It is hereby found and determined that Bonestroo, Rosene, Anderlik & Associates, Inc. , Engineers for the City,have heretofore reported to this Council that a public improvement for the City as hereinafter described is feasible and may best be made as proposed and not in conjunction with any other improvement, and that the estimated cost of said improvement to the City is $57,310.00. 2. This Council shall meet at the time and place specified in the form of notice included in paragraph 3 hereof for the purpose of holding a public hearing on the proposed construction of a public improvement as therein described. 3 . The City Clerk is authorized and directed to cause notice of the time, place and purpose of said meeting to be :( published for two successive weeks in the New Hope-Golden Valley Post, being the official newspaper of the City, the first of such publications to be not less than 10 days and the second not less than 3 days prior to the date of said meeting. The final commercial rate for this project is $19.28 per foot as compared to $20.52 per foot which was the amount estimated at the public hearing. The entire amount may be paid in full without interest at any time on or before October 25, 1989, at the City Hall, 4401 Xylon Avenue North, New Hope, Minnesota 55428, or within 30 days of the adoption of the assessment roll by the City Council. I X 9-; - 1/ ; Review: Administration Finance RfA-OO 1 RESOLUTION NO. 89-183 -:r , RESOLUTION ADOPTING ASSESSMENT FOR STREET IMPROVEMENT NO. 425 (36TH AVENUE WIDENING AT JORDAN) WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for the improvement of 36th Avenue North at Jordan Avenue North, Street Improvement No. 425. NOW, THEREFORE, BE IT RESOLVED, by the Council of the city of New Hope as follows: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the first of ~ the installments to be payable on or before the first Monday in ~ January, 1990 and shall bear interes~ at a rate of nine per cent per annum from the date of the adoptlon of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1990. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. The final assessment rate compared to the amount presented in the preliminary report is listed below. Preliminary Report Final % Deviation Commercial Rate $20.52/F.F. $19.28/F.F. -6.0% As noted the final assessment rate is 6.0% less than the preliminary report rate while the final project cost is +8.8% above the preliminary report amount. The difference is due to the fact two stop signs with signals were constructed which weren't included in the preliminary report and are not proposed to be assessed. He noted. that the project includes resurfacing' 36th Avenue from the County Road 18 bridge to the easterly en:l of new curb construction. 'Ihe City Er.g"ineer advised. that the estima.ted. project cost was $57,310.00. He stated. that properties benefitting from the prop:se::l street resurfacing would be assessed. bcised. on an estima.ted. rate of $20.52 per front foot for a total of $13,375.00. '!he City Engineer explained. that the purpc>se of the prop:se::l project is to provide four traffic lanes, both east arrl west, through. the 36th arrl Jordan Avenue intersection to create a safer intersection with the four-way stop signs for the pedestrian traffic. ( '!he Mayor asked. whether anyone in the audience wished. to comment on the prop:se::l proj ect. A resident in the audience inquired. whether other al te.rrlati ves have been considered. to accomplish the goal of a safer intersection. Mr. Hanson :pointed. out that 36th Avenue is a state aid street arxi generates 12 , 000 to 17, 000 vehicles per day on the roadway. He stated. that less constnIction than proIX>sed. nay not create a safer intersection. rrhe resident stated. that at the August lOth Council meetin; there were discussiorlS of a righ.t turn only lane from 36th onto Jordan, both east arrl west, to eliminate widening both sides. '!he city Engineer explained. that traffic movement from 36th Avenue onto Jordan does not warrant a turn lane. He IX>inted. out that traffic would still merge creating a hazardous situation unless the lane was blocked. for righ.t turn traffic. The total cost of the proposed assessment is $12,570.56. 5. Assessments shall be payable in equal annual installments extending over a period of 10 years, and shall bear interest at a rate of nine per cent per annum from the date of the adoption of the assessment resolution. 6. The area proposed to be assessed for the making of the improvements stated in No.3, above, shall include all of the lots and parcels (a) abutting the streets as platted in the plats above named, or (b) within or abutting the tracts of land described above. ~ 7. No appeal may be taken as to the amount of any individual assessment unless a written objection signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. 8. An owner may appeal an assessment to District Court pursuant to Minnesota statutes, Sec. 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or Clerk. 9. The City has no ordinance permitting the deferment of the levy of special assessment on a hardship basis for citizens age 65 or above, as authorized in M.S. 435.193 through 436.195.
