DATE: PLANNING CASE: PETITIONER: REQUEST: LOCATION: ZONING: January 8, 1985 85 - 1 Nevada Partners Conditional Use Permit for Outdoor Storage 2900 Nevada Avenue North I-1 STAFF FINDINGS AND COMMENTS: 1. The petitioner is seeking a conditional use permit to.store up to six trailers to the rear of his building on unimproved property. 2. The building has just been completed and recently occupied and the petitioner has been storing the trailers and other equipment outside when discovered by the Inspections Department. Council had approved a two phase office/warehouse for this site in 1984. To date, phase I has been built. The trailers will be parked in what is~know as phase II. 3. No screening is proposed. Zoning Code does not require screening unless the open storage abuts a residential district or use. There is a parcel at the west property line that is in the I-1 zoning'dis- trict, but is used as a residence/business. The parcels to the north and east are also I-1. 4. There are a couple of concerns that staff would like to bring forth. One is that the outdoor storage should be clearly defined. As I un- derstand Nevada Partners is a mechanical contractor and the opportunity exists for a lot of equipment to be stored outside, much like that found at the Egan-McKay site at Medicine Lake Road and Louisiana. Another concern is what is going to happen with phase II of the development. The entire site is going to be very crowded when this is completed and the city should have some idea what is going to happen to the storage in the event that the entire site is developed. 5. Staff would recommend approval as long as the storage is clearly defined and that there is some yearly review. There is precedent in the past for requiring screening, even though an industrial does not abut to residential property. This perhaps should be explored further. !ADA ,Sf~.O0 N O' I1' 'N / D_~8.00 -- ..S 0° ii' lO DATE: PLANNING CASE: PETITIONER: REQUEST: LOCATION: ZONING: January 8, 1985 85 - 2 Gregory Davis Sideyard Setback Variance 7808 39th Avenue North R-1 STAFF FINDINGS AND COMMENTS: The petitioner is seeking to put an addition on their home that appears will set eight feet from the sideyard lot line instead of the required ten feet on the non garage side. I attempted to allow the petitioner to work around the variance request last month and got some folks got upset in the process. This is a minor variance and they were under the gun to get going~ because of some family situations. It became apparent that nobody was quite sure how far into the setback the proposed addition was coming so in the end I informed the petitioner that they would have to wait for the Planning Commission and Council b~{ote proceeding. The petitioner was a bit upset about the inconsistency, but I must maintain that I was only trying to help.the petitioner get going and address the variance after the fact. This is a good example perhaps of a minor variance that could be addressed at a staff level rather than at Planning Commission and Council. The next couple of months, staff will be coming forth with a recommendation on just such a minor variance policy for review by the Planning Commission and Council. At this time the Planning Consultant and I are working on putting this together. 4. Staff recommends approval with the required survey if the variance request is approved.
