. on the 13th day of September, 1966 by the designated agents of the Village. 2. That advertisement for bids for the construction of said improvement were published in the New Hope-Plymouth Post, the official newspaper of the Village on September 1st, 1966; and in The Construction Bulletin on September 1st and 8th, 1966. 3. It is hereby found and determined that the bid of C. S. McCrossan, Inc. for the construction of said improvement in the amount of $91,023.50 is the lowest responsible bid submitted; that Bonestroo-Rosene-Anderlik & Associates, Inc., Engineers for the Village have recommended to this Council said C. S. McCrossan, Inc. for the award of the contract; and this Council does hereby award the contract to the aforesaid bidder. 4. The Mayor and Clerk-Treasurer are authorized and directed to enter into an improvement contract for construction of said project in the name of the village with the aforesaid bidder, subject to the said contractor furnishing a public contractor's surety bond, conditioned as required by law. I ---//I Attest: ~ I Clerk-Treasurer day of RESOLlITION ORDERING CONSTRUCTION OF SIDEWALK IMPROVEMENT NO. 185 BE IT RESOLVED by the Village Council of the Village of New Hope as follows: 1. This Council held a public hearing the 9th day of August, 1966 at 7:30 p. m. at the Village Hall, 7701 -42nd Avenue North in said village on proposed Sidewalk Improvement No. 185 of the Village, after notice of said hearing was duly published as required by law in the New Hope-Plymouth Post on July 28th and August 4th, 1966. 2. All persons desiring to be heard were given an op- portunity to be heard thereon and this Council having considered the views of all persons interested and being fully advised as to the pertinent facts, does hereby determine to proceed with the making of said proposed improvement, and said improvement is hereby ordered. 3. The area proposed to be assessed to pay the cost of said improvement shall include the property described in the notice of public hearing pertaining hereto, provided, howeve~ that the area assessed shall be limited to non-residentially zoned property abutting C.S.A.R. No. 9 and within the described area. 4. This Council has examined and approved the Affidavit pertaining to the mailing of notices of said hearing to the owners of all parcels within the area to be assessed, and has examined and approved the mailing list containing the names and addresses of all such owners; and this Council hereby finds, determines and declares that notice of said hearing was duly mailed the owners of each and all parcels within the area proposed to be assessed in accordance with and as required by law. Plans and specifications of proposed Sidewalk Improve- ment No. 185, heretofore prepared by Bonestroo-Rosene-Anderlik & Associates, Inc., Engineers have this day been presented to the Council and such plans and specifications, are hereby approved, and a copy thereof shall be placed on file in the office of the Clerk- Treasurer. 2. The Clerk-Treasurer and Engineer are hereby authorized and directed to advertise for bids in the New Hope-Plymouth Post, the official newspaper of the village and The Construction Bulletin, for the construction of said proposed improvement, said advertise- ment for bids to be in substantially the form attached hereto and made a part hereof. Mayor RESOLUTION AUTHORIZING CONDEMNATION PROCEEDINGS FOR STREET IMPROVEMENT NOS.156 AND 175 WHEREAS, it is necessary and advisable and in the public interest that the Village of New Hope lay out and establish and construct a roadway, Street Improvement Nos.156 and 175, and WHEREAS, in order to accomplish such purpose it is necessary to require easements for street purposes in, under and upon certain real property situated in the County of Hennepin, Village of New Hope, as described in the attached Exhibit A, which is attached hereto and incorporated herein by this reference; and WHEREAS, the Village is advised and believes that the most feasible location for said street easements is across the land that is described, with the temporary easements to expire on the 1st day of August, 1967; and WHEREAS, by reason of the inability of the Village to other- wise obtain such easements, it is necessary to procure title to said land by its right of eminent domain. NOW, THEREFORE, Be it resolved that the Village of New Hope proceed to procure easements in the property described under its right of eminent domain, and the Village Attorney be instructed and directed to file the necessary papers therefor and to prosecute such action to a successful conclusion until it iR ~h~n~nnaA A1c-1nn~~ --~--~-~ --· • RESOLUTION CONFIRMING AMENDMENT TO CONTRACT FOR STREET AND STORM SEWER·TMPROVEMENT NOo 144A TO INCLUDE WORK FROM STREET AND STORM SEWER IMPROVEMENTS NOSo 155 AND 170. BE IT RESOLVED by the Village Council of the Village of New Hope as follows: 1. This Council has heretofore awarded a contract on a unit-price basis to C. S. McCrossan, Inc. for the construction of Street and Storm Sewer Improvement No. 144A for the sum of $462,172.92. 2o This Council did on June 8th, 1965 order the construc- tion of Street Improvement No. 155, and did on October 26, 1965 order the construction of Storm Sewer Improvement No. 170. 3. The said contract with C. S. McCrossan, Inc. has been modified and changed so as to include the aforesaid work, and such additional units of work shall be paid at the same unit price as agreed in said contract, the said contract being changed by a change order for work of Storm Sewer Improvement No. 170 for the sum of $7,976.00, and by a change order for work of Street Improve- ment No. 155 for the sum of $1,990.00. The action of the Council in accepting said change orders is hereby formally ratified and confirmed, and the contracts shall be deemed amended accordingly. 4. This Council finds and determines that the estimated total cost of the additional work stated above is $9,966.00, and that said amount does not exceed 25% of the original contract price. BE IT RESOLVED by the Council of the Village of New Hope, Minnesota, as follows: 1. The assessment rolls heretofor duly prepared for the above captioned public improvements of the Village of New Hope, and now on file in the office of the Village Clerk, are hereby approved as the proposed assessment for said Improvements, and this Council shall meet at the time and place indicated in the notice attached hereto for the purpose of passing upon said assessments and hearing all objections hereto. 2. The entire amount assessed against any parcel of land will be payable unless prepaid, in equal consecutive annual installments as specified below, the first of such installments to be payable with the general taxes for the year 1967. ·The first installment will be payable with interest at the rate of 6% per annum on the entire assessment from the date of the resolution levying said assessment to December 31st, 1967 and each subsequent installment will be payable with one year's interest at said rate on all unpaid installments, except that no interest will be charged if the entire assessment as to any parcel is paid at the office of the Village Treasurer within thirty days from the date of the adoption of the assessment roll. 2.
