Type of Planning Request A. Conditional Use Permit (CUP) II. Property Specifications Zoning: R-1, Single Family Residential. Location: 4240 Gettysburg Avenue North. Adjacent Land Uses: R-1 Single-family Residential to the north, south, and east. R-1 Single-family Church to the west. Site Area: 3.53 acres, or 153,835 square feet Building Area: Proposed addition:12,263 square feet Planning District: Planning District 7. The Comprehensive Plan supports the requested conditional use within the district and also promotes reinvestment in New Hope's residential neighborhoods. IV. Background Holy Trinity Lutheran Church currently operates a kindergarten through 8th grade private school and daycare center. The church desires to expand their current facility in order to meet the needs of their growing school. The church has submitted an application for a Conditional Use Permit (CUP) to expand the school by approximately 11,123 square feet through the addition of a second floor over the Planning Case Report 18-23 Page 1 9/28/18 existing school area. The project includes a 1,140 square foot expansion of the main floor entryway. In total, the building addition will add 12,263 square feet to the current building. V. Zoning Analysis A. Plan Description 1. Setbacks One of the standards for approval of a CUP for religious buildings is doubling of the required base district setbacks, not to exceed 30 feet. The site plan shows that all building setbacks are compliant with this standard. Parking City Code requires elementary and church schools to provide one parking stall for each seven students based on building design capacity, plus one stall per three classrooms. The applicant provided an estimated maximum enrollment capacity for the daycare nursery, pre-school and the church school K -8th grades of 214 students. School staff is estimated to be 9 employees, with other daytime church and daycare staff adding another 18 employees. Using the city's parking standards, the required parking count is 62 parking stalls. The site plan provides 65 parking stalls. The site plan shows parking stalls in the north parking lot at variable lengths. All stalls must meet the city's minimum dimensions requirements. The minimum stall width is 8 feet 9 inches, and minimum stall length is 19 feet or 18 feet with an approved snow removal plan. The width of the north parking lot has sufficient area to meet the required stall and drive aisle dimensions without need to expand the parking lot. The site plan also shows a proof -of -parking area on the south end of the site. This proof -of - parking area meets the city's minimum dimensions, setbacks and design criteria. This lot will only be required if the current on-site parking is insufficient to meet future church parking demand. if required, the proof -of -parking shall be constructed in with city performance standards that exist at the time of construction, including but not limited to parking lot design, screening, and lighting. Planning Case Report 18-23 Page 2 9/28/18 3. Access, Circulation, and Loading The site plan shows three curb cut access points. There are two existing curb cuts on the west side of the site that provide access from Gettysburg Avenue. These curb cuts are proposed to remain in their current locations. To make bus / truck movements work within the site, the applicant has requested a third curb cut onto Gettysburg Avenue. The city allows church properties one curb cut for every 125 feet of frontage on a public street. The church has approximately 550 feet of frontage along Gettysburg Avenue, allowing up to 3 curb cuts. The proposed curb cuts meet the city performance standards for width and separation between curb cuts. Staff finds that site access and circulation has been well conceived and should provide for efficient traffic flow throughout the site. The applicant has provided a description of type and size of delivery vehicles that will serve the church and school. The auto turn exhibit shows how a 40 -foot -long bus will access, off load and egress the site through the north parking lot. In the applicant's narrative, their description of other delivery vehicles serving the church and school describes all vehicles as shorter than the school buses. Finally, there is a one-way drive aisle that runs along the west side of the building. This drive aisle is used to drop off congregation members at the west entrance. 4. Curbing and Pavement A portion of the existing bituminous parking area will be removed in two areas to accommodate construction activities and the installation of the new curb cut. The proposed areas of disturbance will not trigger a review of the plans by the watershed district. There will be new concrete curbing installed in areas where the pavement is disrupted. 5. Mechanical Equipment Screening Rooftop and ground -mounted mechanical equipment has not been identified on the current plans. New equipment must be shown on the plans and be screened to meet city code. 6. Building Design and Exterior Materials The maximum building height in the R-1 District is 32 feet, or two -and -a -half stories (whichever is more restrictive). The building elevations show that the proposed building is two stories and has a maximum height of 32 feet. The primary exterior material for the new addition is 8" burnished CMU blocks to match the current building. The CMUs will be complimented with several new windows, small bands of EFIS, and an attractive new entrance. New Hope Design Guidelines do not provide specific recommendations for institutional and religious buildings. Staff finds the proposed building design and materials to be in alignment with the general intent of the city's guidelines. The materials are high quality, attractive and durable. Planning Case Report 18-23 Page 3 9/28/18 7 Trash Enclosure The property is currently served by an existing trash enclosure that will not be altered as part of this project. The current enclosure will accommodate new waste generated with the expansion. 8. Lighting The applicant has submitted a photometric lighting plan for outdoor lighting. In review of the plan, the following comments are offered: • The applicant has provided photos of the proposed new lighting to demonstrate that the fixtures meet city standards for 90 -degree cutoff light fixtures. • Additional parking lot lighting is being installed. Light levels for all parking lots will meet the city minimum requirement of 0.2 foot candles across the parking lot. • Wall mounted lights are proposed along the building which will provide the city's required 5.0 foot candles at building entrance and 0.5 foot candles along internal sidewalks. • The new lighting and photo metric plan meets the city zoning standards for exterior lighting. 9. Play Area The northern area of the site is designated as the elementary school play area. Staff recommends enclosing the play area with a fence to avoid students leaving the site and to prevent balls and other items from going into the street or trespassing into adjoining lots. Fence details have been provided; the proposed fence will be a 4 -foot tall chain link fence. The site plan must show the location of existing and proposed new fences to demonstrate that the play area is enclosed from surrounding streets and properties. 10. Signage A signage plan was not submitted with the application. Any new signage will require a sign permit after staff review. 11. Storm Water The impervious surface area on the property is not increasing as part of this project. Therefore, there is no review by the watershed. district, and no additional stormwater control measures are being constructed. 12. Snow Storage The applicant's site plan shows a snow storage area along the north side of the parking lot. This snow storage area is equal to, or greater than 10% of the parking lot surface. Fire Code The Deputy Fire Marshal has reviewed the submitted plans, and she has raised no concerns with the site design. The Fire Marshal will work with the Building Official and the applicant's architect to ensure compliance with fire codes that relate to the building construction. B. Zoning Code Criteria 1. Conditional Use Permit (CUP) Criteria. The Planning Commission and City Council shall consider the possible adverse effects of the proposed conditional use. In determining whether to approve or deny a conditional use permit, the City Council and Planning Commission shall find that the conditional use permit complies with the following criteria. ' The burden of proof demonstrating compliance with the following criteria shall be the responsibility of the applicant. (1) Comprehensive Plan. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official comprehensive municipal plan of the city. Fines The proposed. use of the building is consistent with the intent of the Comprehensive Plan. Additionally, the comprehensive plan promotes building and site upgrades that improve the function and aesthetics of properties within all residential districts. (2) Compatibility. The proposed use is compatible with adjacent present and future anticipated land uses. Fines The proposed use of the building is consistent with allowable uses in the R-1 District. The church and school have been in place for several years. Expansion of the current use is compatible with adjacent present and future anticipated land uses. (3) Performance standards. The proposed use conforms to all applicable performance standards outlined in the Zoning Code. Findings. Staff has concluded that the proposed use conforms to all applicable performance standards outlined in the Zoning Code. (4) No depreciation in value. The proposed use will not tend to or actually depreciate the area in which it is proposed. Finding& The use of the building as a church and school will not depreciate the area's value. The proposed upgrades to the site and the building addition should contribute to the character of the neighborhood in a positive way. (5) Zoning district criteria. In addition to the above general criteria, the proposed use meets the criteria specified for the various zoning districts. Planning Case Report 18-23 Page 5 9/28/18 Per Code Section 45(e) (1), Public, educational and religious buildings are a conditional use within the R-1 Single Family Residential District with the following criteria: Side yards shall be double that required for the district, but not greater than 30 feet. Findinsa The site pian indicates that the prescribed side yard setback standard is being met. C. Design and Review Committee The Design and Review Committee met on September 13, 2018, to consider the proposal. The committee was in favor of the project. D. Approval 1. Type of Approval 2. Notification Property owners within 500 feet of parcel were notified by mail, a legal notice was published in the Sun Post newspaper, and land use application signs were placed on the property. Staff has not received questions or comments regarding the proposal. VIII. Summary Holy Trinity Lutheran Church is an existing church and school in the community that desires to expand their current facility in order to meet the needs of their growing school. The proposed improvements will enhance the site and contribute positively to the character of the neighborhood. Staff is excited for the opportunity to help the church meet their expansion goals. IX. The church will construct the proof -of -parking area at the directive of the city if the on-site parking proves to be insufficient to accommodate the site's demand. Any new rooftop or ground mounted mechanical equipment shall be identified and meet all applicable screening requirements. New Hope, MN 55428 Phone: (763) 533-0600 Thank you for recommending the topic of bussing, staff parking and delivery vehicles to our building committee. These are all very important items that we will need to be looking at in the near future. Regarding bussing, we have decided on couple of possible solutions: 1. a) Adding a one way exit driveway on the far end of the current parking lot. That way the busses can enter and exit our current lot without disrupting current entrance and exit modes. b) Removing the portico, which allows all delivery vehicles and busses to enter and exit without causing more disruption during high traffic times. (Please see parking* lot map for both 1 a & b) - We can stagger bus and parent pick up/drop off if necessary. 2. As far as staff parking, school staff will enter through the very first drive (portico drive) and park in the first spaces on the west side of the lot, filling the spots on Gettysburg Ave. The school staff for maximum parking capacity would be 9. The church and child care staff will park along the north side of the lot, facing the field. Maximum staff for church and child care parking will be 18. Building capacity is as follows: Infants: 8 Young Tods: 12 Older Tods: 14 Preschool child care 20 (2 classrooms = 40 students) PreK-25 K- 15 1st- 15 2nd- 15 3rd- 15 4th -15 5-6-20 7-8-20 Maximum Capacity for students=214 Infant -8th grade For delivery vehicles, they will pull into the main driveway and pull up to the front entrance using the first few spots in front of the building. Our deliveries are not made during high traffic times. The types of delivery vehicles that we have during the school day are a Milk Truck, USPS, Fed Ex, UPS, SpeeDee, Lunch Catering Truck, and once or twice per year a semi truck for playground equipment. Again, these vehicles will pull up to the front of the building where they will unload the product, since the majority of our deliveries do not happen during student pick up/drop off times. Special Event Parking Plan Funerals: Holy Trinity averages 3 funerals per year. Funerals will be scheduled to take place between student drop off and pick up times (Between 11:OOAM and 1:OO.PM). Weddings will only be scheduled after school hours and weekends. Pastoral Conference: 50 pastors in attendance. Holy Trinity would host once every 6 years and schedule between school drop off and pickup or shuttle from a rented parking lot for the day. Advanced control systems compatible with NEMA 7 -pin standards can be utilized with the PER7 receptacle. Dimming Occupancy Sensor (MSPlbIM-LXX, MSPlX-LXX and MSP -LXX) These.sensors are factory installed in the luminalre housing. When the MSP/DIM-LXX sensor option is selected, the occupancy sensor is connected to a dimming driver and the entire luminaire dims when there is no activity detected. Mr. Jeff Alger, Community Development Coordinator/Management Analyst, gave background on the case. The applicant intends to open a liquor store in the easterly tenant bay, while Family Dollar will continue to occupy the westerly portion of the building. The proposed facade improvements would affect the north and west sides of the tenant bay. Because the proposed facade modification would change more than 25% of the building's appearance from the right-of-way, a site plan review is required. Alger then went through the zoning analysis. The materials used will be stucco and stone veneer. Windows will be replaced and the parapet wall will be extended. The applicant does not specify plans to modify the east or south facing walls of the building. A recommended condition of approval would require that these walls be repainted to match or compliment the new fagade. Any new rooftop or ground mounted mechanical equipment would need to meet all screening requirements. Plans indicate the wall sign on the current liquor store would be moved to the new location and installed at the northeast entrance to the building. A sign permit would be required prior to installation. Address numbers are mandatory for each tenant bay to differentiate the two. Current lighting on the building will be used and meets the required 90 degree cut-off requirements. Deliveries will take place in the rear lot on the south side of building. Several maintenance and upkeep issues were noted; exterior storage and trash, overgrown and noxious weeds, dead plants, brush piles, and a large sign laying in the rear yard parking lot. Piles of timbers on the east side of building and uneven cement bollards/pylons were also noted as potential hazards to vehicles and pedestrians. The trash enclosure abutting the rear of the building would need to be retrofitted to meet City Code and utilized by the liquor store and Family Dollar. A new enclosure could also be constructed that would meet all City Code requirements, as recycling is also required per City Code. The building's sprinkler and fire monitoring system must be inspected and tested prior to opening of the business, with inspections occurring annually thereafter. The owner will need to provide the deputy fire marshal with a key to the building, which will be stored in the fire department lock box. The broken sump pump pipe requires repair and to be buried to connect directly to the catch basin in the southeast corner of the parking lot. Alger concluded that proper legal notice, land use signs, and mailing notice were given. Staff did not receive any questions on the proposal. Staff recommends approval of the site plan review with the conditions outlined in the report. When Chair Schmidt questioned whether any of the Commissioners had any questions for staff, Chair Schmidt asked about the eastern wall that was not pictured. Alger responded it is wooded along that side and the hope is the owner will clean up the eastern side when the wall is painted. Commissioner Redden asked if both trash enclosures would need to be retrofitted to comply with city code. Alger confirmed the current enclosures would need to be retrofitted to meet code, or a new enclosure built. Motion by Commissioner Redden, seconded by Commissioner Frazier, to open the Public Hearing. All present voted in favor. Motion carried. The applicant approached podium, Igor Yakovicev, 11 Saratoga Lane N, Plymouth, MN, and stated his contract was for the building facade only, including the windows, doors, and exterior building materials of stucco and stone veneer. Commissioner Landy asked if Mr. Yakovicev was comfortable with the recommendations for approval. Yakovicev said he was. Commissioner Brinkman asked Mr. Yakovicev if fixing the east side of the building is part of his plan. The applicant stated he spoke with the building owner and the plan is to paint and clean up the outside of building on that side. No one from the audience wanted to address the commission. Motion by Commissioner Landy, seconded by Commissioner Redden, to close the public hearing. All present voted in favor. Motion carried. Entirety of east and south walls shall be repainted to match or compliment the proposed facade. 2. Address numbers of a contrasting color to their background and at least six inches in height shall be installed in a location plainly legible and visible from Bass Lake Road. Each tenant bay within the building shall be assigned a different address or suite number. 3. Any new rooftop or ground mounted mechanical equipment shall be identified and meet all applicable screening requirements. 4. Trash enclosure abutting the rear of the building shall be utilized or a new trash enclosure meeting all city Code requirements shall be constructed. If the existing trash enclosure abutting the rear of building is utilized for trash removal service, it shall be retrofitted to be constructed with walls of architectural elements similar to the principal structure. 5. Exterior storage, old signs, trash, dead plants, brush piles, and overgrown/noxious weeds shall be removed from site. Dead plants shall be replaced with city -approved plantings. Property shall continue to be maintained with regular upkeep of landscaping areas and trash removal service. 6. Cement bollards/pylons protruding from parking lot shall be removed or repaired. 7. Sump pump line shall be buried underground, connecting directly to catch basin in the southeast corner of the lot. 8. Sprinkler and fire monitoring system shall be inspected/tested prior to opening. PUBLIC HEARING Chair Schmidt introduced Item 4.2, request for a Conditional Use Permit Planning Case 18-25 (CUP) for expanded outdoor storage at 5130 Winnetka Avenue N, Arvig, Item 4.2 petitioner. 3 Planning Commission Meeting September 4, 2018 Mr. Aaron Chirpich, Community Development Specialist, introduced the case. Arvig, a telecommunications provider, will be moving into the building located at 5130 Winnetka Avenue N. The current outdoor storage available on the site will require expansion to accommodate Arvig's needs. Since the proposed storage area exceeds 20 percent of the gross floor area of the principle building, this case will require a conditional use permit. Next, Chirpich reviewed the zoning analysis. There are three driveway access points off Winnetka Avenue N and vehicle traffic will be controlled by a one-way traffic flow system. The site will require 42-47 parking spaces and the proposed plan meets the parking requirement by offering 48 spaces. The possibility of additional employees added to the location in the future would require additional parking stalls to be noted on the plan and resubmitted. The proposed landscaping plan shows five new trees along perimeter of parking areas that abut Winnetka Avenue. Additional landscaping screening will be required to provide parking lot screening. Shrubs 3-4 feet in height are recommended to maintain sight lines to the building. The landscaping plan must be revised to meet the minimum tree size requirements of 2.5 inches. The outdoor storage area will be screened on the northern perimeter with a 7 -foot tall chain-link fence with privacy slats. The landscaping plan shows a mix of deciduous and coniferous trees, which will provide additional screening. The northwest side of the storage area will be screened with a 7 -foot tall wood privacy fence. Fence and gate detail will need to be provided for final approval. The site plan shows new light fixtures that would need to meet the following requirements: freestanding light fixtures in outdoor storage area must not exceed 25 feet in total height, proposed wall mounted lights will require 90 degree cut-offs, and the applicant must submit a full photometric lighting plan for the entire site illustrating compliant light levels. Perimeter curbing will be required around all new pavement. The proposed storm water pond was reviewed by the city engineer and found to be sufficiently sized to meet the site needs. Additional details will be required before final approval is granted. Chirpich concluded that proper legal notice, land use signs, and mailing notice were given. Staff did not receive any questions on the proposal. Staff recommends approval of the site plan review with the conditions outlined in the report. The applicant shall provide the size and quantity of oversized company vehicles. 2. Fence and gate details shall be submitted by the applicant for city approval. 3. All new parking, driveway, and outdoor storage areas shall be constructed with a continuous concrete perimeter curb. 4. Materials within the outdoor storage area shall not be stacked to exceed the height of the storage area fencing. 5. All new lighting shall have 90 degree cut-off fixtures. Freestanding lights shall not exceed 25 feet in height. Applicant shall provide a photometric plan showing that the site is compliant with the light levels required by city code. 6. The landscaping plan shall be revised to show that all new tree plantings meet the minimum size requirements per city code. The landscaping plan shall be revised to include the placement of a shrub hedge along the western edge of the parking areas along Winnetka Avenue. 7. The applicant shall enter into a stone water maintenance and management agreement with the City (to be prepared by the city Attorney). 8. The applicant will provide record plans or as -built drawings to the city following project completion. 9. The grading, drainage, and storm water management plans shall be subject to review and final approval by the city Engineer. ANNOUNCEMENTS Chair Schmidt commended the Mayor and City Council for the finalists and offered congratulations to Commissioner Frazier. Other Commissioners echoed their congratulations. Mr. Sargent also offered thanks to all who applied for the vacant council seat and extended congratulations to Commissioner Frazier. He also informed the Commissioners that Frazier would be sworn in at the September 10th City Council meeting. Commissioner Landy extended his thanks for the support from the Commissioners and staff and was happy to be back. Commissioner Brinkman asked for confirmation that the bus tour was next week. Sargent said it was and gave a brief background of the tour.
