SCOPE: This project provides for the construction of storm sewer to serve the
recently developed Parkway Business Center at 5600 International Parkway and
the immediate surrounding area. The area is located north and east of
International Parkway in Science Industry Park subdivision..
FEASIBILITY AND RECOMMENDATION: The project is feasible from an engineering
standpoint and is in accordance with the Comprehensive Storm Sewer Plan for
the City of New Hope. The project as outlined herein can best be carried out
by combining it as a change order to the recently bid 1988 Street Resurfacing
Program, Project No. 432 or biding it as a separate project on it's own.
STORM SEVER: Storm sewer proposed herein provides for construction of an 18"
and 27" diameter storm sewer from International Parkway (west of the existing
railroad crossing) to the centrally located wetland in Science Industry Parko
The proposed storm sewer layout is shown on the attached drawing. The 27"
storm sewer east of the railroad crossing is required due to the proposed
development and grading of two soccer fields and a softball field in the
future Science Industry Park betv7een the railroad crossing and the existing
wetland. Presently an open ditch exists conveying drainage from an existing
24" eMF culvert beneath the railroad > crossing to the wetlando At the time
Parkway Business Center developed an agreement between the City of 1\1 e \'7 Hope
and the developer (Rosev7ood Corporation) 1j7 a. s developed requiring Parlcway
Business Center to accept assessments when this storm sewer is built~ In
addition it's also proposed to extend an 18ft storm se 't.ve r nOl'trlerly from the
existing storm sewer in International parkwa.y along the west side of the

existing railroad to the existing 24" eMP culvert crossing beneath the tracks
as shown in the attached drawing 0 This storm sewer is required due to the
development of Parkway Business Center which filled the existing open ditch.
Thereby~ restricting the flow from the existing storm sewer in the low point
of International Parkway to the existing 24" eMF culvert crassing beneath the
tracks.

COST ESTIMATES: Detailed cost estimates are presented in Appendix A located
at the back of this report. The total project cost is estimated to be $37,750
which includes contingencies and all related averhead~ Overhead costs are
estimated at 25% and include legal, engineering, administration and bond in-

ASSESSMENTS: Assessments are proposed to be levied against the benefited

WHEREAS, a License Agreement between the Soo Line Railroad and
the City of New Hope to allow the City to construct a
storm sewer under the railroad between the proposed
city park and the property at 5600 International
Parkway has been prepared and presented to the city
council of the City of New Hope; and
WHEREAS, the fee associated with the license is $600.
NOW, THEREFORE BE IT RESOLVED by the City council of the city of
New Hope, that the License Agreement No. 27293 between
the Soo Line Railroad and the City of New Hope, is
hereby approved and the Mayor and city Manager are
authorized to sign.
Adopted by the City council of the City of New Hope, Hennepin
County, Minnesota, this 24th day of July, 1989.

1 . The Railroad Company grants to the Licensee permission to install and maintain a Rep
pipe line, not exceeding 33 inches in diameter, hereinafter called "pipe line". extending upon and across the Railroad
Company's property and tracks in the SH~ SWz of Section 6 , Township 118 N., Range 21 \-1
County of Hennepin , at or near Ne;;,; Rope , State of Hinnesota
for a distance of approximately 20 feet at Railroad Survey Station 25+88
In the location indicated in red and in accordance with the details as shown on the map hereto attached marked "Exhibit A". and
specifications hereto attached marked "Exhibit 6", at a depth of not less than 7 feet beneath the base of the rail of any
railroad tracks located on said property, to be used by the Licensee exclusively for storm se'r..;er

other obstructions to the construction of Licensee's pipe line and shall indemnify Railroad Company for any and all liability for damage to
the foregoing pipes. wires. conduits. sewers. piling or other obstructions. if any. caused by the construction or maintenance of Licensee's
pipe line. The Railroad Company makes no representation by the granting 01 this license that its prop-erty is tree of any such pipes. wires.
conduits. sewers, pilings or other obstructions.
5. The Licensee shall not carry on any work in connection with the installation. maintenance, repair,changing or renewal of

6. The Licensee at the Licensee's sole ex.pense, whenever notified to do so, shall promptly make such repairs to or changes
in the pipe line. including cnange in location, as said Chief Engineer or his authorized representative shall tor any reason consider
necessary and require. The Railroad Company shall have the right, at its ele-ction, to make emergency reoairs to the pice line, and in
such event the Licensee. upon bills baing rendered therefor. will promptly reimburse the Railroad Company for all expenses incurred in
connection therewith.
7. Maintenance and usa of the pipe line upon and across the Railroad Comoany's property at the above described location,
however long continued, shall not vest in the Licensee any nghts adverse to those of the Railroad Company.
8. The Licensea shall assume all risk of damage to or destruction of the pipe line through any cause whatsoever while locate-d
upon and across the Railroad Company's property. and shall at all times fully indemnify the Railroad Company against all liability, claims,
demands, suits, judgements. costs and expenses by reason of loss or damage to property and injury to or death of persons whatsoever
or whomsoever. 10 any manner arising from or growing out of, directly or indirectly, wholly or in part. the installation. maintenance, repair.
changing. renewal. existence or removal of the pipe line upon. across or from the RaIlroad Company's property at the above descnbe-d
location.
9. The waiver by the Railroad Company of a breach by the Licensee of any provision hereof. shall be limited to the act or omission
constituting such breach. and shall not constitute a continuing or permanent waiver.
. 10. This agreeme0t or ~he permissiot! herein granted shall ,:ot be assigned or transferred by the Licensee in any manner. by
operatIon of law or otherwIse. Without the written consent of the Rwlroad Company. Subject thereto. this agreement shall inure to the
benefit of. and be binding upon. the successors, assigns and legal representatives of the respective parties.
11. This agree-ment shall continue in eHect until terminated by either party upon thirty (30) days' written notice to the other

Dear Dan,
Enclosed are a License Agreement from the Soo Line Railroad Company for the
above project. This agreement is required to construct the storm sewer
beneath the railroad spur between the City park and the propety recently
developed by Rosewood Corporation. As noted a resolution must be adopted by
the City Council authorizing the execution of the agreement. In addition, a
$600 fee is required in advance as rental for permission to construct the
storm sewer.
The storm sewer work is presently being bid with the 1989 MSA Street Project,
City Project No. 444. The bids will be received July 14 with contract award
considered at the July 24 Council meeting. Therefore, we would like to have
the resolution authorizing the execution of the agreement between the Soo Line
Railroad Company and the City of New Hope to also be considered at the July 24
Council meeting.

BE IT RESOLVED by the City Council of the City of New Hope
as follows:
1. That bids for the construction of street Improvement
No. 444 (1989 MEA Street Resurfacing project) and storm Sewer
Improvement No. 436 (Science Industry Park storm Sewer) which
were combined for advertisement and bidding purposes, were duly
opened at the New Hope City Hall, 4401 Xylon Avenue North, at
11:30 o'clock A.M. on the 18th day of August, 1989, as heretofore
authorized by this Council 0
2 . That advertisement for bids for the construction of said
improvements was published in the New Hope-Golden Valley Post, the
official newspaper of the City, on the 26th day of July, 1989,
and in the Construction Bulletin on the 28th day of July and the
r 4th day of August, 1989.
~ 3 . It is hereby found and determined by this Council that
the bid of C.8. McCrossen, Inc. for the construction of said
projects in the amount of $1,012,126.32 is the lowest responsible
bid submitted for the construction of said improvements; that
Bonestroo, Rosene, Anderlik & Associates, Inc., Engineers for the
City, have recommended to this Council the said low bid for the
award of the contract for the construction to the designated
lowest responsible bidder.
4 . The Mayor and Manager are authorized and directed to
enter into an improvament contract for the construction of said
improvements in the name of the City with the lowest responsible
bidder, subject to the said contractor furnishing a public
contractor's surety bond, conditioned as required by law.

On July 24, 1989 the City Council requested bids for Improvement
Project No. 444 (1989 MSA street Resurfacing Project) and
Improvement Project No. 436 (Science Industry Park storm Sewer).
The bids were rejected because a defect was found in the notice
advertising the project for bidding purposes.
The City council scheduled a special meeting to consider the new
bids. The new bids were received on Friday, August 18, 1989 and
are in the process of being reviewed by the City Engineer. A
resolution is in the packet which will award the contract to the
lowest responsible bidder.

TO CONSIDER SPECIAL ASSESSMENTS TO BENEFITTED PROPERTY
WHEREAS, the New Hope city council did, after hearing upon nXice
published and mailed as required by law, on December 12,
1988, order construction of street Improvement No. 436;
and
WHEREAS, on August 21, 1989, the City council did award the
contract for the construction of said improvements to
C. s. McCrossan Construction Inc. I 7865 Jefferson Highway I
Maple Grove, MN 55369; and
WHEREAS, the City Council did direct and hereby approves and
ratifies staff's action of determining expenses incurred
in making the improvement;
WHEREAS, the total cost of the project is $44,289 and the amount
to be assessed is $31,002 as itemized below; and
WHEREAS, Minnesota statutes Section 429 . 061 requires that a
proposed assessment roll shall be prepared by the City
Clerk with the assistance of the City Engineer and made
available for public inspection, and that this Council
shall consider said assessment roll at a public hearing
after giving proper notice to the affected property
owners.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of New
Hope as follows:
1. That it is hereby determined that the total cost to be
assessed is as hereinafter set forth:

2 . Assessments shall be payable in equal annual installments
extending over a period of 15 years, and shall bear
interest at a rate of nine percent per annum from the

assistance as shall be required, shall tabulate the
entire amount to be assessed for the improvement against
every assessable tract, piece or parcel benefi tted by the
making of such improvement, in accordance with provisions
of "Minnesota statutes, and shall file a copy of such
proposed assessment in the Clerk's office for public
inspection.
4. That the City Clerk is directed to publish the public
hearing notice in the New Hope-Golden Valley Post setting
a public hearing on September 24, 1990, to consider the
proposed assessment roll.
5. That the City Clerk is directed to mail notice of said
public hearing to all owners of benefitted property set
forth in the proposed assessment roll.
Adopted by the City council of the City of New Hope, Hennepin
County, Minnesota, this 27th day of August, 1990.

assessment unless a written objection signed by the affected property owner
is filed with the City Clerk prior to the assessment hearing or presented to

Minnesota statutes, See. 429. 081 by serving notice of the appeal upon the
Mayor or Clerk of the city within 30 days after the adoption of the
assessment and filing such notice with the District Court within ten days

NOTICE IS HEREBY given that the Council of the City of New Hope
will meet at the City Hall, 4401 Xylon Avenue North, on MondaYr the
24th dav of Septemberr 1990 at 7:00 p.m., or as soon thereafter as
the matter may be heard, to hear, consider and pass upon all
written or oral objections, if any, to the proposed assessments for
the public improvement of the City described in the caption and
hereinafter.
The general nature of the improvement was:
The construction of an 18" and 27" diameter storm sewer from
International Parkway, west of the existing railroad crossing I
to the centrally located wetland in science Industry Park I
including catch basins, manholes, drain pipes and all other
appurtenant works and services reasonably required therefor.
The area proposed to be assessed includes your property, identified
above. The attached exhibit A identifies all of the properties to
be assessed on this project. A map showing the entire carea to be
assessed is on file and may be view~d at the office of the City
Clerk.
The proposed assessment rolls are now on file in the office of the
ci ty Clerk and are open to public inspection by all persons
interested. The total amount of the proposed assessment is
$31,002. The amount to be assessed to your property is listed at
the top of this notice.
Written or oral objections will be considered at the meeting, and
the Council may consider any objection to the amount of a proposed
individual assessment at an adj ourned meeting upon such further
notice to the affected property owners as it deems advisable.
Family Styled City" For Family Living
No appeal may be taken as to the amount of any individual
assessment unless a written objection signed by the affected
property owner is filed with the City Clerk prior to the assessment
hearing or presented to the presiding officer at the hearing. An
owner may appeal an assessment to district court pursuant to
Minnesota statutes, Sec. 429.081 by serving notice of the appeal
upon the Mayor or Clerk of the City within 30 days after the
adoption of the assessment and filing such notice with the district
court within ten days after service upon the Mayor or Clerk.
The City has no ordinance permitting the deferment of the levy of
special assessments on a hardship basis for citizens age 65 or
over, as authorized in M.S. 435.193 through 435.195.
The entire amount may be paid in full without interest at any time
on or before October 24, 1990, at the City Hall, 4401 Xylon Avenue
North, New Hope, MN 55428, or within 30 days of the adoption of
the assessment roll by the City Council.
You may prepay the assessment at City Hall anytime up to and
including November 15, 1990, but interest will be charged from the
time the roll is adopted to December 31, 1990. The City has no
ordinance authorizing a partial prepayment of the assessment.
If you do not choose to prepay the assessment, it will then be
certified for collection with your real estate taxes with the first
of 15 installments beginning with taxes payable in 1991.
If the assessment is put on your taxes, it will be spread in equal
annual installments over 15 years bearing interest at nine percent
( 9 % ) per year. The first installment will include interest on the
total assessment from October 1, 1990 through December 31, 1991, or
15 months' interest.

Dear Dan,
Since September of 1984, the City has been allowing fill to be placed in
Science Park located north of the Public Works Garage and east of Snap-on-
Tool. The fill has been placed in accordance with a grading plan which in-
cluded a combination of softball and soccer fields. To date, the City has not
incurred any expense for placing the fill. However, recently the City did
contract to have the trees removed and public works began leveling the fill in
accordance with the grading plan.
To accommodate the softball and soccer fields, the grading plan provided for
filling a portion of the wetland. In September of 1984, we submitted a permit
to the DNR for filling a portion of the wetland and also providing mitigation
for that filling. Because this work has never been done, we have also been
applying for extensions to the DNR permit. The filling of the wetland has now
been done and we must complete the mitigation work to comply with the DNR
permit which expires this year. Therefore, we have negotiated a change order
with C. S. McCrossan Construction, Inc. as part of Project No. 444. Attached
is a letter from C. S. McCrossan outlining their work and cost at $4,250. We
recommend approval of this change order so the work can be completed this fall
to comply with the DNR permit.

A public hearing was held on September 24, 1990, and continued to tonight's
meeting. The public hearing is to consider adopting the assessment roll for
Improvement Project No. 436 . This project proposes assessments against one
property owner--Parkway Business Center Ltd. Partnership, 5600 International
Parkway for $31,002.
The City Engineer is recommending a reduction in the proposed assessment to
Parkway Business Center from $31,002 to $20,131.
Staff recommends that the City Council close the public hearing and adopt the
resolution.

RESOLUTION ADOPTING ASSESSMENT
FOR STORM SEWER IMPROVEMENT NO. 436
(SCIENCE INDUSTRY PARK STORM SEWER IMPROVEMENT)
WHEREAS, pursuant to proper not ice duly gi ven as required by 1 aw , the
council has met and heard and passed upon all objections to the
proposed assessment for the Storm Sewer Improvement No. 436, Science
Industry Park Storm Sewer Improvement.
NOW, THEREFORE, BE IT RESOL VED, by the Counei 1 of the City of New Hope as
follows:
1 . Such proposed assessment, a copy of which is attached hereto
and made a part hereof, i s hereby accepted and shall
constitute the special assessment aga i nst the 1 ands named
therein, and each tract of land therein included is hereby
found to be benefi tted by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of 15 years, the first of the
installments to be payable on or before the first Monday in
January, 1991 and shall bear interest at a rate of nine
percent per annum from the date of the adoption of the
assessment resolution. To the fi rst i nsta 11 ment sha 11 be
added interest on the entire assessment from the date of this
resolution until December 31, 1991. To each subsequent
installment when due shall be added interest for one year on
all unpaid installments.
3 . The owner of any property so assessed may, at any time prior
to certification of the assessment to the county auditor, pay
the whole of the assessment on such property, with interest
accrued to the date of payment, to the city treasurer, except
that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of this resolution; and
he may, at any time thereafter, pay to the city treasurer the
entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such
payment is made. Such payment must be made before November 15
or interest will be charged through December 31 of the next
succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of
this assessment to the county auditor to be extended on the
property tax lists of the county. Such assessments shall be
collected and paid over the same manner as other municipal
taxes.

Dear Dan:
Parkway Business Center which is the only property to be assessed objected to
their assessment for the above project at the hearing on September 24, 1990.
Their assessment was determined in accordance with the preliminary report
which distributed the project costs as follows:
Parkway Business Center 70% $31,002
City of New Hope 30% 13,287

The City share (30%) was determined in accordance with past City projects and
policies. The balance (70%) was then to be assessed to the benefitted
drainage area. At the time of the preliminary report (October, 1988) , it was
felt this approach was fair when in fact Parkway Business Center included more
than 70% of the benefitted drainage area based on the available information at
that time. However, since that time the ball fields and soccer fields in
Science Park have been revised and additional park land (+ 3.2 acres) drains
to the newly constructed storm sewer. Therefore it is recommended the project
costs be distributed based on the drainage areas which are listed below:

The estimated assessment to Parkway Business Center in the October 1988
preliminary report was $26.425. The recommended assessment at this time is

A public hearing has been scheduled to consider adopting the assessment roll for
Improvement Project No. 436. This project proposes assessments against one
property owner--Parkway Busi ness Center Ltd. Partnershi p, 5600 Internat i ana 1
Parkway for $31,002.
The City Engineer has prepared a total project cost.
Staff recommends that the City Council close the public hearing and adopt the
resolution.

RESOLUTION ADOPTING ASSESSMENT
FOR STORM SEWER IMPROVEMENT NO. 436
(SCIENCE INDUSTRY PARK STORM SEWER IMPROVEMENT)
WHEREAS, pursuant to proper notice duly given as required by 1 aw , the
council has met and heard and passed upon all objections to the
proposed assessment for the Storm Sewer Improvement No. 436, Science
Industry Park Storm Sewer Improvement.
NOW, THEREFORE, BE IT RESOLVED, by the Coune i 1 of the Ci ty of New Hope as
follows:
1 . Such proposed assessment, a copy of which is attached hereto
and made a part hereof, is hereby accepted and shall
constitute the special assessment aga i nst the 1 ands named
therein, and each tract of land therein included is hereby
found to be benefi tted by the proposed improvement in the
amount of the assessment levied against it.
2 . Such assessment shall be payable in equal annual installments
extending over a period of 15 years, the first of the
installments to be payable on or before the first Monday in
January, 1991 and shall bear interest at a rate of nine
percent per annum from the date of the adoption of the
assessment resolution. To the first installment shall be
added interest on the entire assessment from the date of this
resolution until December 31, 1991. To each subsequent
installment when due shall be added interest for one year on
all unpaid installments.
3 . The owner of any property so assessed may, at any time prior
to certification of the assessment to the county auditor, pay
the whole of the assessment on such property, with interest
accrued to the date of payment, to the city treasurer, except
that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of this resolution; and
he may, at any time thereafter, pay to the city treasurer the
entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such
payment is made. Such payment must be made before November 15
or interest will be charged through December 31 of the next
succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of
this assessment to the county auditor to be extended on the
property tax lists of the county. Such assessments shall be
collected and paid over the same manner as other municipal
taxes.
Adopted by the City Council of the City of New Hope, Hennepin County, Minnesota,
this 24th day of September, 1990.

ASSESSMENT HEARING NOTICE FOR
STORK SEWER IMPROVEMENT NO. 436
(SCIENCE INDUSTRY PARK STORM SEWER IMPROVEMENT)
NOTICE IS HEREBY given that the Council of the City of New Hope
will meet at the City Hall, 4401 xylon Avenue North, on Mondav. the
24th day of Seotember. 1990 at 7:00 p.m., or as soon thereafter as
the matter may be heard, to hear, consider and pass upon all
written or oral objections, if any, to the proposed assessments for
the public improvement of the City described in the caption and
hereinafter.
The general nature of the improvement was:
The construction of an 18" and 27" diameter storm sewer from
International Parkway, west of the existing railroad crossing,
to the centrally located wetland in Science Industry Park,
including catch basins, manholes, drain pipes and all other
appurtenant works and services reasonably requ,ired therefor.
The area proposed to be assessed includes your property, identified
above. The attached exhibit A identifies all of the properties to
be assessed on this project. A map showing the entire .area to be
assessed is on file and may be viewed at the office of the City
Clerk.
The proposed assessment rolls are now on file in the office of the
ci ty Clerk and are open to public inspection by all persons
interested. The total amount of the proposed assessment is
$31,002. The amount to be assessed to your property is listed at
the top of this notice.
Written or oral objections will be considered at the meeting, and
the Council may consider any objection to the amount of a proposed
individual assessment at an adjourned meeting upon such further
notice to the affected property owners as it deems advisable.

No appeal may be taken as to the amount of any individual
assessment unless a written obj ection signed by the affected
property owner is filed with the City Clerk prior to the assessment
hearing or presented to the presiding officer at the hearing. An
owner may appeal an assessment to district court pursuant to
Minnesota statutes, Sec. 429.081 by serving notice of the appeal
upon the Mayor or Clerk of the ci ty wi thin 30 days after the
adoption of the assessment and filing such notice with the district
court within ten days after service upon the Mayor or Clerk.
The City has no ordinance permitting the deferment of the levy of
special assessments on a hardship basis for citizens age 65 or
over, as authorized in M.S. 435.193 through 435.195.
The entire amount may be paid in full without interest at any time
on or before October 24, 1990, at the City Hall, 4401 Xylon Avenue
North, New Hope, MN 55428, or within 30 days of the adoption of
the assessment roll by the City Council.
You may prepay the assessment at City Hall anytime up to and
including November 15, 1990, but interest will be charged from the
time the roll is adopted to December 31, 1990. The City has no
ordinance authorizing a partial prepayment of the assessment.
If you do not choose to prepay the assessment, it will then be
certified for collection with your real estate taxes with the first
of 15 installments beginning with taxes payable in 1991.
If the assessment is put on your taxes, it will be spread in equal
annual installments over 15 years bearing interest at nine percent
(9%) per year. The first installment will include interest on the
total assessment from October 1, 1990 through December 31, 1991, or
15 months' interest.
