If the base bid and alternates one through four bids are acceptable to the Council} staff recommends awarding a contract to Hunerberg Construction Company in the amount of $894,384.00 for Projects 671 and 679. BACKGROUND The New Hope Public Works Facility was built in 1980 with a 1,800 square foot repair shop. The proposed shop addition will allow staff to move all service work into the expanded repair shop area from the parking garage and outside areas. The improvement has been considered on two other occasions, 1991 and 1997. The Council appr9ved contracts to TSP ONE1 Inc., for architectural services and to E&V, Inc., to be the owner's representative for the proposed project on March 13, 2000. Schematic designs were approved March 27, 2000, and the Council approved specifications on May 22, 2000. If a contract is awarded to Hunerberg Construction Company, they are proposing to begin construction the first part of August and substantially complete the project by January 2001. The final layer of asphalt for the repair shop approach, the landscaping, and seal coating the parking and storage lots would be completed late spring or early summer 2001. June 24, 2002 Consent By: {~!; Item No. Sy: Guy Johnson 6.5 RESOLUTION APPROVING THE WETLAND REPLACEMENT PLAN REQUIRED UNDER THE WETLAND CONSERVATION ACT REQUESTED ACTION Staff is recommending that the Council approve the Wetland Replacement Plan for the Hidden Valley Park Improvements. BACKGROUND The reconstruction of the pond at Hidden Valley Park will impact 11,532 square feet of wetland. The Wetland Conservation Act requires wetland replacement in the ratio of 2: 1 replacement, or 23,064 square feet of wetland. Acting on behalf of the City of New Hope, Bonestroo has prepared the necessary Wetland Replacement Plan Application and has submitted it to the Minnesota Department of Natural Resources, Basset Creek Watershed Management Commission} and Hennepin Conservation District for review and comment. No comments nor suggested revisions were received. As the local governmental unit (LGU) administering the Wetland Conservation Act, New Hope is required to approve the Wetland Replacement Plan. Portions of the improvements are within the existing pond/wetland. As a result, mitigation is required for the disturbed \vetlands. Overall, the project is an enhancement to the City storm water and ~}etland system. The improvements \vithin the project account for the required mitigation. As required by the Wetland Conservation Act, a Notice of Wetland Conservation Act (WCA) Application for Impacts greater than 10,000 sq. ft. \vas published and distributed to appropriate agencies for reviev/. A copy is attached. The required comment period has expired with no comments received. The City of New Hope is the Local Government Unit (LGU) for administering the WCA in New Hope. BACKGROUND On June 26, 2000, the City Council approved a contract with Hunerberg Construction Company for a building addition and the renovation of the New Hope Public Works Facility. The original contract amount was $894,384.00. Two previous Change Orders approved by the Council on November 13, 2000 and February 26, 2001 caused the revision in the contract amount to $947,181.00 Change Order No.3 represents compensation for additional work in ten areas of the project and credits in two areas. These changes are as follows: 1. A Code issue required disconnects at the city's welder outlets. $432.00 2. The concrete floors that were removed during demolition were up to 12 inches thick instead of the normal 5 to 7 inches. $3,054.00 3. Finished end cap cement blocks for two walls in the repair shop that were not called out on the blue prints. $11376.00 4. General contractors mark up on work that their utility subcontractor completed for Public Works. BACKGROUND The New Hope Public Works facility was built in 1980 with a 1,800 square foot repair shop. The shop addition will allow staff to move all service work into the expanded repair shop area from the parking garage and outside areas. The improvement has been considered on two other occasions, 1991 and 1997. The Council approved contracts to TSP ONE, Inc., for architectural services and to E&V, Inc., to be the owner's representative for the proposed project on March 13, 2000. Schematic designs were approved March 27, 2000, and the Council approved specifications on May 22, 2000. On June 26, 2000, the City Council approved a contract with Hunerberg Construction Company for a building addition and the renovation of the New Hope Public Works garage facility. The project began in early August of 2000, with a proposed substantial completion date in January 2001. The final layer of asphalt for the repair shop driveway approach and the landscaping were to be completed in the spring of 2001. Because of delays due to the removal of additional materials and weather, it was agreed to extend the substantial completion date in the contract to February 19, 2001. The ineffective management of subcontractors by the general contractor prolonged the project into the summer of 2001. The actual substantial completion date was July 27, 2001. Because of this unacceptable delay, the city pursued liquidated damages totaling $31,400.00 for 157 days at $200.00 per day. After receiving this information, Hunerberg Construction Company informed the Project Architect that they had filed for arbitration to resolve the issue. A settlement was agreed upon during negotiations between city representatives, including the City Attorney, and Hunerberg Construction Company's attorney prior to the actual arbitration hearing. RESOLUTION NO. 02 - 104 RESOLUTION APPROVING FINAL PAY REQUEST TO HUNERBERG CONSTRUCTION COMP ANY FOR IMPROVEMENTS TO PUBLIC WORKS FACILITY (PROJECT NOS. 671 & 679) BE IT RESOLVED by the City Council of the City of Ne\v Hope as follo\vs: \VHEREAS, Change Order No.3 has been agreed to by Hunerberg Construction Company reducing the contract price by $1,213.00, and WHEREAS, based on Change Order No.3 the revised contract price has been established at $945,968.00, and WHEREAS, to date Hunerberg has been paid $899,821.00 leaving a final payment due Hunerberg based on Change Order No.3 of $46, 147.00, and WHEREAS, Hunerberg has directed the City to pay directly its roofing subcontractor Commercial Roofing, Inc. $7,147.00 upon completion of the roofing repairs included in Change Order No.3, and WHEREAS, Hunerberg is owed the remaining $39,000.00 and should be paid said amount upon completion of the eleven warranty items and submission of the required documentation set out in the attachment to the architect's Certificate for Final Payment. It is estimated these conditions can be completed by the Hunerberg on or before June 28th. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City ofNe\v Hope as follows: 1. Hunerberg Construction Company shall be paid $39,000.00 upon completion of the eleven warranty items and submission of required documentation referenced above. The conditions should be completed and satisfied and payment made no later than June 28, 2002. 2. INSPECTIONS: All plumbing installations must be tested and inspected in accordance with the requirements of the Minnesota Plumbing Code. As specified in Minnesota Rules, part 4715.2830, no plumbing work may be covered prior to completing the required tests and inspections. Provisions must be made for applying an air test at the time of the roughing-in inspection as outlined in Minnesota Rules, part 4715.2820, subpart 2, of the code. A manometer test, as specified in Minnesota Rules, part 4715.2820, subpart 3, is required at the time of the finished plumbing inspection. It is the responsibility of the contractor/installer to notify the State Health Department \vhen the installation will be ready for a test and inspection. Sheet P21 0 indicates the installation of draintile around the vehicle lift in Repair Bay No.3. The revisions dated September 1, 2000, show the draintile discharging to a sump, \vhich discharges indirectly to a vented floor drain in a storage room. A detail of the vehicle lift \vas not provided. If it is possible that hydraulic fluid may leak from buried hydraulic cylinders and/or related piping to the draintile, or if fluids leaked from vehicle maintenance may reach the draintile, the following requirements must be met: a. Documentation must be provided to this office from the local fire marshall allowing the sump installation prior to construction. b. Documentation must be provided to this office from the local electrical inspector allowing the sump installation prior to construction. c. The sump pump motor must be explosion-proof. The architectsl E&V, and City staff will be in attendance to review the proposed design. BACKGROUND The Public Works facility was remodeled in 1979. An 11800 square foot repair shop was included in the original design. The new repair shop addition would have allowed moving all service work into the repair shop area from the parking garage and the outdoors. Because of the existing conditions, some of the larger vehicles are unable to access the repair shop. The current repair shop is only large enough to work on two average sized vehicles at a time. Therefore, the space is restricted to service work, short term repairs, and police car set-up. With these s.pace restraintsl larger, long term projects on equipment are unable to be completed in the repair shop because of the time commitment. Alsol there are more large pieces of analyzing equipment needed to service and maintain the City's vehicles and equipment that is continually becoming more sophisticated. This would include an anti-freeze reclaimer, air conditioner refrigerant reclaimer, multiple computerized analyzers, etc. This improvement has been considered on two other occasions. Cost estimates were done in 1991 and 1997. FUNDING Funding for this project is budgeted in the 2000 Capital Improvement Program.
