BE IT RESOLVED by the City Council of the City of New Hope as follows:
1. That bids for the construction of golf course maintenance facility
(Improvement Project 451) were duly opened at the New Hope City
Hall, 4401 Xylon Avenue North, at 11:30 a.m. on the 4th day of
October, 1989, as heretofore authorized by this Council.
2. That advertisement for bids for the construction of said
improvement was published in the New Hope-Go1den Valley Post, the
official newspaper of the City, on the 13th day of September,
1989, and in the Construction Bulletin on the 15th day of
September, 1989.
3. It is hereby found and detennined by this Council that the bid of
Sunshine Construction for the construction of said proj ect in the
amount of $135,180 is the lowest responsible bid submitted for the
construction of said improvement; that vogt Corporation has
recommended to this Council the said low bid for the award of the
contract for the construction to the designated lowest responsible
bidder.
4. The Mayor and Manager are authorized and directed to enter into an
improvement contract for the construction of said improvement in
the name of the City with the lowest responsible bidder, subject
to the said contractor furnishing a public contractor I s surety
bond, conditioned as required by law.
Adopted by the City Council of the City of New Hope, Hennepin County,
Minnesota, this 9th day of October, 1989.

We understand that they have forwarded their financial statement to
the city direct.
Sunshine Construction has been in business for 13 years, and has
obviously established a solid presence in the home building market.
The reference letters indicate good performance regarding construction
of temporary classrooms for a School District, and construction of a
dental clinic.
The maintenance building project is a rather simple and straight-
forward project, so we do not view it as a problem that the
contractor's experience has been mostly with houses. We have heard
nothing negative about this company.
We point out that Sunshine Construction has been in business for 13
years. For a project of this size, we feel that this length of time
in business, plus their ability to provide the performance bond or
equivalent financial guarantee of performance, are ample confidence
factors to support a decision to award them the construction contract.

planing and construction phases of my dental building in A~ple
Valley was a pleasant experience.
We broke ground the last ~art of October and I was moved in and
doing business by the end of February.
I WQS impressed by three things: the grade of material they used
including the framing material; the suboontractors that were
employed on my building; and the close attentiOn Todd gave to the
projee~, just as if it were his own buildin~.
After working in the building for four months now there hasn't been
anything! would ohange. If I were to do it again I wculdntt
hesitate to hire Sunshine Construction and Todd Munson again.

THE CONTRACT DOCUMENTS
The Contract Documents consist of this Agreement, Conditions of the Contract (General, Supplementary and other Conditions),
Drawings, Specifications, Addenda issued prior to execution of this Agreement, other documents listed in this Agreement and
Modifications issued after execution of this Agreement; these form the Contract, and are as fully a part of the Contract as if attached
to this Agreement or repeated herein. The Contract represents the entire and integrated agreement between the parties hereto and
supersedes prior negotiations, representations or agreements, either written or oral. An enumeration of the Contract Documents,

THE WORK OF THIS CONTRACT
The Contractor shall execute the entire Work described in the Contract Documents, except to the extent specifically indicated in

CONTRACT SUM
4.1 The Owner shall pay the Contractor in current funds for the Contractor's performance of the Contract the Contract Sum of
One Hundred and Thirty Five Thousand, One Hundred and Eighty Dollars
($ 135,180. 00 ), subject to additions and deductions as provided in the Con-
tract Documents.
4.2 The Contract Sum is based upon the following alternates, if any, which are described in the Contract Documents and are

ARTICLE 5
PROGRESS PAYMENTS
5.1 Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for Payment issued by the
Architect, the Owner shall make progress payments on account of the Contract Sum to the Contractor as provided below and
elsewhere in the Contract Documents.
5.2 The period covered by each Application for Payment shall be one calendar month eo

5.3 Provided an Application for Payment is received by the Architect not later than the
fifteenth day of a month, the Owner shall make payment to the Contractor not later than
30 days after recei viner application from Archi teet. If an Application for Payment is received by the
Architect alter the application date fixeaaoove, payment shall be made by the Owner not later than
30 days after receiving application from Architect.
5.4 Each Application for Payment shall be based upon the Schedule of Values submitted by the Contractor in accordance with
the Contract Documents. The Schedule of Values shall allocate the entire Contract Sum among the various portions of the Work
and be prepared in such form and supported by such data to substantiate its accuracy as the Architect may require. This Schedule,
unless objected to by the Architect, shall be used as a b;L'iis for reviewing the Contractor's Applications for Payment.
5.5 Applications for Payment shall indicate the percentage of completion of each portion of the Work as of the end of the period
covered by the Application for Payment.
5.6 Subject to the provisions of the Contract Documents, the amount of each progress payment shall be computed as follows:
5.6.1 Take that portion of the Contract Sum properly allocable to completed Work as determined by multiplying the percentage
completion of each portion of the Work by the share of the total Contract Sum allocated to that portion of the Work in the
Sche~Cj of Values, less retainage of ten percent
( 'X,). Pending final determination of cost to the Owner of changes in the Work, amounts not in dispute may be
included as provided in Subparagraph 7.3.7 of the General Conditions even though the Contract Sum has not yet been adjusted by
Change Order;
5.6.2 Add that portion of the Contract Sum properly allocable to materials and equipment delivered and suitably stored at the
site for subsequent incorporation in the completed construction (or, if approved in advance by the Owner, suitably stored off the
site at a 10catiQJ1 agreed upon in writing), less retainage often
percent (.10 %);
5.6.3 Subtract the aggregate of previous payments made by the O\vner; and
5.6.4 Subtract amounts, if any, for which the Architect has withheld or nullified a Certil1cate for Payment as provided in Para.
graph 9.5 of the General Conditions.
5.7 The progress payment amount determined in accordance with Paragraph 5.6 shall be further modified under the following
circumstances:
5.7.1 Add, upon Substantial Complet12I} oi,the Work, a sum sufficient to increase the total pavments to

Sum, less such amounts as the Architect shall determine for incomplete Work and unsettled claims; and

FINAL PAYMENT
Final payment, constituting the entire unpaid balance of the Contract Sum, shall be made by the Owner to the Contractor when (1)
the Contract has been fully performed by the Contractor except for the Contractor's responsibility to correct nonconforming

RESOLUTION APPROVING CHANGE ORDER #3 AND #4 FOR IMPROVEMENT
PROJECT NO. 451 (GOLF COURSE MAINTENANCE FACILITY)
Change Order #3 is for sealing of the concrete floor for a total
of $350.00.
Change Order #4 is for an increase in capacity of sewage lift
station, as per recommendations of the Engineer, Mark Hanson and
Public Works Director, Roger Paulson. This is to provide for
reduction in long term maintenance costs for this new lift
station at the golf course. The cost is $6,966.30.
Staff recommends approval of both change orders.

At inside surfaces of exterior walls at rooms 102 and 103,
walls are to be furred with furring strips and 1-1/2" molded
polystyrene insulation board plus polyethylene vapor barrier
and 1/2" gypsum board. This is to extend up to roof deck.
Where ceramic tile is scheduled, tile is to be installed
over the gypsum board and insulation noted above.

Dear Mr. Donahue:
The not-to-exceed limit on our professional fee construction
documents and bid and construction phase services was established
as 8-1/2% of a pre-bid budget of $126,300.00. This established
a limit of $10,735.00 for these services.
We structured the bid package with alternates so that the project
could go ahead for $126,300 or less.
since the city elected to go ahead with accepted alternates
resulting in a contract sum totalling $135,180.00, we request
that this figure also be the basis used to figure our 8-1/2% not-
to-exceed limit. The difference between $135,180.00 and
$l26,300.00 is $8,880.00. This times 8-1/2% equals $755.00.
Adding $755.00 to our fee limit would result in the fee limit for
construction plans and site visits to be $11,490.00 and the
overall fee authorization for the project to be $15,240.50.
