PROJECT 740 President Opem introduced for discussion Item 4, Resolution ordering Item 4 published notice and scheduling public hearing to approve sale of 7S00, 7Sl6, and 7S28 42nd A venue North to Frey Development and Manley Land Development, LLC (improvement project no. 740). Mr. Shawn Siders, community development specialist, stated the resolution will allow scheduling a public hearing on May 23, 200S. He stated the terms of the sale include: a land acquisition price of $S10,000, property to be transferred in an II as isrJ condition, and the buyer must receive planning approval prior to closing. Mr. Siders stated the developer has indicated that they will submit the planning application on May 13, and it is conceivable that the EDA could review the case at its June 27 meeting. He stated site preparation could begin as early as July. President Opem pointed out that the project includes eight office condominiums and an upscale Italian restaurant. The development is being EDA Meeting Page 1 April 2S, 200S undertaken without any financiai assistance by the city. The EDA conveyed their appreciation to staff for a job well done. Commissioner Hoffe asked Mr. Siders to report to the public regarding liabilities of Electronic Industries for soil contamination. Mr. Siders stated the project can move forward after the Minnesota Pollution Control Agency reviews the redevelopment plans to ensure compliance with the approved Declaration of Environmental Restrictive Covenants. Once approved, the MPCA will issue a "close out" letter which will allow the redevelopment to proceed. He pointed out that because Electronic Industries has been identified as the responsible party for the soil contamination, it will be the responsibility of Electronic Industries to indefinitely provide ground water monitoring of the property. EDA RESOLUTION Commissioner Gwin-Lenth introduced the following resolution and moved 05-02 its adoption: "RESOLUTION ORDERING PUBLISHED NOTICE AND Item 4 SCHEDULING PUBLIC HEARING TO APPROVE SALE OF 7500, 7516, AND 7528 42ND AVENUE NOR1H TO FREY DEVELOPMENT AND MANLEY LAND DEVELOPMENT, LLC (IMPROVEMENT PROJECT NO. 740)." Once a preferred developer is selected by the EDA, city staff requests that the EDA schedule a public hearing to sell the property to the preferred developer at its meeting of June 13, 2005. POLICYIPAST PRACTICE City goal #2 is to pursue the maintenance and redevelopment of commercial and residential properties within the city. The City Council has been addressing the residential portion of this goal through the city's many housing activities, including acquiring properties from willing sellers in designated redevelopment areas. BACKGROUND On August 23, 2004, the New Hope EDA approved a purchase agreement for the acquisition of the property located at 5207 Pennsylvania Avenue North for $80,000. Property closing took place on November 4,2004. On February 14, 2005, the City Council awarded the demolition contract to the Hempel Corporation. Demolition of the site is complete and the site is restored and ready for the construction of a new rnarket rate single family housing unit. On April 1, 2005, city staff distributed proposal forms to various developers that construct single family homes in the area. Those proposals were due by 2 p.m. on Tuesday, May 10, 2005. The redevelopment specifications required that any interested developer offer at least $75,000 for the purchase of the lot and established a $300,000 minimum target value of the house and lot after redevelopment. Al Stobbe Homes A two story home with 1,737 square feet of finished living space above grade was submitted for the city's consideration. The house does not include a two car attached garage; however, it is an option that an individuaJ homebuyer could include if interested prior to redevelopment. The plan indicates that the house is a three bedroom two bathroom unit with an unfinished basement which could increase the living area by 954 additional square feet. The plans indicated a front porch and a rear patio. The existing 30' by 30' garage on- site will have new siding and the roof will be replaced to match the new home. The Hennepin County Assessor's Office has estimated the value of the redeveloped lot and house at $287,400. Al Stobbe Homes has indicated a projected saJes price of approximately $325,000, depending on the level of buyer upgrades. A very Homes A two story home with 2,406 square feet of finished living space above grade was submitted for the city's consideration. The three bedroom two and one-half bathroom will have an unfinished basement of 1,205 square feet which can be finished to increase the living space. The house includes an attached two car garage and the existing 30' by 30' garage on-site will have new siding and the roof will be replaced to match the new home. The plans indicate a front porch will be constructed; however, a rear patio has not been included in the plans. Avery Hornes has indicated a projected sales price of approximately $370,000, depending on the level of buyer upgrades. Accent Homes A multi-level home with 2,160 square feet of finished living space was submitted for the city's consideration. The proposed home resembles a rambler style home. The three bedroom and three bathroom home will have an unfinished living area of 560 square feet which can accommodate additionaJ living space. The house includes an attached two car garage and the existing 30' by 30' garage on-site will have new siding and the roof will be replaced to rnatch the new home. The plans indicate a front porch will be constructed; however, a rear patio has not been included in the plans. The Hennepin County Assessor's Office has estimated the value of the redeveloped lot and house at $320,800. Accent Homes has indicated a projected saJes price of approximately $325,000 to $340,000, depending on the level of buyer upgrades. Request for Action May 23, 2005 Page 3 RECOMMENDATION In order to facilitate the evaluation of these proposals, city staff developed a ratings matrix which assigned points based on a number of factors that were both objective and subjective. For instance, the above grade finished square footage was assigned a points value and the proposal with the most finished square footage above grade received the maximum point value for that category. Based on the objective and subjective point values assigned, city staff recommends that the EDA consider awarding the redevelopment of the city owned property at 5207 Pennsylvania Avenue North to Avery Homes. The plan most closely resembles the redevelopment specifications that were previously approved by the City Council and the proposed home has substantial room in the basement to expand the living area without increasing the proposed building envelope. The proposed attached two car garage will provide convenience to the future residents of the home and the oversized garage in the rear of the property will offer substantial storage and work area for the residents. Staff would recommend that the EDA consider two conditions to that approval and that would be to require the installation of a rear patio during the redevelopment of the property. City staff has discussed including a rear patio with the proposed developer and they have indicated that can be addressed. Secondly, the proposed curb cut larger than can be approved by the city without a variance. In that regard, city staff would recornmend that the EDA require that the curb cut and driveway width meet the New Hope City Code requirement of a maximum of 24 feet in width. Once the driveway extends beyond the boulevard area, the driveway can increase beyond 24 feet in width to accommodate access to the garage/workshop located in the rear of the property. In order to expedite the redevelopment of the property, city staff will allow A very Homes to submit building plans for review once they have submitted the required $1,000 deposit prior to closing. That deposit rnust be submitted to the city prior to the EDA meeting of June 13, 2005. If the EDA directs staff to transfer the property to Avery Homes, city staff will develop a purchase agreement to be considered by the EDA at its meeting of June 13, 2005, at the conclusion of the public hearing. If the purchase agreement is approved by the EDA on June 13, 2005, city staff will immediately coordinate the land transfer so that the house can be completed on or around December 1, 2005. The preliminary estimate was $105,000, so the final cost estimate of $91,655 is $13,345 less than the anticipated cost. POLICY PAST PRACTICE The EDA routinely takes action on redevelopment projects that meet the goals of both the Comprehensive Plan and the city plan. The EDA previously approved the burial of overhead utilities on the east side of Winnetka A venue south of Bass Lake Road in conjunction with the Winnetka Green redevelopment project. BACKGROUND At the June 21, 2004, City Council work session staff discussed a number of items regarding the redevelopment projects currently underway in the Livable Communities area near the intersection of Bass Lake Road and Winnetka Avenue. Per the direction from the Council, staff coordinated with Xcel Energy on the burial of overhead utilities along the east side of Winnetka between 53rd Avenue and the south side of Bass Lake Road, as part of the Winnetka Green redevelopment project. This project was completed in the fall of 2004. The Council also directed that staff coordinate on the burial of overhead utilities north of Bass Lake MOTION BY Ilnl~ SECOND BY TO: I:RFA Request for Action Page 2 5-23-05 Road in conjunction with the Winnetka Townhomes redevelopment project, as the long-term goal of the city was to bury overhead utilities whenever possible with redevelopment projects for aesthetic and safety purposes. Staff requested a scoping and preliminary cost estimate from Xcel Energy for this project and Xcel provided preliminary cost estimates for two options, which were presented at the March 28 EDA meeting, as follows: . Option 1: The cost to underground existing overhead facilities from the north side of Bass Lake Road to approximately 5620 Winnetka Avenue, $60,000. . Option 2: The cost to underground existing overhead facilities from the north side of Bass Lake Road to 58th A venue, $105,000. On March 28, the EDA selected Option 2 and authorized staff to request a detailed estimate on that option. The city received the final cost estimate on the burial of overhead electric facilities north of Bass Lake Road on Winnetka Avenue from Xcel Energy on May 9 as follows: . The cost to underground existing overhead facilities frorn the north side of Bass Lake Road to 58th Avenue, $91,655. Staff requests that the EDA approve a motion authorizing the burial of overhead utilities as proposed. Staff would then request that Xcel Energy prepare a "Statement of Work Request" to get the project on schedule. FUNDING The project is located in an area where a TIF District was specifically created for the Winnetka Townhomes redevelopment project. Per the director of finance, it was intended that costs for some Infrastructure improvements, such as burial of overhead utilities, ponding improvements and sidewalk improvements, would be paid for out of the TIP revenue stream created by the district. The two options vary by the northern extent of which the lines are buried. Both option begin the burial of lines at Bass Lake Road and extend north to: . Option 1: approximately 5620 Winnetka Ave (north side of Winnetka Townhomes) . Option 2: 58th Ave N (north side ofWinncrest Apartments) Rough cost estimates, $60,000 for Option 1 and $105,000 for Option 2, have been provided by Xce!. Xcel also stated that a more detailed Engineering Estimate would be required based on the city's final design. This relates as to which of the two options is selected for further exploration. The city has planned the construction of a storm sewer improvement in this area for 2006. (Refer to the attached figure.) Option 1 has been reviewed and appears feasible to complete in regards to existing utilities and the current sidewalk project design. Selection of Option 2 would require further investigation and coordination between the burial of the lines and the proposed storm sewer project along that section of the Winnetka Avenue corridor. Option 2 appears to be feasible. However. if Council chooses Option 2, we should meet with Xcel to review the scope of the storm sewer project to coordinate the designs.
